권성동 국민의힘 원내대표가 22일 헌법재판소 ‘항의’ 방문에 나섰다. 전날 문형배 헌법재판소장 권한대행과 이재명 더불어민주당 대표가 ‘절친’ 사이라며 “(문 권한대행이) 탄핵 심판을 다룰 자격이 있냐”고 운을 떼더니, 헌재의 입장을 들어보겠다며 직접 서울 종로구에 위치한 헌재를 찾아간 것이다. 그는 이 자리에서 ‘문 권한대행이 이 대표의 모친상에 조문했다’며 두 사람의 유착 가능성을 제기했다가, 헌재가 “명백히 사실에 반한다”고 반박하자 “내가 잘못 전해 들은 것 같다”며 발을 뺐다.

윤석열 대통령 지지자 일부가 지난 19일 서울서부지법에 난입해 폭동을 일으키는 등 사법부에 대한 위협이 고조되고 있는 상황에서, 집권 여당 원내대표가 별다른 근거도 제시하지 않으면서 ‘헌재소장 권한대행-야당 대표의 유착’ 가능성을 부추기며 극렬 지지자들의 선동을 부추기고 있다는 비판이 나온다.

Critics say that the ruling party's floor leader is fueling the incitement of fierce supporters by encouraging the possibility of "acting chairman of the Constitutional Court-opposition party's collusion" without providing any grounds at a time when some supporters of President Yoon Suk Yeol stormed into the Seoul Western District Court on the 19th and caused a riot.

권성동 원내대표는 이날 오전 국회 법제사법위원회 소속 여당 의원들과 서울 종로구에 있는 헌재를 방문했다. 헌재 사무처장 등에게 면담을 요청했으나 외부 일정이 있다는 이유로 만남은 불발됐다. 권성동 원내대표는 “외부 일정을 조정하더라도 의원이면 당연히 만나야 한다”며 “헌재가 면담 자체를 거부한 것은 국회와 국민을 존중하지 않는 태도”라고 비판했다.

‘아니면 말고’식 헌재소장 권한대행-야당 대표 유착 의혹

권성동 원내대표는 이후 기자들과 만나 ‘문 권한대행과 이 대표의 친분설’을 거듭 제기하며 헌재의 탄핵심판 공정성에 의문을 제기했다. 그는 “문 대행은 이 대표와 절친이고, 누구보다 가깝다”며 “문 대행은 평상시 헌재 관계자들에게 정치 평론을 많이 하고, 정부·여당 비판을 많이 했다”고 주장했다.

이어 “(문 대행이) 이 대표와 친분에 대해 과시도 많이 하고, 자랑도 많이 했다. 이 대표의 모친이 돌아가셨는데, 상가 방문한 걸 자랑삼아 헌재 관계자에게 얘기할 정도로 가깝다”며 “그렇기 때문에 문 권한대행의 탄핵심판 진행 과정에 대해 의구심을 갖는 것이다. (이 문제에) 명확히 답변해야 헌재의 공정성과 신뢰성이 높아진다”고 말했다.

"(Acting Moon) showed off a lot about his friendship with Lee and boasted a lot. Lee's mother has passed away, and it is close enough to tell a person at the Constitutional Court to take pride in his visit to the mall," he said. "That's why we have doubts about the progress of Moon's impeachment trial. The fairness and credibility of the Constitutional Court will be enhanced only when it clearly answers (the issue)."

헌재는 곧바로 “문 대행은 이 대표의 모친상에 문상을 한 적이 없으며, 조의금을 낸 사실조차 없다”고 반박했다. 권 원내대표는 그러자 “문 대행이 (이 대표와의) 친분 때문에 (이 대표 모친상에) 가봐야 하는데 헌법재판관이어서 못 가서 아쉬워했다는 얘기를 (내가) 잘못 전해들은 거 같다”고 말했다. 그러면서도 두 사람이 가까운 관계이기 때문에 문제가 될 수 있다는 취지의 입장은 끝내 내려놓지 않았다. 그는 “(사법연수원) 18기 고위직 출신에 두 사람을 모두 잘 아는 사람에게 확인했다”며 “나머지 부분은 반박이 없으니까 (가까운 사이인 걸) 시인한 거 아니냐. 틀리면 (문상 여부에 대해서만) 반박했겠냐, 정치평론하듯 정부·여당 비판한 것 등도 다 반박했을 것”이라고 말했다.

