국회 법제사법위원회 소속 범여권 의원들은 조희대 대법원장을 겨냥해 “김건희 등 내란 및 국정농단 사범 재판지연하는 대법원장의 직무유기, 반드시 책임을 묻겠다”라고 16일 밝혔다.

이날 더불어민주당, 조국혁신당, 진보당 법사위 의원들은 입장문을 내고 “한덕수와 이상민에게 항소심 재판부는 각각 징역 15년과 징역 9년의 중형을 선고했고, 김건희 피고인의 혐의에 대해서도 2심에서 징역 4년의 실형이 선고됐다”면서 “그러나 이미 하급심을 통해 입증된 이들의 범죄 혐의에 대한 최종적인 법적 판단은 미뤄지게 됐다”고 했다.

그러면서 “상고심 선고 법정 시한을 며칠 앞두고 전원합의체 회부를 결정한 조희대 대법원에 그 책임이 있다”고 했다.

조 대법원장에게 책임을 물으며 “상고심 처리 기한을 명백히 넘기게 된 이번 결정은 피고인들이 줄기차게 요구해 온 ‘시간 끌기·재판 지연 전략’에 최고법원이 사실상 동조하고 명분을 깔아줬다는 국민적 비판을 면하기 어렵다”고 했다.

또 “윤석열이 임명한 조희대 대법원장 자신도 취임 이후 줄곧 법대로 ‘633 원칙’을 강조하며 신속한 재판을 주문해 왔다” “그런데 왜 지금은 자신이 그토록 강조했던 ‘3개월 원칙’을 깨버리는 것이냐”라고도 했다.
