버지니아 총기사건으로 접어야만 했던 UN앞 Human Rights 달리기
안녕하십니까?
한국사법피해자 모임(총무 정국정)의 김정도입니다.
우선 버지니아 공대 한국학생 총기난사 사건 희생자의 명복을 빌며 그 유족에 대하여 한국 국민의 한 사람으로서 그리고 사법피해자들을 대신하여 심심한 애도의 뜻을 전하고 싶습니다. 아울러 부상자의 쾌유를 빌어 마지않겠습니다.
본인은 지난 3월12일 출국 시 지우들로부터 “검찰의 부패를 국제사회에 알린다고 검찰이 꿈쩍이나 할 것 같은가?”, “누워서 침 받기 식이다”등의 비난과 걱정을 뒤로 한 채 미국에 온 것이다. 물론 미국이라고 해서 법조비리나 각종 사회적 문제가 없는 것은 아닐 것이다.
그런데도 미국에 온 이유는
첫째, 미국은 범죄를 행사하려는 집단이나 사람이 아니라면 법과 원칙이 지켜질 수 있고, 우리와 같이 법을 지키면 손해가 아니라, 안 지키는 사람이 분명히 불이익을 받게 되었고, 국민이 국가를 신뢰할 수 있도록 장애인 또는 상대방을 배려하는 등 모든 기초질서가 지켜질 수밖에 없게 되었고, 그 결과도 대다수 국민들은 정부를 신뢰하는 것을 느낄 수 있었다(미국에서는 김명호교수 사건이나, 부당한 검찰권행사에 기인한 안산시 등의 구조적 비리인 지역난방사건은 발생자체가 불가능하였다고 판단됨)
둘째, 미국에는 세계인의 인권과 평화를 지키려는 UN본부가 있고, 그 사무총장도 한국인이다. 그렇다고 그를 만날 수 있는 것도 아니다. 그래서 지난4월13일 인권관련(Human Rights)서한을 반기문총장에 보냈다(NY: Certified mail #...3958 4955-별첨참조)
그러나 25년만의 뉴욕 한파, 폭풍, 폭우, JFK 공항의 차디찬 시멘트 의자에서의 새우잠, 심한 몸살에서 장고의 장고를 거친 결과 “각국 외교관 및 관광객이 지나는 UN앞을 대형 태극기를 휘날리며 달리기 착상”, YMCA의 Peter 지배인의 Human Rights 달리기를 배려한 숙박 가능(불의대처노력 인정됨), 어렵게 구한 대형태극기 등 우여곡절 끝에 UN앞에서 가슴과 등에 아래와 같은 구호를 달고 대형태극기를 휘날리며 달리기를 시작했다

UN앞 달리기
처음 한 시간 정도 UN앞과 주위(약500M?)를 반복적으로 달렸지만, 조깅하는 정도로 생각하는 것 같았다. 그러나 2시간이 넘자 근처에 있던 사람들이 박수를 보내왔다. 얼마 후 한 외국인이 같이 달리기 시작했다. 그는 왜 달리며 나이를 물었다. 나는 67세로서 한국의 사법피해자의 인권을 위해 달린다고 했다. 그 외국인은 자기는 10KM도 뛰기 힘든데 그 나이로 대단하다고 하였다. 한 바퀴를 같이 뛴 후 그는 태극기를 자신이 들고 그의 동료들과 함께 사진도 같이 찍었다. 나중에는 경찰과 행인들도 길을 비켜주거나 격려를 보내왔다.
LA총영사관 앞 비리검찰성토시위는 취재를 했지만 보도는 안 되었다. 그래서 방법을 바꾼 것이다. 그 동안 뉴욕에서 도움을 주던 교포들에게 UN앞에서 약4주를 달린 후 워싱턴, 샌프란시스코 등 약 3개월 정도 달리기로 이미 계획을 세웠기 때문에 작은 응원들이지만 무관심보다는 나름대로 격려가 되었다. 산을 움직인다는 심정의 장고의 장고를 거듭한 보람도 있고, 주위에서도 태극기로 UN앞 등 달리기를 긍정적으로 평가했다.
미국에서는 결코 생각, 학연, 배경만으로는 성공할 수 없다. 부단한 노력과 창의력 그리고 불의대처 노력 등 감동적인 결과도 인정되기 때문이다. 미국에서 성공한 한국인 예술가, 골프, 야구선수 등의 예를 살펴보면 왜 그런지 그 이유를 알 수 있을 것이다.
