다음 달 2일 현 정권의 수사·기소 분리 방침에 따라 검찰청이 기소를 전담하는 공소청으로 재편되고, 중요 범죄 수사는 신설되는 중대범죄수사청(중수청)이 맡는다. 열흘 뒤면 검찰청이 78년 만에 문을 닫는 형사사법시스템의 대전환을 맞게 되는 것이다. 하지만 전환 작업을 총괄할 법무부 장관은 공석이다. 지난달 26일 퇴임한 정성호 전 장관 후임으로 지명됐던 더불어민주당 김승원 의원이 코로나 신약 청탁 등 각종 의혹으로 지난 19일 자진 사퇴했다. 새 후보자 지명부터 국회 인사청문회까지 고려하면 10월 2일 전에 신임 법무 장관이 취임하기는 어려워졌다.

초대 공소청장(검찰총장) 인선 작업도 후보추천위원회가 꾸려지지 않는 등 지지부진한 상황이다. 공소청 직제와 시행령·시행규칙 등 하위 법령 정비도 마무리되지 않았다. 중수청도 김지용 초대 청장 후보자가 지명됐지만, 여권 내 반발로 국회 인사청문회 일정도 잡지 못하고 있다. 더불어민주당 등 여권 일각에선 김 후보자가 검사 출신에 과거 ‘검수완박’에 반대하는 입장을 밝혔다며 반대한다. 수사를 주도하게 될 경찰도 경찰청장이 1년 9개월째 공석이다. 법조계에선 “형사사법시스템 재편을 주도할 수장이 모두 공석인 상태라 졸속 추진이 우려된다”는 말이 나온다.

◇두 번 뽑았는데도 정원 68% 수준

행정안전부는 최근 검사와 검찰청 소속 직원을 대상으로 진행한 중수청 2차 특례 임용에 201명이 지원했다고 21일 밝혔다. 앞서 진행된 1차 특례 임용에는 2376명이 지원했지만 이 가운데 615명이 철회해 정원(2874명)의 약 61%인 1761명만 남았다. 이에 인력을 추가로 확보하려고 2차 임용을 진행했지만 1·2차 지원자를 모두 합해도 1962명(정원의 약 68%)에 그쳤다. 지원자 전원을 임용하더라도 정원에 912명이 모자란다. 중수청은 나머지 인력을 변호사나 경찰 출신으로 채용할 계획이다.

중수청은 청사 준비도 마치지 못했다. 중수청 본청(정원 396명)과 서울청(정원 1089명)이 들어설 건물은 서울 을지로 르네스퀘어 빌딩으로 지하 주차장 일부와 지상 2~17층을 사용할 예정이다. 중수청은 지난 7월 임대차 계약을 맺고 현재 내부 인테리어 등 시설 공사를 하고 있다. 하지만 공사가 지연돼 다음 달 개청 후 얼마간은 일부 공간만 사용해야 할 형편이다. 공사는 연말까지 단계적으로 진행될 예정이라고 한다. 전산·통신·방호 시설은 오는 12월에야 완비될 예정이라고 한다. 이 때문에 조사실과 기록·압수물 보관 시설, 디지털 포렌식 시설을 충분히 확보할 수 있을지 불투명하다. 피의자 등이 대기할 구치감은 설치되지만 유치장은 인근 경찰서 시설을 빌려 써야 한다.

사건 정보를 공유하는 중수청 자체 형사사법정보시스템도 2029년쯤에야 구축이 완료될 예정이다. 자체 시스템이 마련되기 전까지 경찰 시스템을 중수청 업무에 맞춰 사용해야 한다. 한 현직 검찰 중간 간부는 “수사기관은 조사·증거 보관 시설까지 갖춰야 하는데 준비에 시간이 촉박한 것 같다”고 했다.

◇공소청은 정원·직제 불투명

검찰청은 10월 2일 공소청으로 재편된다. 공소청은 경찰과 중수청에서 사건을 넘겨받아 기소 여부를 결정하고 공소 유지를 담당한다. 하지만 아직 직제가 확정되지 않았다. 법무부는 지난 4일 검사 정원 2292명을 유지하고 지방공소청에 ‘사법통제부’를 두는 공소청 직제안을 입법예고했다. 그러나 이재명 대통령이 지난 10일 정원과 부서 명칭 등을 재검토하라고 지시하면서 수정에 들어갔다. 법무부는 ‘사법통제부’란 명칭을 ‘불송치사건심사부’로 바꾸고 검사 정원은 출범 후 업무량 분석 등을 거쳐 다시 조정하는 방안을 검토 중이다. 한 검찰 관계자는 “직제가 정해져야 부서가 정해지고 인사를 내 사건을 처리할 수 있다”며 “이 상태로 10월 2일을 맞으면 모든 업무가 ‘올 스톱’될 것”이라고 했다.

공소청 출범에 맞춰 검찰청이 수사하던 사건은 중수청과 경찰로 넘겨야 한다. 이를 위해 사건을 구분하고 수사 기록과 압수물을 이관하는 작업도 이뤄져야 한다. 그러나 공소청에 남길 사건과 중수청·경찰로 넘길 사건을 구분할 실무 기준이 아직 마련되지 않았다고 한다. 중수청과 공소청 출범 초기 수사와 공소 유지에 혼선이 생길 가능성이 큰 것이다.

