선전포고를 하지 않고 기습공격을 감행하는 주체는 실제로는 그 전쟁발발자 내지 그 전쟁유발자였다는 사실을 역사 속에서 확인할 수 있다.

한국전쟁의 역사를 돌이켜보면, 선전포고 없는 북한의 남침으로 서울이 점령되는 전쟁초기 역사가 그 예이다.

러시아가 우크라이나를 침공하면서 공식적인 선전포고는 없었다. 대신 러시아는 "특별 군사 작전"을 개시한다고 선언했다. 이는 선전포고와 달리 전쟁을 공식적으로 선포하는 것은 아니지만, 군사력 사용을 정당화하는 명분으로 전쟁발발자인 러시아 측에 의해 활용되었다.

한 국가가 다른 국가에 공식적으로 전쟁을 선포하는 선전포고는 한국전쟁 이전에 있어서 중요한 외교 형식절차였다.

예를 들어 프랑스의 대독 선전포고는 1939년 9월 3일, 독일의 폴란드 침공 이틀 후 프랑스 제3공화국의 나치 독일에 대한 선전포고였다.

미국의 전 대통령 프랭클린 D. 루스벨트가 1941년 12월 8일, 일본의 진주만 공격 다음날인 이 날 미국 의회에 일본에 대한 선전포고를 요청했다. 또한, 12월 11일에는 독일과 이탈리아가 미국에 선전포고하자, 미국 의회는 이들에게도 선전포고를 승인했다. 미국이 이러한 절차를 밟은 이유는 미국 헌법상 유일하게 의회만이 독자적으로 가지고 있는 권한이 선전포고이기 때문이다. 이런 측면에서 이 미국의 선전포고는 더 정확히 말하자면 의회의 전시상태 선언이다. 이때 적대세력 지목도 함께 한다.

물리적 전쟁이 아니라 경제측면에서는 어떠한가?

2025년 관세 전쟁의 그 대표적인 예이다.

끝장을 보자는 “선전포고” 국가에 대한 책임보다, ‘누가 선전포고를 하게 만드는가?’에 더 주목하여 그 원인을 찾아야 하기 때문이다.

공격할 의사가 있는 국가가 적국에 선전포고하면, 그 적국도 맞 선전포고하면서 전쟁이 시작된다는 순서를 그대로 밟는다는 측면도 유사하다.

그러나 이러한 정석도 밟지 않는 비열한 주체도 또한 이 바닥에 있다.

민간기업 간에는 선전포고 없이 상대를 공격하는 경우도 많았으며, 이를 ‘기습의 형태 답습’이라고 부를 수 있겠다.

‘국가 대 국가’ 또는 ‘기업 대 기업’이라는 전쟁은 동급 간의 이야기였다면, 나는 ‘국가 대 개인’이라는 비동급 간의 비대칭 약탈에 대하여 이야기하고 싶다.

바로 지난 15개월간 호주 정부출자 은행장의 지독한 괴롭힘과 비리를 공익신고자로서 호주 정부에 알려주었건만 오히려 호주 정부가 이 공익신고자의 재산을 완전 거꾸로 강탈해가는 나의 이야기가 그 예이다.

호주 연방 법무장관은 사안의 중요성으로 인해 이 재판의 종결절차를 직접 맞고 있는데, 나에게 무려 6번이나 ‘이게 마지막 비용이다’는 거짓말을 해대며 공익신고자를 완전 파산시킨다. 그 중의 4번은 문서 약속이고 그 중의 하나는 병상에 중병으로 고생하는 나의 아버지가 너무 답답하야 호주 연방 법무장관에게 직접 물어달라고 해서 호주 법무장관한테 받은 답변이다.

‘국가 대 국가’ 간의 전쟁 약탈에 있어서도 선전포고라는 형식을 갖추는데, 호주 정부는 ‘국가 대 개인(특히 공익신고자)’라는 엄청난 비대칭 관계에 있어 ‘너의 재산을 모조리 강탈하겠다’는 본심을 속이고 “이번이 마지막 비용이다”는 ‘선전포고 없는 기습’으로 최소한의 인간성도 잊어먹는다.

‘누가 선전포고를 하게 만드는가?’의 주체는 놀랍게도 호주 법무장관인 것이다.

