Prosecutors Can Now Request Supplementary Investigations from CIO
Amendment Passes Over CIO's Independence Concerns, Highlighting Agency's Limited Prosecution Success
By Yoo Hee-kon Published 2026.09.22. 00:47 The Chosun Daily Newspaper / 조선일보 CIO located at the Gyeonggi Provincial Government Gwacheon Complex. /News1 The Public Prosecution Office, which will assume prosecution functions from the Prosecutors’ Office set to be dissolved on October 2, can now request supplementary investigations from the Corruption Investigation Office for High-ranking Officials (CIO). The National Assembly passed the CIO Act amendment bill containing these provisions during its plenary session on September 17. Previously, prosecutors could not request supplementary investigations for cases referred by the CIO for prosecution, unlike cases forwarded by the police. Under current law, the CIO can only investigate and prosecute judges, prosecutors, and police officers of the rank of superintendent or higher, while other high-ranking officials must be referred to prosecutors for indictment. However, the absence of prosecutors’ authority to request supplementary investigations from the CIO has led to delays in case processing or instances where prosecutors rejected indictments, causing cases to be ‘ping-ponged’ between the two agencies. The CIO opposed the CIO Act amendment bill, proposed by Democratic Party of Korea Rep. Kim Ki-pyo, arguing that it would ‘infringe upon its independence.’ The CIO requested the use of the term ‘request for additional investigation’ instead of ‘request for supplementary investigation,’ which is used between prosecutors and the police. CIO Director-General Oh Dong-woon attended the National Assembly Legislation and Judiciary Committee plenary session on the 16th and urged lawmakers to ‘deliberate on clauses that could undermine the CIO’s status as an independent agency and its presence.’ Oh further argued against granting prosecutors the authority to request supplementary investigations, citing the case of former President Yoon Suk-yeol, who was arrested by the CIO in January last year on insurrection charges but had his detention revoked by the court. Prosecutors did not file an immediate appeal against the court’s decision. Regarding this, Oh stated, ‘If prosecutors had the authority to request supplementary investigations at the time, they could have achieved the goal of releasing former President Yoon without needing the court’s detention revocation decision.’ The implication is that if prosecutors gain this authority, the Public Prosecution Office could obstruct CIO investigations in the future. However, Oh’s arguments were not accepted by Democratic Party members of the Legislation and Judiciary Committee. The CIO Act amendment bill was passed with 11 out of 13 committee members in favor and later approved by the National Assembly the following day. A current deputy chief prosecutor remarked, ‘The CIO, which possesses both investigative and prosecutorial authority, opposing even requests for supplementary investigations—not investigative directives—from the Public Prosecution Office is tantamount to refusing any oversight.’ The prosecutor added, ‘It is even more incomprehensible for the CIO, which has no notable investigative achievements, to emphasize its independence.’ Since its establishment in 2021, the CIO has directly prosecuted eight cases, with only one resulting in a confirmed guilty verdict. In March last year, a former prosecutor, Yoon, received a suspended six-month prison sentence for forging a citizen’s complaint and creating a false investigation report. In contrast, cases such as former Senior Prosecutor Kim Hyung-jun’s bribery case and former Chief Prosecutor Son Jun-seong’s case involving the leakage of official secrets were acquitted. The remaining five cases are still under trial. · This article has been translated by Upstage Solar AI. |
