SEOUL, Nov. 26 (Yonhap) -- A special counsel team on Wednesday indicted the head and deputy chief of the Corruption Investigation Office for High-ranking Officials (CIO) without detention on charges of dereliction of duty in connection to its investigation into the 2023 death of a young Marine.
​
It marked the first time the agency's leadership has been indicted since its establishment in 2021.
​
CIO Chief Prosecutor Oh Dong-woon and Lee Jae-seung, the agency's deputy chief, are accused of failing to notify the Supreme Prosecutors Office for 11 months when a CIO prosecutor became subject to a criminal complaint in August last year, as required by law.
​
Democratic Party lawmakers had filed the complaint against then CIO prosecutor Song Chang-jin for allegedly lying under oath at the National Assembly over his knowledge regarding an individual linked to the Marine death case.
​
The special counsel team, investigating alleged interference by former President Yoon Suk Yeol's administration in the Marine death case, believes no action took place over the complaint as the agency viewed it as a political attack on its leadership.
​
Separately, the team believes some CIO officials, including Song, obstructed the agency's investigation at the time over the allegations surrounding the Marine death case to apparently prevent it from targeting Yoon.
​
The team indicted Song on charges of abuse of authority for allegedly obstructing efforts to seek search-and-seizure warrants against Yoon and former Defense Minister Lee Jong-sup in connection to the case.
​
The move comes after the team last week indicted Yoon on charges of exerting undue pressure on the military's investigation into Cpl. Chae Su-geun's death in July 2023.

채상병 순직 사건 외압·은폐 의혹을 수사하는 이명현 순직해병 특별검사팀이 26일 고위공직자범죄수사처를 이끄는 오동운 공수처장과 이재승 공수처 차장을 재판에 넘겼습니다.

특검팀은 오늘 오 처장과 이 차장을 직무유기 혐의로 불구속기소 한다고 밝혔습니다.

오 처장과 이 차장은 지난해 8월 송창진 전 공수처 부장검사의 위증 혐의 고발 사건을 접수한 이후 사건을 대검찰청에 통보·이첩하지 않고 방치한 혐의를 받습니다.

송 전 부장검사는 지난해 7월 국회 법제사법위원회(법사위)에서 "윤석열 전 대통령에 대한 통신기록 영장이 모두 기각됐다", "수사외압 사건에 이종호 전 블랙펄인베스트 대표가 연루된 사실을 몰랐다"는 허위 증언을 한 혐의(국회증언감정법상 위증)로 더불어민주당 의원들에 의해 고발됐습니다.

공수처법에 따르면 공수처장은 소속 검사의 범죄 혐의를 발견한 경우 관련 자료와 함께 이를 대검에 통보해야 합니다.

이들은 고발 사건을 이첩하지 않는 행위가 관련 법령에 반하는 위법·부당한 사건처리라는 점을 잘 알면서도 당시 고발이 공수처 지휘부를 겨냥한 부당한 정치적 공격'이라고 규정해 아무런 조치를 하지 않았다고 특검팀은 판단했습니다.

해당 고발 사건이 접수되고 특검에 이첩되기 전까지 약 11개월 동안 피의자·참고인 조사는 단 한 차례도 이뤄지지 않는 등 사건 수사가 전혀 진행되지 않았으며, 다른 검사에게 사건을 재배당하거나 수사를 진행하도록 지시한 바 없다는 게 특검팀 결론입니다.

당시 사건을 처음 배당받은 박석일 전 공수처 부장검사도 직무유기 혐의로 함께 기소됐습니다.

박 전 부장검사는 위증 사건에 대한 아무런 조사 없이 고발장 접수 이틀 만에 무혐의로 결론 내린 보고서를 작성하는 등 사건 수사를 충실히 이행하지 않은 혐의를 받습니다.

특검팀은 채상병 순직 사건 수사를 방해한 송 전 부장검사와 김선규 전 부장검사도 각각 직권남용 혐의로 재판에 넘겼습니다.

김 전 부장검사와 송 전 부장검사는 공수처가 채상병 순직 사건을 수사하던 시기 공수처 처장·차장직을 대행했습니다.

특검팀은 이들이 채상병 순직 사건에 대한 수사가 윤 전 대통령으로 향하는 것을 차단하기 위해 관련 수사를 방해했다고 판단했습니다.

특검팀은 공수처 주요 참고인들을 통해 김 전 부장검사가 지난해 4·10 총선을 앞두고 채상병 수사외압 사건의 관계자들을 소환하지 말라고 여러 차례 지시했으며, 송 전 부장검사는 지난해 6월 윤 전 대통령, 이종섭 전 국방부 장관 등에 대한 압수수색 영장 청구를 방해했다는 사실을 확인했다고 밝혔습니다.

특검팀은 "피고인들은 주어진 권한을 악용해 공수처 수사가 대통령에게 향하는 것을 차단함으로써 공수처의 수사권을 사유화·정치화했다"며 "고위공직자 범죄에 대한 독립적이고 엄정한 처리를 목적으로 출범한 공수처의 설립 취지를 무력화했다"고 말했습니다.
