The Manage e-Filing module provides authenticated users with the following functionality: - Complete and submit Small Claims documents;
- Pay, via credit card, Small Claims filing fees, if applicable;
- Edit incomplete Small Claims documents;
- Receive status updates on submitted documents; and
- Maintain a history of previous Small Claims filings.
To file a Small Claims document, click on the "Start New Filing" link above. To edit or review an existing filing, click on the "Review / Edit Filings" link above.
The following Small Claims documents are available for electronic filing: - Statement of Claim
- The Statement of Claim is the originating document for a Small Claims case. The form collects, and provides to the Provincial Court, the following information about a claim: 1) Plaintiffs; 2) Defendants; 3) What Happened; 4) Where and When it Happened; 5) Amounts Claimed; and 6) Amounts Abandoned.
The fee to file a claim up to and including $499.00 is $50.00. The fee for claims of $500.00 and over is $100.00.The applicable fee must be paid online via Credit Card before your document can be submitted electronically.
- Reply to Statement of Claim
- This form is used to agree with the Statement of Claim, dispute it, and/or make a counterclaim against the other party(s). A Defendant who receives a Statement of Claim may take the following actions: 1) Agree and pay; 2) Admit to all or part of the claim; 3) Admit to all or part of the claim and propose a payment schedule; 4) Oppose all or part of the claim; 5) Counterclaim; 6) Apply to transfer the claim to another Jurisdiction; or 7) Make a claim against a third party. This form is used to complete actions 1 through 5.
- Proof of Service of Statement of Claim
- A document filed by the Plaintiff informing the court of when, how, and whom you have served. A Statement of Claim must be served on all defendants.
- Proof of Service of Reply to Statement of Claim
- A document filed by the Defendant informing the court of when, how, and whom you have served. A Reply must be served on all Plaintiffs.
- Application for Default Judgment
- When a Defendant does not reply to a claim within the time limit (10 days within the Province of Newfoundland and Labrador (NL) and 30 days outside the province), the Plaintiff may ask the court for a Default Judgment. The Default Judgment form shall request the outstanding amount due the Plaintiff, plus amounts expended for filing and service of documents.
An Application for Default Judgment has a filing fee of $10. If registering your Judgment with the Judgment Enforcement Registry an additional $15 is charged. All fees must be paid online via Credit Card before your document can be submitted electronically.
- Summons to a Payment Hearing
- A document filed by the Creditor to summons the Debtor (s) to court to assess the Debtors ability to pay and for a Judge to consider whether a payment schedule should be ordered. A payment hearing can be requested by the Creditor.
A Summons to a Payment Hearing has a filing fee of $10. If more than one Summons to a Payment Hearing is filed within a 6 month period, the filing fee increases to $25. This fee must be paid online via Credit Card before your document can be submitted electronically.
- Proof of Service of Summons to a Payment Hearing
- Complete this form to provide the court with proof that the Summons has been served on the person(s) named in the Summons. According to the Rules of Service, a person named in the Summons to a Payment Hearing needs to be served.
- Application for Summary Judgment
- A party can apply for Summary Judgment against the other parties in a case where a reply was filed agreeing with the claim. The Summary Judgment must give the details of why the court should issue the judgment.
An Application for Summary Judgment has a filing fee of $10. If registering your Judgment with the Judgment Enforcement Registry an additional $15 is charged. All fees must be paid online via Credit Card before your document can be submitted electronically.
- Judgment
- This form is used for judgments, with the exception of Default Judgment. A judgment form can be filed with the court by either Plaintiff or Defendant at the completion of a trial. A judgment must be registered with the Office of the High Sheriff if you want to proceed to enforcement.
A Judgment has a filing fee of $10. If registering your Judgment with the Judgment Enforcement Registry an additional $15 is charged. All fees must be paid online via Credit Card before your document can be submitted electronically.
- Notice of Withdrawal
- Complete this document to request a withdrawal. The Creditor or Debtor (if a counterclaim exists) may decide to withdraw the claim (and counterclaim) at any time during the Small Claims process. A party who withdraws a claim or counterclaim MAY NOT at any time proceed with it or file another notice with respect to the claim or counterclaim without the permission of a Judge.
- Notice of Satisfaction
- A satisfaction piece is filed when a debt has been satisfied. This form can be filed by either the Creditor or Debtor to notify the court that satisfaction has been achieved. If filed by the Debtor proof of satisfaction must be attached to the form.
- Application to a Judge
- Complete this form to request the following Orders: 1) Permitting Costs; 2) Permitting another method of service; 3) Cancelling a Default Judgment or dismissal order; and 4) Transferring the matter to another court or other orders permitted under the Small Claims Rules.
An Application to a Judge has a filing fee of $10, except if you are applying to Cancel a Default Judgment or Dismissal Order which carries a fee of $50. All fees must be paid online via Credit Card before your document can be submitted electronically and are not recoverable.
- Residential Tenancy/Restitution Order Judgment
- A judgment form is completed and filed with the court to enforce payment of a Residential Tenancy Order or a Restitution Order. Certified copies of these orders are required upon filing.
A Residential Tenancy Order has a filing fee of $10. Restitution Orders are free. If registering either with the Judgment Enforcement Registry an additional $15 is charged. All fees must be paid online via Credit Card before your document can be submitted electronically.
- Judgment Enforcement Registration
- To enforce the Judgment of a claim, the creditor must register their judgment with the Sheriff's Office. The cost of registering a judgment is $15. To register a judgment, simply answer "yes" when asked if "you wish to register your judgment" while completing an applicable Small Claims document.
