대법원이 12·3 비상계엄과 관련해 내란에 가담한 혐의를 받는 한덕수 전 국무총리와 이상민 전 행정안전부 장관의 사건을 전원합의체에 회부하기로 했다. 대법원이 소부(小部)가 아닌 대법관 모두가 참여하는 전합에서 비상계엄의 내란 여부 등을 판단하려는 것 같다는 해석이 나온다.

대법원은 5일 “한 전 총리와 이 전 장관의 내란 사건은 국민적 관심도가 매우 높고, 역사적으로 사법적 평가가 필요하며, 두 사람이 공범 관계여서 함께 심리될 필요가 있다는 점을 고려했다”며 이같이 밝혔다.

당초 한 전 총리의 사건은 대법원 2부, 이 전 장관의 사건은 대법원 3부에 배당됐다. 이에 두 사람은 자신들의 사건을 전합에 회부해달라는 내용의 의견서를 제출했는데, 대법원에서 사실상 이러한 요청을 받아들인 것이다.

대법원 관계자는 “각 소부에서 전합에서 심리해달라는 요청이 있었다”며 “두 사건을 전합에서 같이 심리한다는 취지로, 상고심 선고 등은 개별적으로 이뤄질 수 있다”고 설명했다.

윤석열 전 대통령의 비상계엄에 가담한 혐의를 받는 한 전 총리는 앞서 1심에서 징역 23년, 2심에서 징역 15년을 선고받았다. 계엄 당시 언론사 단전·단수 지시를 전달한 혐의 등을 받은 이 전 장관에겐 1심에서 징역 7년, 2심에서 징역 9년이 선고됐다.
