서울중앙지법 형사26부(재판장 이현경)는 이날 군형법상 군사기밀누설 혐의로 기소된 문 전 사령관의 선고 공판을 열고 이 같이 판단했다.
문 전 사령관은 비상계엄 전날이었던 2024년 12월 2일 오전, 김용현 당시 국방장관에게 ‘정보사령부 특수부대 관련 임무를 잘 준비하라’는 지시를 받고, 이 내용을 같은 날 노 전 사령관에게 전달한 혐의를 받는다. 당시 노 전 사령관은 전역을 한 뒤라 민간인 신분이었다. 해당 내용엔 특수부대의 예산 등 정보가 포함된 것으로 알려졌다.
그러나 법원은 문 전 사령관이 전달한 내용이 군사 기밀에 해당하지 않는다고 봤다. 재판부는 “문 전 사령관이 언급한 ‘특수부대’ 등 단어만으론 군 기밀이 외부에 누설된다고 보기 어렵다”며 “노 전 사령관이 기존에 알고 있던 정보 이상의 자료를 제공받지 않았다”고 했다.
고의성에 대해서도 “당일 오전 국방장관에게 보고가 있었다는 사실을 말하고자 하는 의도를 넘어 문 전 사령관에게 군사상 기밀을 누설하고자 하는 고의가 인정되지 않는다”고 했다.
당초 이 사건은 국방부 검찰단이 기소해 군사법원에서 재판이 진행됐지만, 지난 1월 문 전 사령관이 파견되면서 서울중앙지법으로 이송됐다.
앞서 문 전 사령관은 비상계엄 당시 부정선거 의혹 수사를 위한 비선 조직인 ‘제2수사단’을 구성하기 위해 민간인 신분이던 노상원 전 정보사령관에게 요원 40여 명의 명단을 넘긴 혐의(군기누설·개인정보보호법 위반)로 기소돼 지난 6월 징역 2년을 선고받고 법정구속됐다.
문 전 사령관은 비상계엄과 관련해 내란 중요 임무 종사 혐의로도 기소돼 재판을 받고 있다. 이에 대한 1심 선고는 오는 21일 나올 예정이다.
