학생인권조례는 학생, 보호자, 교직원, 시민사회단체, 의회 등의 광범한 지지를 받아서 제정되었다.
한 교사가 “학부모의 집요한 민원 제기에 힘들어 하며” 생명의 끈을 놓은 것으로 알려진 사건을 계기로 ‘교권을 보호하자’는 여론이 일고 있다. 고인의 명복을 빌며, 일부 보호자들이 교사에게 ‘아동학대방지법’을 악용한다는 것에 우려를 표한다. 이번 사건에 대한 진상조사를 철저히 하고, 1) 오남용되는 아동학대방지법의 일부 조항을 개정하고, 2) 생활지도하기 어려운 학급을 새내기 교사에게 맡기는 교육행정을 개선하며, 3) 교사의 교육권을 정립할 수 있게 되길 기대한다.
이번 사건에 책임이 큰 교육부 장관과 대통령이 ‘학생인권조례’ 때문인 것처럼 인식한 것은 잘못되었다고 본다. 교육권 침해 사건의 빈도 등은 학생인권조례의 제정(시기, 지역) 여부와 별로 상관이 없다는 것이 증명되고 있다. 학생인권조례는 “교직원의 정당한 교육·연구활동을 방해해서는 안된다”고 규정하고 있다.
예컨대, 2011년 10월 5일에 제정된 ‘광주광역시 학생인권 증진 및 보장에 관한 조례’의 제9조에는 다음 내용이 있다. 제9조(학생인권 보장의 원칙) ① 이 조례에서 규정하는 학생의 인권은 학생이 인간으로서 존엄을 유지하고 행복을 추구하기 위하여 반드시 보장받아야 하는 최소한의 권리이며 이 조례에 열거되지 아니 한 이유로 경시해서는 아니 되고 「헌법」과 「유엔 아동의 권리에 관한 협약」에 의거 최대한 보장하여야 한다. ② 학생은 자신의 권리를 주장하기 위해 타인의 인권을 침해하거나 교직원의 정당한 교육·연구활동을 방해해서는 아니 된다.
