The special counsel announced on the same day that Mayor Oh, former Vice Mayor of Seoul Kang Cheol-won, and businessman Kim Han-jeong, among others, were indicted on charges of violating the Political Funds Act. 오세훈 서울시장이 ‘정치 브로커’ 명태균씨로부터 여론조사를 의뢰하고 그 비용을 대납하게 했다는 의혹을 수사 중인 민중기 특별검사팀이 1일 오 시장을 기소했다. 다만 명씨는 오 시장과 함께 재판에 넘겨지지 않았다.

특검은 이날 오 시장과 강철원 전 서울시 정무부시장, 사업가 김한정씨 등을 정치자금법 위반 혐의로 기소했다고 밝혔다. 강 전 부시장은 2021년 4월 서울시장 보궐선거 당시 오 시장 측 캠프 비서실장을 지냈다. 김씨는 오 시장의 후원회장으로 여론조사 비용을 대신 지불했다는 의혹을 받는다.

특검은 “피고인 오세훈은 명태균에게 ‘서울특별시장 보궐선거 관련 여론조사’를 해달라는 취지로 부탁하고, 선거 캠프 비서실장인 피고인 강철원에게 명태균과 상의해 여론조사를 진행해 달라는 취지로 지시했다”며 “명태균은 피고인 오세훈의 부탁에 따라 2021년 1월 22일부터 그해 2월 28일까지 총 10회에 걸쳐 서울특별시장 보궐선거에 관한 여론조사를 진행하고, 피고인 강철원은 명태균과 연락하며 설문지를 주고받는 등 여론조사 진행을 상의했다”고 밝혔다.

특검은 이어 “김씨는 2021년 2월 1일부터 그해 3월 26일까지 총 5회에 걸쳐 여론조사 비용 명목으로 합계 3300만원을 지급했다”고 적었다.

앞서 특검은 지난달 8일 오 시장과 명씨의 대질 신문을 6시간가량 진행했다. 당시 명씨는 특검 조사 후 “(오 시장이) 기억이 안 난다고 한 부분이 너무 많았다”고 했다. 오 시장은 “5년 전 일을 소상하게 기억하는 게 오히려 어색한 일”이라고 말했다.

특검은 이날 명씨는 기소하지 않았다. 특검 관계자는 명씨를 피의자로 전환하거나 기소할 계획이냐는 질문에 “이 사건의 본질은 김씨가 여론조사 비용을 대납한 것이고, 서울시와 강 전 부시장이 여론조사 결과를 받은 것인 만큼 명씨를 피의자로 전환할 수가 없다”고 했다.

오 시장이 혐의를 부인하고 있고, 대질 신문에서도 양측의 입장이 대립한 데 대해서는 “관련자 진술뿐 아니라 물적·인적 증거를 종합해 혐의를 입증할 수 있다고 판단해 (오 시장을) 기소한 것”이라고 했다.

오 시장 측은 “오 시장이 강 전 부시장에게 지시한 걸 누가 들었다는 건지 모르겠다”며 “오 시장을 기소하며 명씨를 기소하지 않은 이유도 납득이 가지 않는다”고 했다.
