비(非)거주 1주택자의 종합부동산세와 양도소득세를 강화하는 정부의 세제 개편안을 두고 민주당이 23일 고위 당정청에서 “거주·비거주 구분을 두지 말라”고 요청하면서 정부가 장고에 들어갔다. 정부는 “집은 사는(buying) 것이 아닌 사는(living) 곳”이라며 비거주자의 각종 공제 혜택을 축소할 것을 예고했지만, 다음 달 초 국회 법안 제출 시한을 앞두고 이달 초 냈던 세제 개편안의 골자를 뜯어고쳐야 하는 상황이 됐다.
◇거주 구분 “폐지보다 완화 무게”
정부 고위 관계자는 “민주당 요청대로 거주자와 비거주자 구분을 폐지할지, 구분을 일정 부분 완화할지를 놓고 내부적으로 논의하고 있다”고 밝혔다. 또 다른 정부 관계자는 “거주 구분을 완전히 폐지하는 방안보다는 비거주자 불이익을 줄이는 방향에 무게를 두고 있다”고 했다.
민주당 내에선 강경파 의원들을 중심으로 정부 원안의 주요 내용을 고수해야 한다는 주장이 나온다. 서울 지역구 한 중진 의원은 “투기적 목적으로 비거주 1주택을 보유한다면 규제해야 한다”며 “세제 개편안 수정을 요구하는 당의 방침에 동의하지 않는다”고 했다. 서울 지역구 다른 의원도 “실거주 원칙을 명확히 해야 한다”고 했다.
◇종부세 기본공제 수술대로
당장 수술대에 오를 대목은 종합부동산세 기본공제다. 정부 세제 개편안에 따르면, 종부세 과세 대상 1주택자의 기본공제액은 공시가격 12억원(시세 약 17억4000만원)에서 14억원(약 20억3000만원)으로 완화된다. 하지만 비거주자는 기본공제가 12억원에서 9억원(약 13억원)으로 확 줄어든다. 종부세 기본공제는 거주 기간을 따지지 않고 세금을 내는 해의 6월 1일 기준 거주 여부를 기준으로 따진다. 그러다 보니 10~20년 넘게 한 집에 살다가 전근, 육아 등 불가피한 이유로 비거주자가 돼도 투기꾼을 겨냥한 정부의 증세 대상이 된다. 비거주자 기본공제 수준을 거주자와 동일하게 14억원으로 맞추거나 기존 공제액인 12억원 등으로 일정 정도 높이는 방안을 놓고 정부는 고심하고 있다.
단독 명의보다 세 부담이 더 큰 폭으로 불어나는 공동명의 비거주 1주택자의 기본공제도 손질이 불가피하다. 공동명의 거주자는 18억원(약 26억원)의 기본공제가 유지되지만, 비거주자는 기본공제가 9억원으로 크게 줄기 때문이다. 한국여성단체협의회는 13일 “공동명의가 단독명의보다 불리해진다면 양성평등의 시대정신에 역행하는 것”이라는 성명을 냈다.
10년간 보유·거주하면 양도소득세를 낼 때 양도차익에서 최대 80%를 깎아 세금을 줄여주는 장기보유특별공제 폐지도 논란거리다. 기존엔 보유 기간에 따라 최대 40%, 거주 기간에 따라 최대 40%를 깎아줬는데 보유 공제를 전면 없애면 역시 불가피한 비거주자에 대한 과도한 증세로 이어진다는 불만 때문이다. 이에 거주 인정 범위를 넓히는 방안 등이 논의된다.
◇거주 인정 요건, 서울 역차별
정부는 세제 개편안에서 고교·대학 진학과 자녀 학교 폭력 피해에 따른 전학, 1년 이상 부모 봉양 등을 불가피한 비거주로 보기로 하고, 이 경우 거주 기간으로 최장 3년 인정해 주기로 하는 방안을 낸 상태다. 여기에 추가로 결혼, 육아 등 또 다른 사유를 불가피한 사유로 추가하는 방안도 검토하고 있다.
거주 인정 요건의 서울 역차별 문제도 검토 대상이다. 현행 정부안은 종부세 납세자가 몰린 서울·경기의 경우 시·군을 넘어서는 이사만 ‘불가피한 비거주’로 인정한다. 예외로 광역시 내 구 지역과 세종특별자치시, 제주자치도 내 동·읍·면 간 이전은 거주로 인정받을 수 있다. 수도권 외 고가 주택 소유자는 살던 집을 세주고 근처 동네에 세 들어 가도 실거주로 인정받을 수 있다는 것이다. 이에 서울 시내에서 유아, 손주 돌봄 등을 이유로 불가피한 이사를 하게 된 경우를 거주로 인정하지 않는 것은 서울 역(逆)차별이라는 지적이 나온다. 같은 생활권인 위례신도시 내 경기 하남·성남·서울 송파구 간 이사는 거주 요건으로 인정받는 반면, 서울 강동구 주택 보유자가 강서구로 이사하는 경우는 거주로 인정받는 혜택을 받지 못한다. 국세청에 따르면, 작년 주택분 종부세 납세자의 60.7%는 고가 주택을 보유한 서울 사람들이었다.

Critics argue that Seoul residents forced to relocate within the city for childcare or elderly care are unfairly excluded from residency benefits. For example, relocations within the same living zone—like between Hanam, Seongnam, and Songpa in the Wirye New Town—are recognized, but a Gangdong District homeowner moving to Gangseo District does not receive the same benefit.