그런데
달리기를 마치고 뉴욕한인회사무실로 돌아왔다. 그런데 버지니아 총기난사범인이 한국인으로 밝혀졌다고 하면서 “때가 때인 만 큰 태극기는 오리려 미국인들의 감정을…”
CNN은 연일 총기사건보도가 전부였다. 범인이 한국사람(South Korea) 자막이 여러 번 나와 교포들도 긴장하기 시작했다. 나 역시 그 동안 알게 된 미국인들에게 너무 부끄러웠다.
결국 나는 그토록 어렵게 시작한 UN 달리기를 접기로 한다고 하였다(무소불위 한 검찰권 행사에 의한 인권탄압을 알 리는 데는 더 좋은 기회가 될 수도 있었음)
그러나 비리 검사 성토 시는 자랑스러웠던 태극기였지만, 한국학생 총기난사사건 후는 태극기나 한국민이 비난과 조롱의 대상이 될 수도 있기 때문이다. 왜냐하면, 남의 아픔과 불행을 무시하고 나의 목적을 달성한다는 것은 국제사회인으로서의 예의도 아니 지만, 자신들의 부정한 처분에 기인한 사법피해자들의 물심양면의 고통은 아랑곳없이 오직 검사라는 사회적 직분만은 반드시 지키려는 검찰을 비난할 자격은 더욱 없기 때문이다. .
지금 우리가 관과 하고 있는 것은 우리민족의 저력과 우수성이 무사안일 한 정치권력과 무소불위 한 검찰권 행사 때문에 사장되고 있다는 점이다. 국력 소모인 셈이다. 그런 사실들은 선진국을 다녀보면 누구든 체험할 수 있기 때문이다. 그런 점에서 과연 언론은 국민의 알 권리를 다하고 있는지 묻지 않을 수 없다.
그러나 문제는 현실적으로 올바른 정치철학과 덕목을 지닌 지도자가 나타날 때까지의 대안은 바로 부당한 방법의 기소독점에 의한 국가, 사회적 병패를 최소화하는 것이다. 이제는 정치권, 법조계, 관련학계, 언론, 사회종교단체 등의 기소독점병폐에 의한 국가사회에 미치는 영향에 대한 연구와 그 대안제시를 할 때도 되었다고 본다. 국가생존과, 사회정의, 국민의 삶의 질 향상과도 직결된 중대한 문제이기 때문이다.
그 동안 나는 비록 법적인 지식은 아니지만 보통사람의 상식으로 미국의 법대 생, 현직교수, 검사등과의 소중한 대화를 가진 결과 “미국법조에도 문제가 있지만 배심원제도가 있는 등 검사의 막무가내 식은 상상키 어렵다”, 거나 우리법조인들은 부당한 검찰권행사에 기인한 지역난방사건을 맡기를 사양하였으나 한 미국변호사로부터 사건을 도와줄 수 있다는 제의를 밭는 등 어느 정도 America Cares란 모험적인 제목을 사용한 의미를 나름대로 확인 할 수가 있었으나 그 사연들은 다음기회로 미루겠다.
결론
현실 불신사회의 요인은 다양할 것이다. 법과제도가 미흡한 것도 한 예일 것이다 그러나 금번 미국방문에서 느낄 수 있었던 것은 무사안일 한 정치권력과 무소불위 한 검찰에 기인 했 다기 보다는 그런 모순을 개선치 않고 숙명으로 받아드리고 있는 우리국민들의 의식 구조적 문제가 더 심각하다는 것은 느낄 수 있었다. 투명한 검찰개혁을 공약하는 국회의원을 선출하면 되기 때문이다. 아니면, 법과 제도개선이전 부패한 검찰이 법이라는 이름으로 행사한 부당한 처분에 고통을 맡고 있는 사회적 약자들에게 부끄러움만 느낄 수 있어도 우리의 사법개혁은 성공한 것과 다름없다고 확신하는 바이다. .

I'm providing this Expose' of committed by a few South Korean Prosecutors for public scruitiny . "It's a shame to report to the international society. But It's a sin when you don't talk about and inhuman acts you know about".

My name is Jung Do Kim, aka JD Kim. I'm 67 years old and from Seoul, Korea. I am a victim of the prosecutorial system that has kept my nation in bondage since the departure of the Japanese in 1945.
One might think our national president or our law makers would be in charge of our nation's justice, that's not true. I've used all the legal processes and formalities available to me, but our president nor our lawmaker's showed any concern about the appeal's by victims of these criminal acts. That's the reason why I'm exposing to the International society and the rights of citizens of the member countries of the United Nations.
What's at stake? Only $500,000,000!!
