대통령 배우자(영부인)를 견제할 때가 왔습니다

The Reform Party on Wednesday proposed the National Assembly stipulate the legal status of the president’s spouse in the law. It could be a political offensive from the minor opposition. But it is also true that Korea’s current politics cannot take a step forward due to the deepening suspicions around first lady Kim Keon Hee. It is deplorable to see such developments today. And yet, many people would gladly agree to the need for the legislature to clearly define the legal status of the presidents’ spouses.

The prosecution on Wednesday decided not to indict the first lady on bribery charges even though she received a luxury handbag from a mysterious pastor after her husband was elected president in 2022. The prosecution based its decision on the absence of any clause on punishing a presidential spouse’s acceptance of expensive gifts from others — except for an article on broadly banning a spouse’s receipt of them. Despite such loopholes, political circles have been mostly indifferent to the issue.

Regardless of mounting suspicions on the first lady’s intervention in the ruling party’s nominations of candidates before the April 11 parliamentary elections, it is difficult to punish her because she is not a government official. In the past, most of the presidents’ spouses didn’t cross the line thanks to the internal checking system in the presidential office. As a result, there was little need to clearly define the first lady’s duties.

However, following former first lady Kim Jung-sook’s solo visit to India in 2018, the current first lady seems to have crossed a red line, as implied by her alleged involvement in the election process. That explains why the splinter opposition wants to specify the first lady’s obligations. We cannot afford any more confusion from our first ladies.

The United States made the First Ladies’ public role clear in Article 105 of the Federal Law. All official activities by them are conducted within the boundaries of the article. Nancy Reagan and Michelle Obama also followed the guideline when their husbands were incumbent presidents. France is no exception. In 2017, the country made a declaration to ensure transparent activities of spouses of its heads of state. The declaration confined their public role to visiting foreign countries with the presidents, communicating with the public and hosting events at the Élysée Palace.

The Reform Party plans to define our first lady’s public role by law, secure transparency in the budget needed for the role, and strengthen their legal responsibility. First ladies should must not wield power just because they are the president’s spouse. The National Assembly has no reason to refuse the party’s proposal.

개혁당은 수요일 국회에 대통령 배우자의 법적 지위를 법에 명시할 것을 제안했습니다. 소수 야당의 정치적 공세일 수도 있습니다. 그러나 김건희 영부인을 둘러싼 의혹이 깊어지면서 현재 한국의 정치가 한 걸음도 나아가지 못하는 것도 사실입니다. 오늘날 이러한 상황을 보는 것은 개탄스러운 일입니다. 그럼에도 불구하고 많은 사람들이 입법부가 대통령 배우자의 법적 지위를 명확하게 정의해야 한다는 필요성에 기꺼이 동의할 것입니다.

검찰은 수요일 영부인이 2022년 남편이 대통령에 당선된 후 의문의 목사로부터 명품 핸드백을 받았음에도 불구하고 뇌물 수수 혐의로 기소하지 않기로 결정했습니다. 검찰은 대통령 배우자가 다른 사람으로부터 고가의 선물을 받는 것을 광범위하게 금지한다는 기사를 제외하고는 처벌 조항이 없다는 점을 근거로 이 같은 결정을 내렸습니다. 이러한 허점에도 불구하고 정치권은 이 문제에 대해 대부분 무관심했습니다.

영부인이 4·11 국회의원 선거 전 여당의 후보자 공천에 개입한 의혹이 거세지더라도 공무원이 아니기 때문에 처벌하기는 어렵습니다. 과거에는 대통령실 내부 견제 시스템 덕분에 대통령 배우자 대부분이 선을 넘지 못했습니다. 그 결과 영부인의 직무를 명확하게 규정할 필요성이 거의 없었습니다.

그러나 2018년 김정숙 전 영부인이 단독으로 인도를 방문한 이후, 현 영부인은 선거 과정에 개입했다는 의혹에서 알 수 있듯이 레드라인을 넘은 것으로 보입니다. 그렇기 때문에 분열된 야당이 영부인의 의무를 명시하려는 이유입니다. 우리는 영부인들로부터 더 이상 혼란을 겪을 여유가 없습니다.

미국은 연방법 제105조에서 영부인의 공적 역할을 분명히 했습니다. 영부인의 모든 공식 활동은 조항의 테두리 내에서 이루어집니다. 낸시 레이건과 미셸 오바마도 남편이 현직 대통령이었을 때 지침을 따랐습니다. 프랑스도 예외는 아닙니다. 2017년 프랑스는 국가 원수 배우자의 투명한 활동을 보장하기 위해 선언을 했습니다. 이 선언은 영부인의 공적 역할을 대통령과 함께 외국을 방문하고 대중과 소통하며 엘리제궁에서 행사를 개최하는 것으로 제한했습니다.

개혁당은 영부인의 공적 역할을 법으로 규정하고, 그 역할에 필요한 예산의 투명성을 확보하며, 법적 책임을 강화할 계획입니다. 영부인이 대통령의 배우자라는 이유만으로 권력을 행사해서는 안 됩니다. 국회는 당의 제안을 거부할 이유가 없습니다.
