Update
54 senior HR activists detained yesterday, charged of holding 'illegal assembly' and interfering with public officers under the Criminal Procedure Code, taken into 'preventative detention' under Maintenance of Public Order Ordinance, were remanded to Kotlakhpat Jail Lahore this evening. They are supposed to be produced before a Magistrate on Nov. 6th (tomorrow).
The meeting that was found objectionable was held at the secretariat of Human Rights Commission of Pakistan. Today, the Public Prosecutor made himself absent from the court of the Magistrate when the detainees were produced therefore initial inquiry could not be proceed.
Background The emergency imposed by Chief of Army, General Musharraf leads back to March 2007, when he suspended Chief Justice of Pakistan on the allegations of abuse of power. However Iftakhar Mohammad Chaudhry (Chief Justice of Pakistan) denied the allegations. He was supported by the lawyers, opposition parties, civil society and human rights organizations, which resulted into massive protests all over the country. The Supreme Court restored Chief Justice Iftkhar Mohammad Chaudhry on July 20, 2007.
The reasons of imposing emergency were stated as follows: ?Attacks on the state infrastructure, security agencies
Following allegations were leveled against Judiciary: ?Affecting war against terrorism, economic growth ?Weakening government writ ?Demoralizing police, hampering intelligence agencies ?Release of some militants by court orders ?Judges overstepping their authority ?Supreme Judicial Counsel made irrelevant ?Judges humiliating government officials in the court
The declaration of emergency rule came at a time when Supreme Court was hearing a crucial case on the eligibility of general Musharraf as the candidate of president. He had been elected President in an election but Supreme Court had stayed the result of Presidential election till the decision on his contested eligibility. The Chief Justice and his colleagues were also hearing cases against government officials and were perusing the cases of missing people allegedly detained by intelligence agencies. However, seven judges of the Supreme Court overturned the Provisional Constitutional Order (PCO) and restrained the Chief of Army Staff, Corps Commanders, Staff officers and civil and military officers from acting under PCO before they were sent home on November 3rd, 2007.
