국회 법제사법위원회는 19일 전체회의에서 조희대 대법원장 출석 요구 안건을 여당 주도로 의결했다.

법사위 여당 간사인 더불어민주당 김승원 의원의 요구로 상정된 조 대법원장 출석 요구 안건은 민주당 등 범여권 의원들의 찬성표로 가결됐다. 국민의힘 의원들은 전원 반대했다.

민주당 소속 서영교 법사위원장은 “장기간 공석인 대법관 후보 제청 과정에서 어떤 일이 있었는지와 김건희·한덕수·이상민 재판을 대법원 전원합의체로 회부하게 된 사유 등을 질의하기 위한 것”이라고 했다.

서영교 법사위원장은 ‘위원회는 특정한 사안에 대해 질문하기 위해 대법원장 또는 그 대리인의 출석을 요구할 수 있다’는 국회법 제121조 5항을 근거로 출석 요구가 적법하다고 했다.

민주당 의원들은 이날 법사위 회의에서 조희대 대법원장이 대법관 최종 후보 2명을 이재명 대통령에게 ‘서면’으로 임명 제청한 것을 두고 대통령과 국회를 무시한 사법 정치라고 비판했다.

국민의힘 주진우 의원은 “청와대가 제청권에 관여하는 직권남용을 해 놓고 정당한 제청권을 행사한 대법원장한테 지금 뒤집어씌우고 있다”며 “의회 독재다. 굉장히 국민들에게 낯부끄러운 일”이라고 했다.