"Did he admit (that they were close to each other) because there was no rebuttal on the rest of the part? If he was wrong, he would have refuted (only about the injuries) and criticized the government and the ruling party as if he were political commentary."

국민의 당 안에선 집권 여당 원내대표가 ‘아니면 말고’ 식으로 헌재에 대한 신뢰도를 흔드는 발언을 내놓은 것에 대해 우려 섞인 목소리가 나왔다. 사상 초유의 법원 난입 폭동이 일어났는데, 지도부가 근거 없는 의혹을 제기하며 지지자들의 분노를 자극해서야 되겠느냐는 것이다. 특히 권성동 원내대표가 헌재를 찾아가 탄핵심판 공정성에 의문을 던진 이날, 조선일보에는 ‘문형배, 이미선, 김형두, 정정미, 정형식, 김복형, 정계선, 조한창 재판광 등 8인 헌법재판관들에게 엄중히 경고한다’는 내용의 한면 짜리 의견광고가 게재됐다. 이 의견광고에는 중국의 부정선거 개입 의혹을 제기하며, ‘애국 청년학도들’을 향해 헌법재판소로 집결하라’고 촉구하는 내용이 담겼다. 한 영남 재선 의원은 “지금은 당 지도부가 발언에 신중할 때다. 근거 없는 의혹제기를 제기해서 지지자를 더 자극해선 안 된다”고 말했다.

A second-term lawmaker of Yeongnam said, "Now is the time for the party leadership to be cautious about its remarks. We should not stimulate our supporters further by raising unfounded suspicions."

“‘부정선거’ 가능성 살펴봐야 한다” 목소리 표면화

하지만 이런 우려들은 공개적으로 표출되지 못하고 있다. 오히려 최근에는 윤석열 대통령이 제기한 ‘부정선거’ 가능성에 동조하는 듯한 발언까지 공공연하게 나오고 있다. 신동욱 수석대변인은 전날 에스비에스(SBS) 라디오 인터뷰에서 “우리 의원 중에서도 부정선거가 분명히 있다고 믿는 분들이 있고, 저 역시도 선거를 치러보면 ‘이거 이상한 데’라고 느낄 수 있는 부분들이 있다”며 “정부가 조금 더 적극적이고 전향적인 입장으로 부정선거가 없었단 것을 분명히 밝혀줄 의무가 있다”고 말했다. 국민의힘은 그간 당 차원에서 부정선거 가능성을 일축해왔으나, 윤석열 대통령은 물론 일부 지지층이 부정선거 가능성을 제기하자 검증 필요성을 거론하고 나선 것이다. 김민전 의원은 최근 국민의힘 소속 의원들이 모인 텔레그램방에 연일 부정선거 관련 기사를 공유한다고 한다. 보다 못한 한 중진 의원은 이에 “이 방에선 부정선거와 관련된 논의가 더 진행되지 않기를 바란다”고 일침을 놓기도 했다고 한다. 영남의 한 중진 의원은 “지금 당을 보면, 과거 자유한국당 시절로 돌아간 거 같다”며 “이대로면 대선 필패”라고 답답한 속내를 털어놨다.

The People's Power has dismissed the possibility of fraudulent elections at the party level, but when some supporters, as well as President Yoon, raised the possibility of fraudulent elections, he talked about the need for verification. Former lawmaker Kim Min-won is said to share articles on fraudulent elections every day in a Telegram room where lawmakers from the People's Power gathered. A senior lawmaker said, "I hope there will be no further discussions related to fraudulent elections in this room." A senior lawmaker in Yeongnam said, "If you look at the party now, it seems that it has returned to the days of the Liberty Korea Party in the past," adding, "If this is the case, it will be a defeat for the presidential election."
