［정동희 뷰 : "국가란 무엇인가?" Ⅲ (국가가 먼저 꼬셨다면 결자해지해야) ]

청춘 남녀 간에 먼저 꼬신 상대가 있기 마련이다. 아무래도 먼저 꼬신 상대는 상대방보다 책임이 더 있기 마련이다. 개인에도 이러한 데, 만약 ‘국가와 개인’ 사이에 먼저 꼬신 상대가 국가였다면, 그 책임은 개인 간보다 매우 더 크다.

그게 공권력을 가진 국가의 성격이 최소한 개인보다 시작에 대한 책임이 더 크기 때문이다.

국가는 인적재해로부터 상대방 개인이 핍박받지 않게 할 의무가 있다는 것은, 각 나라 헌법에 보면 찾아 볼 수 있다는 측면에서 그 의무가 증명된다.

돌이켜보면 24년2월6일 뇌물사건을 호주 당국에 신고할 때 당시에 나는 이 신고가 민사재판으로 강제된다는 사실을 전혀 몰랐다. 한국에서는 그렇지 않기 때문이다.

그 사실을 후에 알고 나서는 나는 당시에 돈이 전혀 없었기 때문에, 재판할 의사가 없다는 걸 수십차례 표명했다.

그런데 변호사비 절반을 빌려준다고 하여 결국 재판이 시작된 것이다.

실제로 호주 법무장관은 당시 빌려주는 것에 대해 허락을 해주었다.

지금은 특히 25년1월6일 법무장관의 ‘This is absolutely final fees’라는 문서 약속 이후 전혀 돈도 빌리지도 못할 정도로 파산된 내 상황에서, 24년11월 당시에 물을 때 옳게 대답하지 않은 은행감독국이 25년 1월17일에 국제법에 반하는 이중처벌 돈을 내고 나서 6일 뒤에 갑자기 (전혀 예상치 못하게 그리고 사전고지 없이) 2% 거액 송금료를 청구하면서 일이 꼬인 것이다.

특히 추가로 은행감독국이 2% 가량을 요구할 때 환율 등의 아무런 이야기도 하지 않고 이것만 내면 모든 게 해결되는 식으로 여러 차례 거짓 이야기를 한 것은, 결코 내 책임이 아니다.

 "옛말에 이르기를, 매듭을 지은 사람이 풀어야 한다"는 결자해지(結者解之) 사자성어는 "묶을 결(結), 놈 자(者), 풀 해(解), 어조사 지(之)"로 이루어져 있습니다. 매듭을 묶은 사람이 풀어야 한다는 뜻으로, 일을 시작한 사람이 책임을 지고 해결해야 함을 비유합니다.

재판할 의사가 없는 나를 돈을 빌려주겠다고 재판시작하게 한 당사자는 이 사건 종결 마지막 단계에서 너무 속아서 완전 파산한 나를 가만히 구경해서는 안 될 도덕적 의무가 있습니다.

또한 그런 상황을 처음부터 인식하고 있는 호주 법무부장관은 돈을 빌려주는 걸 허락해주었기 때문에 이렇게까지 내가 모든 재산과 위험한 차입을 끝까지 하면서 여기까지 결과적으로 유인했다는 점에서, 이 사건 종결 마지막 단계에서 너무 속아서 완전 파산한 나를 가만히 구경해서는 안 될 도덕적 의무가 있습니다.

이런 측면에서 끝까지 평행선을 달리지 말자, 지금은 정치적 결단이 정답! (정동희가 호주 정부 앤소니 앨버니지 총리 등에게 고합니다)

This also applies to individuals, and if the state is the one who first seduced a relationship between a ‘state and an individual,’ the responsibility is much greater than between individuals.

This is because the nature of the state with public power is at least greater than that of individuals. The fact that the state has a duty to prevent individuals from being persecuted by man-made disasters is proven in the fact that it can be found in each country's constitution.

Looking back, when I reported the bribery case to the Australian authorities on February 6, 2024, I had no idea that this report would be forced into a civil trial. Because that is not the case in Korea.

After I found out about it later, I expressed dozens of times that I had no intention of going to trial because I had no money at the time.

However, they said they would lend half of the lawyer's fees, so the trial eventually began.

In fact, the Australian Attorney General gave permission for the loan at the time.

Now, especially in my situation where I am so broke that I cannot even borrow any money after the Attorney General's document promise of ‘This is absolutely final fees’ on January 6, 2025, things got awry when the Banking Supervisory Service, which did not give a correct answer when asked in November 24, suddenly (completely unexpectedly and without prior notice) charged me a large 2% remittance fee 6 days after I paid the double penalty money in violation of international law on January 17, 2025.

In particular, when the Banking Supervision Bureau requested an additional 2%, it was by no means my responsibility to lie several times, saying that everything would be resolved if you just paid this amount without mentioning anything about the exchange rate.

“As the old saying goes, the one who ties the knot must untie it.” The idiom for tying and breaking the knot is composed of “to tie (結), nom (者), untie (解), and the meaning of ~ (之).” It means that the person who tied the knot must untie it, and it is a metaphor for the person who started the task to take responsibility and solve it.

The party who started the trial by offering to lend me money when I had no intention of going to trial has a moral obligation not to sit by and watch me become completely bankrupt because I was so deceived in the final stage of the case's conclusion.

In addition, the Australian Minister of Justice, who was aware of the situation from the beginning, allowed me to lend money and thus lured me to this point by investing all my assets and risky borrowing until the end. Therefore, I have a moral obligation not to sit by and watch as I was completely deceived and completely bankrupt in the final stage of the conclusion of this case.
