한국의 선거관리시스템 이슈와 호주 정부 공권력 시스템은 부부 사이 (정동희)

자식과 부모 사이를 동양식으로 촌수로 굳이 따지면 1촌이고, 부부 사이를 마찬가지로 따지면 0촌 (또는 무촌) 사이이다. 부부는 혼인으로 맺어진 관계이지 혈연 관계가 아니기 때문에 촌수가 없다는 게 이에 대한 사전적 해석이다. 부부가 갈수록 닮는다는 말이 회자되듯이, 부부가 만나기 전 남남일 때보다 살아가며 둘의 언행과 관념적 이미지이 밀접해진다는 측면에서 달리 해석할 수도 있겠다.

지난 1년 반 이상을 호주 정부 소유 국영은행장의 뇌물 사건 관련 민사재판을 진행하여 승소하고 그 뒤에 사안의 중요성으로 이 재판 종결 절차를 책임지고 있는 호주 법무장관 등의 이중성과 일방적인 책임 전가와 회피로 공익신고자인 재판승소 원고가 오히려 거꾸로 모든 게 강탈되는 파국을 겪고 있다.

24년 11월 실질적으로 이 승소한 재판종결 절차에 돌입하며 관련 비용을 호주 법무부와 재판승소금의 지불 실무를 맡고 있는 은행감독국 등에 나는 문의한 바 있다.

상식에 의하면 이런 질문을 공식적으로 호주 정부가 받았으면, 제대로 그리고 똑바로 답변하는 게 당연하다.

그런데 당시 은행감독국은 나에게 답변할 때 ‘Remittance fee’ 단어와 들어간 청구서를 제시했는데, 2달 뒤에 무려 그 금액의 40배를 또 다시 ‘Remittance fee’ 단어와 들어간 청구서를 기습 제기했다.

그리고 그 사이 호주 법무장관은 이 재판과 전혀 무관한 과거 벌금납부 완료 건을 이 재판 종결 절차에 강제로 연관시켜 (국제법에 반하는) 4배 가중벌금을 내지 않으면 모든 권리를 박탈하겠다는 공권력 만행을 저질렀다.

상식적 기준에 의한 대화를 주고 받는 일반 사회에서는 도저히 일어날 수 없는 일들이 연이어 달이 바뀔 때마다 나타나며, 이미 이 재판 시작 전에 모든 나의 호주 자산이 동결시킨 호주 정부가 이 상태에서 어떠한 과제도 수행하기 어렵다는 걸 잘 알면서도 연속적으로 악용하는 “무지막지한 갑의 횡포”를 그것도 공익신고자이자 재판승소자에게 가하고 있는 것이다.

이러한 예측가능성 제로 국면에서도 나는 살려고 버둥쳤는데, 이는 호주 법무장관이 이중처벌에 항의하는 나에게 25년 1월 6일 “This is absolutely final fees”라는 정부약속이 적힌 정부문서를 발행하고 은행감독국 등 관련 부서에게도 배포하여 그 약속을 나는 믿었기 때문이었다. 이후 25년 3월 중에 호주 법무장관은 이런 문서 약속을 두 번째로 했고 구두 약속들도 몇 번 따로 있었다.

그래서 그 때라도 내가 쓰러지지 않고 호주 정부가 요구하는 과제를 시간이 지체된다는 이유로 막대한 지체금도 추가로 내면서 견디어 내었는데, 이런 사정을 잘 아는 호주 법부장관과 은행감독국은 25년2월 30여만불의 송금수수료 지체금을 징수했음에도 25년 6월 지체 등의 이유로 또 다시 거액의 수수료를 은행감독국은 징수하는 만행을 저질렀다.

더 놀라운 사실은 그런 엄청난 송금수수료 등을 선 징수했음에도 나에게 아무런 고지 없이 USD를 AUD로 교환하고 그 사이 호주 연방은행의 금리인하 1번과 25년2월에는 말도 하지 않았던 직전 금리인하 1번을 이유로 ‘시장환율이 그 사이 거의 동일함에도 그 준거환율 차이를 호주 특유의 논리라는 식으로 과장’하여, 재판승소금을 갖고 있는 호주 은행감독국이 최종단계에서 또 다시 공익신고자의 모든 인권을 유린하는 ‘전쟁범죄 수준의 공권력 횡포’를 부리고 있는 것이다.   

