(서울=연합뉴스) 한주홍 기자 = '헌정회복을 위한 헌법학자회의'는 헌법재판소가 마은혁 헌법재판관 후보자 임명과 관련한 사건을 다른 사건보다 먼저 선고하는 것이 공정하다고 주장했다.

(Seoul = Yonhap News) Reporter Han Joo-hong = The 'Conference of Constitutional Scholars for Restoration of Constitution' argued that it is fair for the Constitutional Court to sentence a case related to the appointment of Ma Eun-hyuk as a candidate for Constitutional Court justice before other cases.

이 단체는 2일 보도자료를 내고 "재판부를 9인 체제로 만드는 것은 헌법 취지에 따라 공정한 헌법재판을 진행하기 위해 가장 시급한 일"이라며 이같이 말했다.

또 "대통령 탄핵심판이나 국무총리 탄핵심판 등 이번 사건보다 먼저 접수된 사건들 역시 9인 체제로 심리해 선고하는 게 헌법에 부합한다"고 주장했다.

The group released a press release on the 2nd and said, "Making the court a nine-member system is the most urgent thing to proceed with a fair constitutional trial in accordance with the purpose of the constitution."

He also argued, "It is in line with the Constitution to hear and sentence cases received earlier than this case, such as the presidential impeachment trial and the prime minister's impeachment trial."

이 단체는 12·3 비상계엄 사태 이후 일부 헌법학자가 만든 임시단체로 김선택(고려대)·이헌환(아주대)·전광석(연세대) 교수가 공동대표이며 교수·강사 등 100여명이 참여했다.

This group is a temporary organization created by some constitutional scholars after the December 3 emergency martial law incident, and professors Kim Seon-taek (Korea University), Lee Heon-hwan (Aju University), and Jeon Kwang-seok (Yonsei University) are co-representatives, and more than 100 professors and instructors participated.

헌재는 최상목 대통령 권한대행 부총리 겸 기획재정부 장관이 마은혁 헌법재판관을 임명하지 않은 것이 국회의 재판관 선출 권한 등을 침해했다며 우원식 국회의장이 낸 권한쟁의심판과 공정한 헌법재판을 받을 권리를 침해했다며 한 변호사가 낸 헌법소원 결론을 3일 선고한다.

The Constitutional Court will sentence the conclusion of a constitutional petition on the 3rd, saying that the failure of Acting President Choi Sang-mok and Minister of Strategy and Finance to appoint Ma violated the National Assembly's authority to select judges and that it violated National Assembly Speaker Woo Won-sik's right to a competitive trial and a fair constitutional trial.
