서울중앙지법 형사22부(재판장 조형우)는 8일 대민 지원 작전에 투입됐다가 숨진 고(故) 채수근 해병 상병이 소속됐던 해병대 1사단 사단장이었던 임성근 예비역 소장에게 업무상 과실치사 혐의를 인정해 징역 3년을 선고했다. 재판부는 사고 당시 해병 1사단 소속 박상현 전 7여단장, 최진규 전 포11대대장에겐 금고 1년 6개월을, 이용민 전 포7대대장에겐 금고 10개월을 선고하고 법정 구속했다. 장모 전 중대장에겐 금고 8개월에 집행유예 2년이 선고됐다.

임 전 사단장 등은 2023년 7월 19일 경북 예천군 수해 실종자 수색 작전에 투입된 해병대원들에게 구명조끼 등을 주지 않은 채 수중 수색을 시켜 채 상병을 숨지게 하고 다른 대원을 다치게 한 혐의(업무상 과실치사상)로 기소됐다. 임 전 사단장은 수색 작전 통제권이 육군 50사단으로 넘어갔는데도 바둑판식 수색을 지시해 부대에 혼란을 줬다는 혐의(군형법상 명령 위반)도 받았다.

재판부는 “장병들이 목숨을 잃은 여러 사례가 있었지만 말단 지휘관이 책임지는 관행이 반복됐다”며 “이번 사건은 상급 지휘관들의 무리한 수색 지시가 원인이어서 엄중한 책임을 물어야 한다”고 했다. 재판부는 임 전 사단장이 적극적으로 수색하라고 지시하는 등 부하 지휘관들을 밀어붙인 탓에 허리 깊이까지 물에 들어가라는 지시가 내려져 대원들이 위험에 빠졌다고 봤다. 재판부는 “(임 전 사단장이) 박 전 여단장에게 지휘를 맡겼다면 수색은 안전하게 진행됐을 것”이라고 했다. 박 전 여단장은 사고 전날엔 무리하게 하천에 다가가지 말라고 지시했었다고 한다. 재판부는 임 전 사단장이 2024년 12월 채 상병 부모에게 ‘제가 수중 수색을 지시하지 않았다’는 메일을 보낸 것과 관련해 “어떻게 가해자가 피해자에게 이런 걸 보낼 수 있느냐. 오랜 재판 경력에서 이런 사람은 본 적이 없다”고 지적했다.

박 전 여단장과 최 전 대대장은 수중 수색 지시와 관련해 명확한 내용을 대원들에게 알리지 않는 등 주의 의무를 소홀히 한 책임이 있다고 재판부는 판단했다. 재판부는 다만 이 전 대대장과 장 전 중대장에 대해서는 “군대 특성상 (상급자의) 지시를 거부하기 어려웠을 것이고 범행도 자백하고 있다”고 했다.

이날 판결 선고 후 채 상병 어머니는 “형량이 너무 적다. 아들의 희생에 대한 책임이 이렇게 가볍다면 어느 부모가 안심하고 자식을 군에 보내겠느냐”고 했다.

이런 가운데 서울고법 형사6-2부(재판장 박정제)는 이날 김상민 전 검사가 김건희 여사에게 1억4000만원 상당의 이우환 화백 그림을 건네며 국회의원 공천 등을 청탁한 혐의(청탁금지법 위반) 등을 유죄로 인정해 징역 3년에 집행유예 3년을 선고했다. 1심의 일부 무죄 판단을 뒤집은 것이다.

The 22nd Criminal Division of the Seoul Central District Court (Judge Cho Hyung-woo) on the 8th sentenced former Major General Lim Seong-geun (retired), who served as the commander of the 1st Marine Division to which the late Marine Corps Corporal Chae Su-geun belonged, to three years in prison, recognizing charges of criminal negligence resulting in death. The court sentenced former 7th Brigade Commander Park Sang-hyun and former 11th Battalion Commander Choi Jin-gyu, both under the 1st Marine Division at the time of the accident, to one year and six months in prison, and former 7th Battalion Commander Lee Yong-min to ten months in prison, detaining them in court. Former Company Commander Jang received a suspended sentence of eight months in prison with two years’ probation.

The court stated, “There have been multiple cases where soldiers lost their lives, but the practice of holding only lower-ranking commanders accountable has repeated. This case was caused by unreasonable search orders from higher-ranking commanders, so they must bear severe responsibility.” The court found that Lim’s aggressive push for searches led to orders for troops to enter water up to their waists, endangering them. It added, “If Lim had entrusted command to former Brigade Commander Park, the search would have proceeded safely.” Park had reportedly instructed troops the day before the accident to avoid approaching the river recklessly. Regarding an email Lim sent to Chae’s parents in December 2024 stating, “I did not order the underwater search,” the court criticized, “How could a perpetrator send such a message to the victim? I have never seen such a person in my long judicial career.”

The court ruled that Park and Choi were responsible for failing to clearly communicate the details of the underwater search orders to troops, neglecting their duty of care. However, regarding former Battalion Commander Lee and former Company Commander Jang, it noted, “Given the nature of the military, it would have been difficult to refuse orders from superiors, and they have confessed to their crimes.”