이런 가운데 법무부는 최근 국회에 낸 ‘2027년도 성과 계획서’에 서울중앙지검 다크웹 수사팀과 금융·증권범죄 합동수사부 등을 포함해 놓는가 하면 지난 6월 3일 이미 치른 지방선거에서 흑색선전과 금권선거 등에 엄정 대응하겠다는 내용도 담았다. 내년도 예산 등에는 공소청 출범을 반영하면서 범죄 대응 계획에는 종전 검찰 수사 체계를 적어 놓은 것이다. 법조계에선 “급격한 형사사법시스템 변화에 정부 부처는 물론 각 수사기관의 업무가 제대로 돌아가지 않고 있다는 방증”이라는 말이 나왔다.

On October 2, the prosecution office will be restructured into the Public Prosecution Office, which will exclusively handle indictments under the current administration’s policy to separate investigations and prosecutions. The newly established Serious Crimes Investigation Agency (Serious Crimes Agency) will take charge of investigating major crimes. This marks a major overhaul of the criminal justice system, with the prosecution office closing its doors for the first time in 78 years in just ten days. However, the Ministry of Justice, which is responsible for overseeing the transition, remains leaderless. Kim Seung-won, a Democratic Party of Korea lawmaker nominated to succeed former Minister Jung Sung-ho, who resigned on August 26, withdrew his candidacy on September 19 amid allegations involving requests for COVID-19 drug favors. Given the time required to nominate a new candidate and hold a parliamentary confirmation hearing, it is unlikely a new justice minister will be appointed before October 2.

The Serious Crimes Agency, meanwhile, faces opposition from within the ruling party over its nominee, Kim Ji-yong, who has been criticized for his background as a former prosecutor and past opposition to the “complete separation of investigations and prosecutions.” The National Police Agency, which will lead investigations, has also been without a commissioner for 1 year and 9 months. Legal circles warn, “With all key positions vacant, the reform risks being rushed and poorly executed.”

◇Two Recruitment Rounds Still Fall Short of 68% Quota

The Ministry of the Interior and Safety announced on September 21 that 201 people applied for the second special recruitment of the Serious Crimes Agency, targeting prosecutors and former prosecution staff. In the first round, 2,376 people applied, but 615 withdrew, leaving 1,761 (about 61% of the quota of 2,874). Despite the second round, the total applicants (1,962) still only meet 68% of the quota. Even if all applicants are hired, 912 positions will remain unfilled. The agency plans to recruit the remaining staff from lawyers or police officers.

The Serious Crimes Agency has also failed to finalize its office setup. Its headquarters (quota: 396) and Seoul branch (quota: 1,089) will operate in the Renaissance Square Building in Seoul’s Euljiro, using part of the basement parking lot and floors 2–17. The agency signed a lease in July and is currently renovating the interior. However, delays mean only partial spaces will be usable after the October 2 launch. Construction is expected to continue in phases until year-end, with IT, communication, and security systems to be completed by December. This raises concerns about insufficient facilities for interrogation rooms, evidence storage, and digital forensics. Detention cells for suspects will be installed, but holding cells will temporarily rely on nearby police stations.

The agency’s own Korea Information System of Criminal Justice Services is not expected to be operational until around 2029. Until then, it will use the police system adapted for its operations. A mid-level prosecutor remarked, “Investigative agencies need proper facilities for investigations and evidence storage, but preparation time is critically short.”

◇Public Prosecution Office’s Quota and Structure Remain Unclear

The prosecution office will be reorganized into the Public Prosecution Office on October 2. The new office will receive cases from the police and Serious Crimes Agency, decide on indictments, and manage prosecutions. However, its organizational structure has not been finalized. The Ministry of Justice proposed maintaining a prosecutor quota of 2,292 and establishing a “Judicial Control Division” in local offices, but President Lee Jae Myung ordered a review of the quota and department names on September 10. The ministry is now considering renaming the division to “Non-Indictment Case Review Division” and adjusting the quota after analyzing workloads post-launch. A prosecution official stated, “Without a confirmed structure, departments cannot be assigned, personnel cannot be appointed, and all work will halt on October 2.”

Cases currently handled by the prosecution must be transferred to the Serious Crimes Agency and police. However, practical criteria for distinguishing which cases to retain or transfer have not been established, risking confusion in early operations.

Amid this, the Ministry of Justice included units like the Seoul Central District Prosecutors’ Office Dark Web Investigation Team and Joint Financial and Securities Crime Investigation Division in its “2027 Performance Plan” submitted to the National Assembly. It also pledged strict responses to black propaganda and vote-buying in the June 3 local elections. While reflecting the Public Prosecution Office’s launch in next year’s budget, the crime response plans still reference the former prosecution system. Legal circles criticized, “This proves that government agencies and investigative bodies are struggling to adapt to the rapid changes in the criminal justice system.”
