지난 3월 노태악 전 대법관이 퇴임한 뒤 다섯 달 가까이 흐르도록 조희대 대법원장은 후임 대법관 제청을 하지 않고 있다. 그러자 대법원장을 향한 여권의 압박이 표면화하고 있다. 더불어민주당 당대표 선거에 출마한 김민석 전 국무총리는 지난 30일 “대법관 제청을 마냥 미루는 조 대법원장의 직무 유기가 도를 넘었다”며 탄핵을 거론했다. 조 대법원장은 노 전 대법관 후임 제청을 안 하는 것일까, 못 하는 것일까.

이와 관련해 오는 9월 7일 퇴임하는 이흥구 대법관 후임 후보를 추리기 위한 대법관후보추천위원회가 4일 열린다. 대법원 주변에선 이 대법관 후임자 추천과 제청을 계기로 노 전 대법관 후임자 제청 문제가 풀릴지 주목한다.

노태악 전 대법관 후임 제청은 지난 1월 21일 추천위가 윤성식 서울고법 부장판사, 김민기·박순영 서울고법 판사, 손봉기 대구지법 부장판사 등 4명을 추천한 이후 멈춰 있다. 대법원장은 통상 추천위가 후보군을 추천하면 2주 정도 기간을 두고 1명을 골라 대통령에게 임명을 제청해 왔다. 하지만 이번에는 6개월 넘도록 제청이 이뤄지지 않았다. 조 대법원장과 청와대가 최종 후보를 누구로 할지 이견을 해소하지 못한 탓이다. 청와대는 김민기 고법판사를 적임자로 꼽고 있지만 조 대법원장은 다른 후보자를 염두에 둔 것으로 알려졌다.

헌법에 따라 대법관은 대법원장의 제청으로 국회 동의를 얻어 대통령이 임명한다. 이에 앞서 대법관후보추천위원회는 법원조직법에 따라 대법원장에게 후보로 3명 이상을 추천한다. 고위 법관 출신 법조인은 “제청권과 임명권을 나눠 가진 두 헌법기관이 협의해 적임자를 찾되 대통령과 대법원장의 의견이 다를 경우 제3의 대안을 고려해보라는 취지에서 추천위가 3명 이상을 추천하는 것”이라고 했다.

대법원은 노태악 전 대법관 후임자 제청을 두고 청와대와 간헐적으로 협의를 시도해 왔다고 한다. 하지만 반년째 제청 문제를 매듭짓지 못하면서 진퇴양난에 처한 모습이다. 조희대 대법원장으로선 청와대가 원하는 후보를 제청하면 제청권을 독립적으로 행사하지 못했다는 비판을 받을 수 있다. 그렇다고 청와대의 뜻과 다른 후보를 제청하면 여당이 과반 의석을 차지한 국회에서 임명 동의안이 부결되거나 대통령이 임명을 거부하는 초유의 사태가 벌어질 수 있다.

이런 상황에서 조희대 대법원장은 지난 2월 이후 공석이던 법원행정처장에 노경필 대법관을 지난달 임명했다. 노 처장은 전남 해남 출신이다. 현 여권 지지 기반인 호남 출신으로는 10년 만에 행정처장을 맡았다. 조희대 대법원장은 재판 업무를 하지 않는 행정처장 자리를 넉 달 넘게 비워둔 채 나머지 대법관 12명을 모두 재판에 투입해왔다. 그런 조희대 대법원장이 재판부 공백을 감수하면서 노경필 대법관을 행정처장에 임명한 것은 꼬여 있는 대법관 제청 문제의 물꼬를 트려는 인사란 해석이 나온다.

이흥구 대법관이 9월 7일 퇴임할 때까지 후임이 임명되지 않으면, 대법원 전원합의체는 대법관 2명이 공석인 상태로 운영된다. 연간 4만건 넘게 접수되는 상고심 사건 처리도 늦어질 수밖에 없다. 법관들 사이에선 신속·공정한 재판을 강조해 온 조 대법원장이 재판부 공백을 장기간 방치하지는 않을 것이라는 관측이 많다.

이 때문에 오는 4일 이 대법관 후임 후보가 추려지면 조희대 대법원장이 노태악 전 대법관 후임까지 동시에 제청할 가능성이 거론된다. 청와대와 대법원장이 각자 선호하는 후보를 1명씩 반영할 수 있다는 것이다.​​ 법조계 관계자는 “조 대법원장이 대법관 제청과 관련해 청와대와 협의를 진행해왔다면 직무 유기라고 하기는 어렵다”며 “대법원장과 청와대가 한 발씩 물러서 갈등을 풀어야 하지 않겠느냐”라고 했다.

Five months have passed since former Justice Rho Tae-ak retired in March, but Chief Justice Jo Hee-de has yet to nominate a successor.
