더불어민주당과 조국혁신당, 진보당 등 범여권은 22일 조희대 대법원장이 대법관 후보자 재제청을 거부한데 대해 “윤석열의 12.3 쿠데타에 이은 사법쿠데타다. 3권분립의 중대한 훼손이자 사법농단”이라며 “다가오는 국정감사에서 진상을 소상히 규명할 것을 국민께 엄중히 약속드린다”고 했다.
앞서 조 대법원장은 이날 대법원을 통해 헌법적 근거와 사유를 찾을 수 없다는 이유로 청와대의 재제청 요구에 응할 수 없다고 밝혔다.
지난달 28일 청와대가 노태악 전 대법관의 후임 손봉기 대구지법 부장판사의 임명동의안을 국회에 보내지 않기로 하고 재제청을 요구한 지 25일 만에 나온 입장이다.
더불어민주당·조국혁신당·진보당 법제사법위원회 위원들은 이날 성명에서 “조희대 대법원장은 이재명 대통령이 UN총회 참석을 위해 미국 순방에 나선 상황에서 출국하자마자 재제청 거부를 공개 선언했다. 그것도 대법 공보를 통해서 ‘대법관후보자 재제청 요청 문서에 구체적인 사유와 헌법적 근거가 적혀 있지 않다’는 말 뿐이었다”며 “대통령이 대한민국을 비운 틈을 타 형식 논리에 얽매여 단편적인 거부 입장을 내놓은 모습은 국민에 대한 최소한의 도리를 저버린 것은 물론, 사법부의 중대한 책무를 가볍게 여기는 안타까운 처사”라고 했다. 이어 “사법부의 독립은 재판의 독립이고, 국민의 기본권 보장을 위한 것이지 사법부 스스로가 민주적 통제를 벗어나기 위한 방패가 아니다”라고 했다.
민주당 이주희 원내대변인도 이날 국회에서 기자회견을 열고 “조희대 대법원장의 장고 끝 악수는 본인의 독선과 무책임을 드러내는 부메랑이 될 것”이라며 거부 입장을 철회하라고 했다.
이 원내대변인은 “조 대법원장이 25일을 끌다 내놓은 답은 고작 세 문장의 재제청 거부였다”며 “대통령이 해외 순방에 나선 다음 날, 짤막한 공지로 ‘기습 통보’했다”고 비판했다.
또 “헌법기관 사이의 중대한 이견을 이런 식으로 처리하는 것이 사법부 수장의 처신이냐”고 덧붙였다.
이 원내대변인은 “어제만 해도 조 대법원장은 1시간가량 대통령과 차담을 나누며 허심탄회하게 협의를 할 수 있었음에도 다음날 일방적 통지로 헌법기관 간의 협의의 정신과 존중의 자세를 몰각했다”고 했다.
그는 “헌법 제104조 제2항은 대법원장의 제청권과 국회의 동의권, 대통령의 임명권을 함께 규정한다”며 “본인의 제청권만 존중받아야 하고, 대통령의 임명권은 도장만 찍어야 한다는 것이냐. 헌법을 말하면서 다른 헌법기관의 권한을 무시하는 그 자체가 반헌법적 태도”라고 지적했다.
그러면서 “대법원은 조희대 대법원장 개인의 법원이 아니다”며 “대법관 1인의 공백은 고스란히 국민의 신속한 재판받을 권리의 침해로 이어지고 있다. 조 대법원장은 재제청 거부를 즉각 철회하라”고 요구했다.
