Seoul court acquits ex-generals in 'hamburger meeting' martial law case
By Yoo Byoung-hoon Published 2026.10.30. 11:10 The Chosun Daily Newspaper / 조선일보 Bang Jeong-hwan, former Innovation Planning Officer of the Ministry of National Defense /Courtesy of News1 At the time of the Dec. 3 emergency martial law, Gu Sam-hoe, former Army 2nd Armored Brigade commander (brigadier general), and Bang Jeong-hwan, former Ministry of National Defense innovation planning director (brigadier general), who were indicted on charges of participating in a rebellion after holding the so-called "hamburger meeting," were acquitted at the first trial. The court said the two did not know the specific details of the plans related to martial law and that it was hard to recognize the purpose of subverting the constitutional order. Six military officials indicted alongside them were also found not guilty. The Seoul Central District Court Criminal Agreement Division 38-2 (Presiding Judge Jeong Su-young, senior judge) on the 30th acquitted Gu, the former brigade commander, Bang, the former planning director, and six others who were indicted on charges including performing important duties for insurrection. Regarding Gu, the former brigade commander, and Bang, the former planning director, the court said, "Even following the plans of Kim Yong-hyun and Noh Sang-won, they were only nominally the Director General and deputy Director General of the joint investigative unit, and it appears they did not know the details." It continued, "Before martial law was declared, they were in a position where they could not confirm what the reason for martial law was or whether a situation requiring martial law had arisen," adding, "Considering these circumstances, it cannot be concluded that Gu Sam-hoe and Bang Jeong-hwan had the purpose of subverting the constitutional order." Kim Jeong-geun, former 3rd Airborne Brigade commander of the Special Warfare Command, Ahn Mu-seong, former 9th Airborne Brigade commander, Kim Sang-yong, former Vice Minister of the Criminal Investigation Command, Kim Chang-hak, former military police commander of the Capital Defense Command, Jeong Seong-u, former head of Section 1 of the Counterintelligence Command, and Kim Se-un, former special operations aviation commander, were also acquitted. The court also found it difficult to recognize the purpose of subverting the constitutional order for them. Gu, the former brigade commander, and Bang, the former planning director, were brought to trial on charges of participating in emergency martial law by meeting Noh Sang-won, the former Defense Intelligence Command chief, at a Lotteria in Ansan, Gyeonggi, on Dec. 3, 2024, and agreeing to serve respectively as the Director General and deputy Director General of a "second investigative unit" to probe alleged election fraud by the National Election Commission. The remaining defendants were accused of participating in martial law by deploying troops to the National Assembly and the National Election Commission, transporting troops to the National Assembly, and forming arrest teams. Earlier, the special counsel for insurrection sought seven years in prison each for Gu, the former brigade commander, and Bang, the former planning director. ※ This article has been translated by AI.
