재판부는 “오 시장이 자신의 정치적 입지에 중대한 영향을 미칠 수 있고, 선거 캠프 내에서도 은밀하게 진행돼야 할 불법 여론조사 비용의 대납을 김한정씨에게 대놓고 요청했다는 것은 상식적으로 쉽게 받아들이기 어렵다”며 “김씨가 지급한 돈이 여론조사 10회분에 각각 대응해 지급됐다고 보기도 어렵다”고 했다.

재판부는 “당시 강 전 부지사와 명씨 사이 몇 차례 만남이 있었던 것으로 보이고, 오 시장 캠프 측과 명씨 사이에 여론조사 일부가 공유됐으며, 김씨가 돈을 지급한 사실이 객관적으로 인정되므로 유죄의 의심이 전혀 없는 건 아니다”라고 했다. 다만 재판부는 “명씨의 진술을 믿기 어렵고, 나머지 증거들로 인정되는 단편적인 사실만으론 공소사실을 증명하기에 부족하다”고 했다.