Over the last ten years the following public prosecutors harassed me with illegal arrest, illegal prosecution, denied evidence in my favor, abused their official positions and ignored judicial decisions: Kim, Young-Joon; Jung Hui-Chang; Kim, Won-Chi; Kim, Jin-Won; Kwon, Jae-Jin; Lee, Sun-Hyuk; Hwang, Un-Young and Lee, Gui-Nam, to name only a few. Later, I was found 'Not Guilty' by the South Korean Supreme Court (case # 2002DO5515), but my cause was useless because the Supreme Prosecutor dismissed all charges pending against those who were suspected of committing crimes against my community and me(case # 2002hyung14675).
That's why I demonstrated in front of the SK Supreme Prosecutors' Office to ask them to "Stop the MENTAL torture and physical experimentation on humans by unwarranted investigations and persecution" Now I've been demonstrated in front of The Korean Consulate General in LA since March 21st... Next will be the UN.
Your advice or thoughtful comments could rescue many victims of criminal acts. Because it's not only the prosecutors' wrong doing, but also it's a political reason that they did not exercise 'due process' to protect victims of criminal acts.

Who cares? We are told that Human Rights are recognized in both the Republic of Korea (ROK) in South Korea and in the Democratic People's Republic of Korea (DPRK) in North Korea. Human Rights actually do not exist in the DPRK and those who stand for human rights there are never heard from again.
But, in South Korea our government claims to uphold Human Rights. Yet, my experience proves otherwise. In my case, Human Rights were ignored and when I challenged illegal actions by the government, I have suffered the consequences. Thus my plight!
Of course the ROK has become an economic miracle and is joining the advanced nations of the world. However, our government pays more attention to scraps of bones found in imported beef from America (current FTA talks), than it does for the Human Rights of its citizens.
I now suffer from insomnia and impaired fasting glucose(one who do not controls of food or not exercise, or stress may change to worse as diabetes). But, through it all I have continued to plead my case. Over the past ten years I have maintained my sanity by jogging. I have overcome my physical stress by running. In October last year I ran the 42 kilometer marathon held in Chuncheon, Korea. Maintaining my physical condition has given me the stamina to continue my struggle against the wrongs committed by these undeserving public prosecutors.
In my nation, Money equals Not Guilty; No money equals Guilty! You have heard that before, I'm sure, but someone has to stand up and be counted. Otherwise, Human Rights is only a slogan, a WORTHLESS SLOGAN!
Where can I go for Justice? That's why I'm here on the doorsteps to the United Nations. This is where citizens of the world come when they can't get a resolution. I'm not here to beg for sympathy, nor financial help.
But your thoughtful comments could give significant courage and hope to Korean victims of Human Rights abuse.
My humble requests
* UN Secretary-General Ban Kil-moon should initiate an investigation about the Human Rights abuses perpetrated by South Korean prosecutors(if needed; The Court decision, evidence, related DVD will provide).
* I, JD Kim, a victim of criminal acts want to testify about these instances of criminal acts to the UN as well as the US Congress.
To The South Korean Government and subject Prosecutors
* Are the victims of criminal acts not afforded human rights guaranteed by our constitution?
* Are the Prosecutors have an authority to ignoring The Court decision?
* Is the finding of a piece of bone in imported beef from the U.S. a more important issue than human rights infringement caused by criminal acts committed by out of control prosecutors?
* Stop the MENTAL torture and physical experimentation on humans by unwarranted investigations and persecution.
* A few Korean Prosecutors can destroy a DEMOCRACY.
Why am I visiting The U.S.?
1). I've expended more than 10 years in suffering caused by court actions taken against me because I reported a heating scam to the town Prosecutor where I live in Ansan city, South Korea.
Why 10 years?
Because the prosecutors never prosecuted the government officials who were suspected of masterminding the heating scam. Which the Korean Supreme Court recognized as factual.
In Korea the prosecution is monopolized by the prosecutor. So, even a murder can't be punished, if the prosecutor doesn't initiate or prosecute the case.
I will soon approach 70 years of age, but I'd rather die than let these corrupt prosecutors escape punishment. If we do not correct the wrongs committed by these evil prosecutors how will we prevent them from illegally prosecuting our nation's children such as the attached case like mine.
2). On January 15, 2007, a former notable professor threatened a judge with a crossbow in South Korea. The professor was arrested. But, his family and netizens conducted a strong campaign of criticism toward the Prosecutor and The Court. The professor was unfairly treated. The judge reversed his statement so the professor should releas immediately.
Many Korean people wanted to know the real reasons why he threatened the judge with a crossbow, But the question is: "Will the prosecutor pursue the truth?" That is the reason why I'm appealing to America and the Justice most citizens of the U.S. enjoy.
3). The South Korean constitution states that: "All people are equal under the constitutional law." But a weak or lower income person without money will never be treated as equal under the law. / JD Kim / THANK YOU !