지금까지 제가 지난 시간 호주 정부에 의해 얼마나 간사하고 교묘하게 그리고 비양심적으로 짓밟히고 있는지에 대해 말씀드렸다.

이 이야기를 들으면 놀랍게도 한국의 특정관리시스템이 그 비슷한 맥락에 있다는 점이 혹자는 느껴질 것이다.

선거 관리의 공정성마저도 확보하지 못할 경우 모든 게 무너질 수 밖에 없는 대만은 우리나라와 달리 매우 단순한 선거시스템을 고집하고 또한 그렇기 때문에 국제선거감시단 등에도 이 시스템의 정직성을 검증하기 위해서 살펴보려고 해도 허락을 한다.

제가 학부에서 심리학을 전공했는데 심리학은 인간의 심리와 관련한 현상에 대해 기본적으로 통계학적인 접근을 구사하는 미국학문이다. 통계학의 발전은 놀라울 정도인데, 특히 최근에 계속 확대되며 나타나는 사전투표와 본투표의 놀라운 차이에 대해서는 당연히 학자와 사회과학의 양심에 근거하여 질문을 던져야 하는 수준에 달하고 있다.

그래서 한국이 몇 개 국에 수출도 한 ‘전자식 분류기’는 대부분의 나라에서 그 문제점이 적지 않음이 다양하게 지적되었고, 대만은 반도체 등 IT부문에서 한국과 동급의 IT강국임에도 이런 식의 분류기 사용은 지양한다. 또한 사전투표 이후 우체국 등을 통하여 전달되는 복잡한 과정에 대한 검증도 사실상 어려운 점을 감안하여 사전투표 없는 본투표를 고집한다. 그 뿐만 아니라 한국처럼 여러 투표소에서 투표함을 모아 구 단위 체육관 등에 옮기는 과정에서 나타날 수 있는 사고를 전면적으로 방지하기 위하여, 대만은 투표 현장에서 개표되며 투표함은 한국처럼 이리저리 옮겨다니지 않는다.

제가 공익신고자로서 호주 국민 100명도 해내지 못한 퍼스 소재 국영은행장의 뇌물 부패 사건을 24년2월6일 호주 당국에 신고하여 24년 6월 호주 정부가 이와 관련하여 무려 USD18M 국고 수입에 공헌했는데도, 저에게 고맙다는 말 한 마디는 커녕 거꾸로 저의 모든 걸 강탈하며 ‘사는 게 더 힘든 지옥’에 빠뜨린 이야기를 한 바 있다. 얼마나 국제 상식과 국제 표준과 국제 양심에 반하는 행위를 호주 정부가 그것도 자국에게 공헌한 공익신고자에게 하고 있는가?

바로 위와 같은 국제 상식과 국제 표준 그리고 국제 양심에 근거하여 한국이 최소한의 선거관리 시스템 개선과 투명성을 앞으로 담보하지 못할 경우, 한국의 미래는 어떻게 될 거라고 여러분은 보시는가?

제가 25년2월부터 한국정부에 긴급 구조 요청을 국민신문고를 통하여 무려 7번 접수했다. 한국 외무부와 호주 소재 한국 대사관은 팔짱만 끼고 있을 뿐이다.

마찬가지로 저는 이런 식의 한국 정부 태도가 국제적으로 이슈로 부각되는 한국 선거관리시스템의 검증 자체 시도를 차단하는 식의 ‘눈 가리고 아옹하는 태도’와 ‘무려 7번 긴급 구조 요청을 철저하게 외면하는 ‘한국 외무부와 호주 소재 한국 대사관’ 그리고 자국의 공익신고자의 모든 걸 강탈하는 호주 정부 이야기, 이 모두는 똑같다는 점을 말씀드린다.

If we are to measure the relationship between children and parents in the Eastern way, they are 1st degree of kinship, and if we consider the relationship between a married couple, they are 0 degrees of kinship (or no degree of kinship). The dictionary interpretation of this is that since the couple is related by marriage and not by blood, there is no relative. Just as it is said that couples become more and more alike, it can be interpreted differently in the sense that their words, actions, and conceptual images become closer as they live than when they were strangers before meeting.

For more than a year and a half, the plaintiff won the civil trial related to the bribery case of the head of a state-owned bank owned by the Australian government and won the case. However, due to the duplicity and unilateral transfer of responsibility and evasion of the Australian Attorney General, who is in charge of the process of concluding this trial due to the importance of the case, the plaintiff who won the trial, who was a public interest reporter, is going through the catastrophe of being robbed of everything.

