이창신(72쪽) : 대학 관계자들 중에도 성도덕이라는 전통적 사고를 강조하는 것을 자신의 임무로 생각하는 사람은 거의 없었다.
“no longer”를 번역하지 않았다.
“enforce”를 “강조”로 번역했는데 “강요”나 “강제”가 어울린다.

Sandel(48쪽) : it was immoral, they thought, for unmarried young women to spend the night with men. But times had changed, and the traditionalists were embarrassed to give the real grounds for their objection. So they translated their arguments into utilitarian terms. “If men stay overnight,” they argued, “the costs to the college will increase.”
이창신(72쪽) : 이들은 결혼하지 않은 젊은 여성이 남자와 함께 밤을 보내는 것은 부도덕하다고 생각했다. 하지만 시대는 변했고, 전통주의자는 자신의 반박을 뒷받침할 현실적인 근거를 찾느라 쩔쩔맸다. 그러다 자기 주장을 공리주의 용어로 바꿔 말했다. “남자가 자고 가면 대학의 비용이 증가할 것이다.”
“real grounds”를 “현실적인 근거”로 번역했는데 “진짜 이유”라는 뜻이다. 남학생이 여학생 기숙사에서 자고 가는 것을 반대하는 진짜 이유는 성교를 할 것이라는 우려 때문인데 시대가 변했기 때문에 그런 이유에 대해 솔직히 이야기하지 않았다는 말이다.

이창신(72쪽) : 개혁주의자들은 전통주의자들을 만나 타협안을 제시했다.
여기서 “meet”는 “만나다”가 아니라 “응수하다”라는 뜻이다.

이창신(74쪽) : 정부는 개인의 자유를 간섭하면서 개인을 보호하려 들거나 다수가 믿는 최선의 삶을 개인에게 강요하지 않아야 한다.
“from himself”를 빼 먹고 번역했다. 개인을 그 자신으로부터 즉 자신의 잘못된 생각이나 행동으로부터 보호하려 든다는 말이다.

Sandel(49쪽) : This unyielding account of individual rights would seem to require something stronger than utility as its justification.
이창신(74쪽) : 개인의 권리를 이처럼 단호하게 주장하려면 공리보다 더 강력한 무언가가 필요할 듯싶다.
“justification”를 빼 먹고 번역했다. “정당화”를 삽입하여 번역했다면 의미가 더 분명히 전달되었을 것이다.

Sandel(49쪽) : Isn’t it possible, even likely, that banning the religion will produce the greatest happiness for the greatest number?
이창신(74쪽) : 이때 절대 다수의 절대 행복을 위한다면 그 종교를 금지할 수 있지 않겠는가?
전체적으로 의미가 정확히 전달되지 않는 번역이다.

Sandel(49쪽) : But if the majority is big enough and passionate enough in its hatred of the heretics, its collective happiness could well outweigh their suffering.
이창신(74쪽) : 하지만 그 종교를 금하자는 이들이 절대 다수이고 이교도를 향한 증오도 깊다면, 전체 행복은 소수의 고통을 훨씬 능가할 수 있다.
두 번 등장하는 “enough”를 제대로 번역하지 않았다.
“its collective happiness”를 “전체 행복”으로 번역했는데 사회 전체의 행복이 아니라 다수의 행복을 말한다.

Sandel(50쪽) : It is proper to state that I forego any advantage which could be derived to my argument from the idea of abstract right, as a thing independent of utility.
이창신(74쪽) : 내가 막연한 권리 덕에 남보다 유리한 입장에 선다고 판단된다면, 그런 이익은 공리와 무관한 것이어서 거부하겠노라고 말하겠다.
“abstract right”를 “막연한 권리”로 번역했는데 “추상적 권리”가 정확한 번역이다.
“abstract right, as a thing independent of utility”가 한 묶음이다.
논증에서 유리한 입장에 선다는 말인데 마치 사회 생활 등에서 유리한 입장에 서는 것처럼 번역했다.

Sandel(50쪽) : Mill thinks we should maximize utility, not case by case, but in the long run.
이창신(75쪽) : 밀은 우리가 공리를 극대화하되, 매 순간이 아니라 장기적인 관점에서 그리해야 한다고 생각한다.
“not case by case”를 “매 순간”으로 번역했는데 “사례마다”가 더 정확한 번역이다.

Sandel(50쪽) : Allowing the majority to silence dissenters or censor free-thinkers might maximize utility today, but it will make society worse off—less happy—in the long run.
이창신(75쪽) : 다수가 반대 의견을 막거나 자유사상가를 검열할 수 있다면 오늘 당장 공리가 극대화될지 몰라도 장기적으로는 사회의 불행이 늘고 행복은 줄 것이다.
“worse off—less happy—”를 “불행이 늘고 행복은 줄 것이다”로 번역했다. 여기서 “worse off”는 “악화된다”는 뜻이며 행복이 줄어드는 것 자체가 사회의 악화다.

Sandel(50쪽) : Wouldn’t the utilitarian have to conclude that, in such a society, individual rights are not morally required?
이창신(75쪽) : 공리주의자들은 그런 사회에서는 개인의 권리가 사실상 꼭 필요치는 않다고 결론짓지 않겠는가?
“morally”를 빼 먹었다.

Sandel(51쪽) : Forcing a person to live according to custom or convention or prevailing opinion is wrong, Mill explains, because it prevents him from achieving the highest end of human life—the full and free development of his human faculties.
이창신(76쪽) : 밀은 관습이나 관례 또는 다수 의견을 따르라고 강요하는 행위는 잘못이라고 말한다. 그럴 경우, 사람들은 능력을 한껏 발휘해 삶의 최고 목적을 달성할 수 없을 것이기 때문이다.
능력을 발휘해 다른 어떤 목적을 달성한다는 말이 아니라 “the full and free development of his human faculties” 자체가 삶의 최고 목적이다.
“free”를 번역하지 않았다.

