Chief Justice Jo Rejects Re-nomination Request Over Constitutional Concerns
Legal Circles Warn Rejection Aims to Block Presidential Control Over Judicial Appointments
| By Kim Eun-gyeong, Lee Min-kyung, Joo Hee-yeon Published 2026.09.23. 00:55 The Chosun Dialy Newspaper / 조선일보 Chief Justice Jo Hee-de announced on the 22nd that he would not comply with Cheong Wa Dae’s request to re-nominate a Supreme Court Justice. This came 25 days after President Lee Jae Myung requested a re-nomination on August 28, stating he would not submit the appointment consent motion for Son Bong-kie (Daegu District Court Presiding Judge), the candidate nominated by Chief Justice Jo, to the National Assembly. Cheong Wa Dae claimed, “This is an attempt to nullify the president’s appointment authority.” Chief Justice Jo issued a statement the same day, stating, “The only document related to Cheong Wa Dae’s re-nomination request is the ‘Request for Re-nomination of Justice Candidate’ dated August 28, which does not specify concrete reasons or constitutional grounds.” He added, “Since no specific constitutional basis or justification for the re-nomination request can be found, I cannot comply.” The Constitution stipulates, “Justices are appointed by the president with the consent of the National Assembly upon the recommendation of the Chief Justice.” However, there are no provisions regarding the procedure or method for re-nominating a Justice. In this context, Chief Justice Jo clearly stated he would not nominate another candidate instead of Son. The Chief Justice’s announcement came the day after President Lee departed for the United Nations General Assembly. Chief Justice Jo had met with President Lee the previous day at the inauguration ceremony for Justice Kim Sung-soo. Legal circles analyzed, “Chief Justice Jo likely judged that complying with the president’s re-nomination request could set a precedent where the administration controls judicial appointments.” A legal source said, “Chief Justice Jo seems to have expressed his intent to adhere to constitutional and legal principles without being swayed by presidential power.” Cheong Wa Dae responded, “The Chief Justice’s statement implies that the Chief Justice’s recommendation authority supersedes the president’s appointment authority, which is unconstitutional.” Democratic Party of Korea leader Kim Min-seok criticized, “Is the Chief Justice engaging in a power struggle with the president? This is truly absurd.” The Democratic Party plans to summon Chief Justice Jo during the parliamentary audit next month to demand explanations. ◇Jo Hee-de’s Rejection of Cheong Wa Dae’s Request: Concerns Over Judicial Appointments Being Controlled by the Administration Chief Justice Jo Hee-de’s rejection of President Lee Jae Myung’s re-nomination request on the 22nd is interpreted as a statement that the president cannot undermine the Chief Justice’s recommendation authority by prioritizing his appointment authority. If the Chief Justice were to comply with the request to nominate someone other than Son without going through the National Assembly’s appointment consent process, his recommendation authority could devolve into a power requiring prior presidential approval. ◇Jo: “No Constitutional Basis or Reason Found for Re-nomination Request” In his statement, Chief Justice Jo cited Constitution Article 82, which states, “The president’s official acts must be documented with the approval of the prime minister and relevant ministers.” He argued that President Lee did not provide specific reasons or constitutional grounds when rejecting Son Bong-kie and requesting a re-nomination. Cheong Wa Dae countered, “The official document included the prime minister’s approval, yet the Chief Justice distorted the facts by claiming a constitutional flaw.” The re-nomination request document sent by Cheong Wa Dae on August 28 reportedly only included the prime minister’s approval. A Supreme Court official clarified, “The Chief Justice’s position was not that the document was invalid due to a lack of approval.” Earlier, Cheong Wa Dae had stated, “The unilateral written recommendation of Son without substantive consultation between the president and Chief Justice failed to meet procedural completeness.” However, the document reportedly only mentioned, “Pursuant to Constitution Article 104(2), since the appointment consent motion for Son will not be submitted to the National Assembly, please re-nominate a candidate.” ◇The Ball Is Now in Cheong Wa Dae’s Court Constitutional scholars generally agree that the Chief Justice’s recommendation authority and the president’s appointment authority are not hierarchical or binding. The Chief Justice is not obligated to nominate the president’s preferred candidate, and the president is not required to appoint a nominated candidate unconditionally. However, the Constitution and laws do not specify under what circumstances the president may reject an appointment or the procedure for requesting a re-nomination. Regarding this, Professor Cha Jin-a of Korea University stated, “Considering the respect due to the head of the judiciary and the intent of the recommendation authority, the president should present valid reasons to persuade the public when rejecting a candidate without clear disqualifications.” The implication is that requesting a re-nomination without clear grounds for disqualifying Son is unjustified. With Chief Justice Jo rejecting the re-nomination request, the decision now rests with Cheong Wa Dae. It has two options: First, submit Son’s appointment consent motion to the National Assembly for a hearing and vote. If the motion is rejected, Chief Justice Jo must nominate a new candidate. If the motion passes and President Lee still refuses to appoint Son, it would be unrealistic given the Democratic Party’s majority in the Assembly. Second, President Lee could send a new document to Chief Justice Jo with constitutional grounds and specific reasons for the re-nomination request. However, legal circles doubt this is likely, as the Chief Justice may still refuse. Cheong Wa Dae is reportedly considering filing a constitutional dispute with the Constitutional Court. Even if Chief Justice Jo complies, observers suggest he would not nominate another candidate from the existing four shortlisted individuals. Instead, a new Justice Candidate Recommendation Committee would likely be formed. The Court Organization Act requires forming a recommendation committee for each nomination, and internal court opinions favor restarting the process. ◇Prolonged Justice Vacancy Possible The Justice Candidate Recommendation Committee recommended four candidates in January to replace former Justice Rho Tae-ak: Son, Yoon Seong-sik (Seoul High Court Presiding Judge), Kim Min-gi (Seoul High Court Judge), and Park Soon-young (Seoul High Court Judge). Cheong Wa Dae is reportedly urging the nomination of one of the remaining three, excluding Son. Legal circles interpret this as a push for Kim Min-gi, as Yoon oversees insurrection cases and Park is under special counsel investigation as a National Election Commission member. However, Chief Justice Jo is reportedly reluctant to nominate Kim due to potential conflicts of interest, as Kim’s spouse is Constitutional Court Justice Oh Young-jun. Even if the conflict over the nomination prolongs the Justice vacancy, Supreme Court operations will not immediately halt. A division requires at least three Justices for rulings, and the full bench can still meet quorum. However, with each Justice handling around 4,000 cases annually, a prolonged vacancy could increase the burden on remaining Justices and delay appeals. Court insiders predict the vacancy could persist until Chief Justice Jo’s retirement in June next year if Cheong Wa Dae does not change its stance. · This article has been translated by Upstage Solar AI. |
