대다수 변호사가 매년 배출되는 신규 변호사 수가 ‘너무 많다’고 인식한다는 조사 결과가 2일 나왔다. 대한변호사협회가 회원 변호사 2521명을 대상으로 온라인 설문 조사한 결과다. 직역 이기주의 관점에서 당연한 결과일 수 있다. 다만 매년 변호사시험 합격자가 1700명 넘게 배출되고 검찰청 폐지를 앞두고 퇴직하는 검사들도 늘면서 변호사 업계가 과당 경쟁에 내몰리고 있다는 방증이란 분석도 나온다.

대한변협은 지난 2월 13일부터 3월 6일까지 회원 변호사를 대상으로 ‘변호사 수 적정성에 관한 설문조사’를 온라인으로 진행했다. 그 결과, 응답자 2521명 중 2450명(97.2%)이 작년 변호사시험 합격자 수(1744명)가 “과잉”이라고 답했다. “적정하다”는 응답은 59명(2.3%)에 그쳤다.

최근 5년간 사건 수임료가 줄었다는 응답은 74.6%(1880명)였다. 응답자의 97.7%(2463명)는 변호사 간 경쟁이 너무 치열해졌다고 했다. 실제로 변호사 1명이 맡는 연간 민사 사건 수는 2012년 73.1건에서 2025년 22.4건으로 줄었다. 여기엔 퇴직 판검사 등 이른바 ‘전관(前官)’들이 변호사 시장에 쏟아져 나오는 것도 영향을 미쳤다는 분석이 나온다.

서울 지역의 한 변호사는 “사건 수임 경쟁이 과열되면서 ‘무료 법률 상담’이나 ‘수임료 50% 할인 쿠폰 제공’ 등 공격적인 마케팅이 늘고 있다”며 “하지만 변호사 수가 많아지면서 판검사 출신들도 예전보다 사건을 수임하기 어려운 상황”이라고 했다.

변호사 업계에서는 변호사 수를 적정 규모로 축소해야 한다고 주장한다. 이번 변협 설문조사에서도 변호사 수 과잉을 해소하기 위해 ‘로스쿨 정원을 축소해야 한다’는 응답이 83.4%(2103명)였다. 일부 응답자는 “변시 합격자 수를 연간 500~1000명 수준으로 제한해야 한다”는 의견을 냈다. 반면 법률 소비자 권익 관점에서 변시 합격자 등 변호사 숫자를 줄여선 안 된다는 목소리도 있다.

The legal profession argues that the number of lawyers should be reduced to an appropriate scale. In this KBA survey, 83.4% (2,103 respondents) answered that "law school quotas should be reduced" to resolve the excess number of lawyers. Some respondents suggested, "The number of bar exam passers should be limited to an annual range of 500 to 1,000." Conversely, there are also voices arguing that, from the perspective of legal consumers' rights, the number of lawyers, including bar exam passers, should not be reduced.