Sandel(51쪽) : Since it appeals to moral ideals beyond utility—ideals of character and human flourishing—it is not really an elaboration of Bentham’s principle but a renunciation of it, despite Mill’s claim to the contrary.
이창신(77쪽) : 공리를 넘어서는 도덕적 이상인 인격과 인간 번영이라는 이상에 호소한다는 점에서 벤담의 원칙을 다듬은 것이 아니라 비난한 꼴이 되었기 때문이다. 물론 밀은 그 반대라고 주장하지만.
“renunciation”는 “비난”이 아니라 “포기”다.

Sandel(52쪽) : In Utilitarianism (1861), a long essay Mill wrote shortly after On Liberty, he tries to show that utilitarians can distinguish higher pleasures from lower ones.
이창신(77쪽) : 《자유론》에 이어 집필한 긴 수필 《공리주의》에서 밀은 공리주의자들이 저급 쾌락과 고급 쾌락을 구분할 줄 안다는 것을 보여주려 애썼다.
여기서 “essay”는 “수필”이 아니다.

“simply”를 “단순한”으로 번역한 듯한데 잘못 번역했다.

이창신(81쪽) : 물론 개중에는 교양 없는 사람으로 보이고 싶지 않아서 셰익스피어를 더 좋아한다고 말하는 사람도 있을 것이다.
“they are sitting in a classroom”를 빼 먹었다.

Sandel(55쪽) : A being of higher faculties requires more to make him happy, is capable probably of more acute suffering . . . than one of an inferior type;
이창신(81쪽) : 고급 능력을 가진 사람은 그보다 못한 능력을 가진 사람보다 (……) 더 많은 노력을 해야 행복해질 수 있으며, 어쩌면 더 심한 고생을 해야 할 수도 있다.
“more acute suffering”를 제대로 번역하지 않았다.

Sandel(55쪽) : Mill thinks the reason has something to do with “the love of liberty and personal independence,” and concludes that “its most appropriate appellation is a sense of dignity, which all human beings possess in one form or other.”
이창신(81쪽) : 밀은 그 이유가 “자유와 개인의 자립에 대한 애정”과 관련 있다고 생각했고, “그것을 가장 적절히 표현하는 말은 존엄이며, 인간이라면 누구나 어던 형태로든 존엄하다”고 결론짓는다.
“the love of (liberty and personal independence)”도 해석했는데 “(the love of liberty) and (personal independence)”인 듯하다.
“존엄하다”는 잘못된 번역이다. 누구에게나 “a sense of dignity”가 있다는 말이다.

Sandel(55쪽) : Everyone gives in to the impulse to be a couch potato once in a while. But this does not mean we don’t know the difference between Rembrandt and reruns.
이창신(81쪽) : 누구나 가끔은 소파에서 빈둥거리고 싶은 충동에 굴복하기 마련이다. 그렇다고 렘브란트와 텔레비전 재방송의 차이를 모른다는 뜻은 아니다.
“couch potato”에서 핵심은 “TV나 보면서”인데 빼 먹고 번역했다. 바로 다음 문장에 “재방송”이라는 단어가 나오기 때문에 어느 정도 유추할 수는 있지만 “Everyone gives in to the impulse to be a couch potato once in a while.” 자체는 제대로 번역되지 않았다.

Sandel(56쪽) : The higher pleasures are not higher because we prefer them; we prefer them because we recognize them as higher.
이창신(82쪽) : 어떤 쾌락이 고급인 이유는, 우리가 그것을 더 좋아해서가 아니라 고급이라고 생각하기 때문이다.
“we prefer them because we recognize them as higher”를 제대로 번역하지 않았다.

Sandel(56쪽) : Not only did he provide strict instructions for his body’s preservation and display, he also suggested that his friends and disciples meet every year “for the purpose of commemorating the founder of the greatest happiness system of morals and legislation,” and that when they did, they should bring Bentham out for the occasion. [문단나누기] His admirers have obliged. Bentham’s “auto icon,” as he dubbed it, was on hand for the founding of the International Bentham Society in the 1980s. And the stuffed Bentham is reportedly wheeled in for meetings of the governing council of the college, whose minutes record him as “present but not voting.”
이창신(83쪽) : 그는 자신의 시신 보존과 전시에 관해 엄격한 지시를 내렸을 뿐만 아니라, 해마다 모임을 열어 “도덕과 입법에서 최대 행복 체계를 만든 사람을 기릴 것”을 친구와 제자들에게 제안했다. 그 모임에서는 벤담을 부각시켜야 했다. [문단나누기] 추종자들은 그의 뜻에 따랐다. 벤담 스스로 ‘자기 성상’이라 이름 붙인 성상이 1980년대에 국제벤담학회 창설 모임에 참석했다. 유니버시티 칼리지 런던 운영위원으로 구성된 이 모임에 박제된 벤담이 휠체어를 타고 참석했다고 전해지는데, 회의 의사록에는 그가 “참석을 했지만 의사결정권은 없는” 사람으로 기록되었다.
“bring Bentham out”을 “벤담을 부각시켜야”라고 번역했는데 “벤담을 출석시켜야”라는 뜻인 것 같다.
방부 처리된 시신을 말하므로 “성상”은 어울리지 않는다.
“이 모임”이라고 번역했는데 “the founding of the International Bentham Society”와 “meetings of the governing council of the college”는 서로 다른 모음이다.
