이정섭 대전고검 검사가 처남의 부탁을 받고 특정인의 범죄 경력을 조회했다는 의혹을 수사 중인 고위공직자범죄수사처(공수처)가 21일 대검찰청을 압수 수색하고 있다.

공수처 수사4부(부장 차정현)는 이날 “검사의 공무상비밀누설 혐의 사건 관련 자료 확보를 위해 압수 수색 영장을 집행 중”이라고 밝혔다. 공수처는 대검 정보통신과를 압수 수색해 이 검사의 메신저 기록 및 전과 기록 조회 여부 등을 확인할 방침인 것으로 전해졌다. 압수 수색 영장은 서울중앙지법에 청구해 발부받았다고 한다.

이정섭 검사는 자녀의 초등학교 진학을 위해 2021년 4월 실제로 거주하고 있지 않은 서울 강남구의 한 아파트에 위장 전입하고 2020년 12월 한 리조트에서 대기업 임원으로부터 객실료를 받은 혐의를 받는다. 이 밖에도 처가 가사도우미의 전과 기록을 조회했다는 혐의(공무상비밀누설)를 받는다. 민주당 측 고발로 수사에 착수한 서울중앙지검 형사1부(부장 김승호)는 이정섭 검사를 지난 6일 기소하면서, 공무상비밀누설 혐의는 공수처로 이첩했다.

이 의혹은 김의겸 전 국회의원이 2023년 10월 국정감사 당시 처음 제기했다. 당시 이정섭 검사는 수원지검에서 ‘쌍방울 불법 대북 송금’ ‘경기도 법인카드 유용’ 등 이재명 더불어민주당 대표 관련 사건 수사를 지휘하고 있었다. 의혹이 제기되자 검찰은 이정섭 검사를 대전고검으로 이동시켰다.

The allegation was first raised by former lawmaker Kim Eui-gyeom during the parliamentary audit in October 2023. At that time, prosecutor Lee was leading the investigation into the case related to Democratic Party leader Lee Jae-myung, including "illegal remittance to North Korea" and "the misappropriation of corporate cards in Gyeonggi Province" at the Suwon District Prosecutors' Office. When suspicions were raised, prosecutors moved prosecutor Lee to the Daejeon High Prosecutors' Office.

민주당은 그해 12월엔 이 검사가 비위 의혹으로 정상적인 직무를 수행할 수 없다며 탄핵 소추도 했다. 하지만 헌법재판소는 작년 8월 재판관 9명의 전원일치 의견으로 이를 기각했다.

공수처는 이날 이정섭 검사의 처남댁인 조국혁신당 강미정 대변인을 참고인으로 소환해 조사하고 있다. 강미정 대변인은 이날 공수처 청사에서 기자들에게 “검찰이 촉박하게 시효 만료 직전 사건을 공수처에 이첩한 부분은 안타깝다”고 말했다. 이 사건의 공소시효는 오는 29일까지다.

법조계에선 이정섭 검사가 누설한 혐의를 받는 전과 기록이 공무상 비밀에 해당하는지 여부가 쟁점이 될 것이라고 보고 있다. 한 차장 검사 출신 법조인은 “판례가 많지 않은 사안으로 알고 있다”고 했다.

Legal experts believe that the issue will be whether the prosecutor's previous criminal record is a public secret. A former deputy prosecutor said, "I understand that there are not many precedents."
