다음 달 2일 폐지를 앞둔 검찰이 사건 정리에 들어갔다. 대검찰청은 최근 일선 검찰청에 수사 중인 사건을 가급적 공소청 출범 전에 마무리하라는 내용의 지침을 내렸다고 3일 밝혔다.
대검은 지난 1일 전국 검찰청 기획 부서에 ‘공소청 출범에 따른 사건 처리 방안’이라는 공문을 보냈다. 검찰이 수사 중이거나 접수한 사건들을 남은 기간 동안 어떻게 처리할지에 대한 내용이 담겼다. 공문에 따르면, 검사가 직접 수사를 개시한 사건과 경찰 등에서 송치한 사건 등을 △10월 2일 이전 처리 △90일 유예 기간 내 처리 △이첩 불가피 등 세 가지로 분류해 처리하도록 했다.
대검은 우선 공소청 출범 전에 사건을 마무리하는 것을 원칙으로 정했다. 다만 공소시효가 임박했거나 사건의 성격상 불가피한 경우엔 공소청 출범 후 90일 동안 검사가 수사를 계속할 수 있도록 했다. 이는 개청과 함께 시행되는 개정 형사소송법과 공소청법에 따른 것이다.

대검은 특히 피의자나 핵심 참고인의 행방을 찾지 못해 기소중지·참고인중지된 사건 중 검찰이 지명수배한 사건을 신속히 경찰이나 특별사법경찰(특사경)에 넘겨야 한다고 강조했다. 검찰청이 폐지되면 검사의 수사권도 사라지는 만큼, 검찰이 지명수배한 피의자가 붙잡히더라도 수사가 불가능하고 풀어줘야 할 수밖에 없기 때문이다. 이에 따라 다른 수사기관이 사건을 넘겨받아 법원에서 체포영장을 다시 발부받고 새로 수배해야 한다. 지난달 20일 기준, 기소중지·참고인중지로 지명수배 혹은 지명통보된 사건은 75만1607건이다.
한 법조계 관계자는 “수배된 사건 수십만건이 한꺼번에 이관되고, 다시 수배가 내려지는 과정에서 혼란과 공백이 우려된다”고 말했다. 대검은 “법원·경찰 등과 협의해 사건 이송과 체포영장 재발부에 공백이 생기지 않게 이달 18일까지 필요한 조치를 완료할 방침”이라고 했다.