In November 2024, as we began the process of concluding the trial in which we won, I inquired about the related costs with the Australian Ministry of Justice and the Banking Supervisory Service, which is in charge of paying trial winnings.

Common sense dictates that if the Australian government has officially received such a question, it is natural to answer it properly and directly.

However, at the time, the Banking Supervision Bureau presented me with an invoice containing the word ‘Remittance fee’ when responding to me, but two months later, they unexpectedly submitted another invoice containing the word ‘Remittance fee’ for a whopping 40 times that amount.

And in the meantime, the Australian Attorney General committed the atrocity of public power by forcibly linking a past case of fine payment, which was completely unrelated to this trial, to the process of concluding this trial and threatening to deprive the person of all rights unless he or she pays a four-fold increased fine (which is against international law).

Things that cannot possibly happen in a general society where conversations are based on common sense standards continue to occur every month, and the Australian government, which has already frozen all of my Australian assets before the start of this trial, is continuously abusing the “unreasonable tyranny of power” even though it knows full well that it will be difficult to carry out any tasks in this state, especially on the public interest reporter and the person who won the trial.

Even in this phase of zero predictability, I struggled to survive, because the Australian Attorney General issued a government document containing a government promise, “This is absolutely final fees,” on January 6, 2025, to me protesting against double jeopardy, and distributed it to relevant departments such as the Banking Supervisory Service, so I believed that promise. During March 25, the Australian Attorney General made this written promise for the second time, and there were several other verbal promises as well.

So, even at that time, I did not collapse and endured the task requested by the Australian government by paying a huge additional fee due to the delay. However, the Australian Minister of Justice and the Banking Supervisory Service, who are well aware of this situation, committed the atrocity of collecting another large amount of fees due to delays in June 25, even though the Australian Minister of Justice and the Banking Supervisory Service collected over $300,000 in remittance fee delays in February 2025.

What is even more surprising is that even though such a huge remittance fee was collected in advance, the USD was exchanged for AUD without any notice to me, and due to the first interest rate cut by the Commonwealth Bank of Australia and the previous interest rate cut that was not mentioned in February 2025, 'the difference in the reference exchange rate was exaggerated as if it were Australia's unique logic even though the market exchange rate was almost the same,' and the Australian Banking Supervisory Service, which has the trial winnings, again violated all human rights of public interest reporters at the final stage. They are engaging in ‘war crime-level tyranny of public power.’

Until now, I have told you how treacherously, cleverly, and unconscionably we are being trampled upon by the Australian government.

When you hear this story, some people may surprisingly feel that Korea's specific management system is in a similar context.

I majored in psychology in undergraduate school, and psychology is an American discipline that basically uses a statistical approach to phenomena related to human psychology. The development of statistics is amazing, and in particular, the surprising difference between advance voting and main voting, which continues to expand recently, has reached a level where questions must be asked based on the conscience of scholars and social scientists.

Therefore, it has been pointed out in various ways that the ‘electronic sorter’ that Korea has exported to several countries has quite a few problems in most countries, and although Taiwan is an IT powerhouse on the same level as Korea in the IT sector, including semiconductors, it avoids using this type of sorter. In addition, considering the fact that it is virtually difficult to verify the complicated process that is delivered through the post office after advance voting, we insist on holding a main vote without advance voting. In addition, in order to completely prevent accidents that may occur in the process of collecting ballot boxes from various polling places and moving them to district-level gymnasiums like in Korea, votes are counted at the voting site in Taiwan and ballot boxes are not moved around like in Korea.

As a public interest reporter, I reported to the Australian authorities on February 6, 2024 the bribery and corruption case of the head of a state-owned bank in Perth, which not even 100 Australian citizens could do. Even though the Australian government contributed as much as USD18M in treasury income in June 2024, instead of saying a word of gratitude to me, they robbed me of everything and put me in a ‘hell where life is harder’. To what extent is the Australian government acting against international common sense, international standards, and international conscience, especially towards public interest reporters who have contributed to the country?

Based on the above international common sense, international standards, and international conscience, what do you think will happen to Korea's future if Korea fails to improve the minimum election management system and ensure transparency?

Likewise, I would like to point out that this kind of Korean government attitude is the same as the 'blind-faced, catfighting attitude' of blocking attempts to verify the Korean election management system, which has been highlighted as an issue internationally, and the 'story of the Australian government robbing public interest reporters of everything that contributed to the Australian nation'.