그것도 호주 정부 국고에 범죄자산 USD18M을 24년6월에 환수하게 공헌한 공익신고자를 대상으로 6번의 거짓 약속과 ‘살아있는 인간의 살껍질을 벗기는’ 2차 세계대전 당시 나찌의 유태인 생체실험에 버금가는 ‘공익신고자의 전 재산 강탈’을 호주 법무장관이 하고 있는 것이다.

나는 호주 법무장관에게 너무도 일방적으로 밟히며 나의 아버지도 같이 밟혔기 때문에, 법무장관에 선전포고를 하는 바이다.

호주 법무장관 입장에서는 조그만 한국이라는 나라에 국적을 가진 내가 ‘한낱 지나가는 외국인 한 명으로 밟아죽여도 표도 안나는 놈’이라고 오산하는 듯 하다.

한참 동안 겪어 보지 못한 경기침체를 호주 국가는 지금 겪고 있다.

이 경기침체와 앞으로 만약 더 안좋은 경기침체가 발생하게 된다면, 호주 국민들은 그 침체의 원인 중의 중요한 원인이 ‘경제에 있어서 매우 중요한 예측가능성 보존은 전혀 못하고 거꾸로 훼손시키는 호주 법무부에게 있음을 직시하기 바란다.

그리고 당장은 아니겠지만 멀지 않은 시간에 진짜 성경에 나온 말세 징후에 대한 예언이 조금이라도 현실화된다면, 그 또한 그 원인은 이미 2024년부터 호주 정부에 의해 만들어졌다는 점을 간과하지 말기 바란다.

호주 법무부와 호주 정부는 아시아 대륙과 같은 시간대에 살면서 아시아 피를 빨아먹는 흡혈귀가 되는 접근은 설사 선전포고와 같은 공표가 없더라도 결국은 아시아대륙에 그 사실이 알려질 수 밖에 없다는 점을 직시하고, 진짜 선전포고를 유발시키지 않는 ‘공존의 지혜’를 발휘해주기를 바란다.

호주 국가의 건국 역사에 입각하여 호주정부가 인간을 바라보지 말고, 다음 구절처럼 인간을 포용하는 국가 본연이 차원에서 여러분의 신과 소통하고 부끄러움이 없기를 간구드린다.

History can confirm‎ the fact that the subject who carried out a surprise attack without declaring war was in fact the person who started the war or was the one causing the war.

Looking back at the history of the Korean War, we can see the early history of Seoul being occupied by North Korea's invasion of the South without a declaration of war.

When Russia invaded Ukraine, there was no formal declaration of war. Instead, Russia declared that it was launching a "special military operation." Unlike a declaration of war, this is not an official declaration of war, but was used by Russia, the originator of the war, as a justification for the use of military force.

Former U.S. President Franklin D. Roosevelt requested the U.S. Congress to declare war on Japan on December 8, 1941, the day after Japan's attack on Pearl Harbor. Also, on December 11, Germany and Italy declared war on the United States, and the U.S. Congress approved a declaration of war on them as well. The reason the United States took this procedure is because under the U.S. Constitution, the only authority that Congress possesses independently is to declare war. In this respect, this declaration of war by the United States is, more accurately, a declaration of a state of war by Congress. At this time, hostile forces are also pointed out.

What about economic terms rather than physical war?

War plunder between ‘states against nations’ also takes the form of a declaration of war, and the Australian government has a hugely asymmetrical relationship of ‘states against individuals (especially public interest reporters)’, deceiving its true intentions by saying ‘I will rob all your property’ and forgetting even the bare minimum of humanity with a ‘surprise raid without a declaration of war’ saying ‘this is the last cost’.

Surprisingly, the subject of ‘Who makes war declared?’ is the Australian Attorney General.

In addition, the Australian Attorney General is making six false promises to a public interest reporter who contributed to the recovery of USD 18 million in criminal assets from the Australian government's treasury in June 2024, and 'robbing the public interest reporter's entire assets', which is comparable to the Nazis' human experimentation on Jews during World War II, which 'skinned the flesh of a living human being'.

Because I have been so unilaterally trampled by the Australian Attorney General and my father was also trampled upon, I am declaring war on the Attorney General.

From the perspective of the Australian Attorney General, it seems that he miscalculates that I, a citizen of a small country called Korea, am a ‘passing foreigner who will not get any votes even if he steps on me to death.’
