근로 계약서
① 개요
ㅇ근로계약은 문서로 체결하는 것이 원칙이다.
- 베트남 노동보훈사회부에서 정한 표준근로계약서 양식을 사용하되 베트남어와 영어로 작성한다. 필요시 내용을 추가할 수 있다.
- 근로계약서는 원본을 2부 작성, 사용자와 근로자가 1부씩 보관한다.
ㅇ근로계약은 인력공급조직과 체결한 인력공급계약의 내용과 상충되어서는 안된다.
- 근로계약 체결후 5일 이내에 근로자는 근로계약서를 인력공급기관에 제출한다. 다만 일시적 근로일 경우 구두로 체결이 가능하나 분쟁방지를 위해서는 서면체결이 바람직하며 구두로 근로계약을 체결하더라도 양측 합의하에 제3자가 목격하는 가운데 체결하는 것이 좋다.

② 근로계약서 체결형태
ㅇ기간에 따라 세가지 형태의 근로계약이 가능하다.
    a. 기간을 정하지 않은 근로계약(기간 미확정)
    b. 12개월에서 36개월 기간의 근로계약(기간 확정)
    c. 12개월 미만의 계절근로 또는 특정용역에 관한 근로계약
ㅇ기간을 정한 기한부 근로계약이 종료된 후 노사 쌍방은 30일 이내에 재계약을 체결하여야 한다. 新근로계약이 체결되지 않으면 舊근로계약은 기간 미확정 근로계약이 된다. 노사 쌍방이 기간이 정해진 신근로 계약을 서명하면 그 계약은 1회에 한하여 연장되며 이후 근로자가 근로를 계속할 경우 노사 쌍방은 기간 미확정 근로계약을 체결하여야 한다(개정 노동법, 2003년 1월부터 발효).

③ 시험채용
ㅇ시험채용기간은 원칙적으로 30일 이내이며, 전문적 업무일 경우는 60일 이내다. 이 기간중 최저임금은 예정 급여의 70%선 이다.
ㅇ시험채용기간 종료후 정식근로계약서 작성이 원칙이나 실제로는 근무시작과 동시에 근로계약이 체결되는 것이 일반적이다. 실제로는 근무시작과 동시에 근로계약이 체결되는 것이 일반적이다. 이 경우 근로계약서에 시험채용기간과 본채용기간은 각각 명기하여야 한다.

Article 3

ㆍTo carry out fully all tasks as agreed in the labour contract.
ㆍTo comply strictly with the internal rules and regulations of the organization in relation to discipline, labour safety and other provisions stated in the collective agreement(if any); and be directly under the management of Mr(Madam).

2. Powers:

ㆍTo make proposals, complain, suspend or terminate the labour contract in accordance with the provisions of the laws on labour.

3. Rights:

ㆍTransportation to work.
ㆍWages or salary of per month to be paid in instalments on the and day of each month.
ㆍAllowances.
ㆍOccupational safety.
ㆍHolidays, leave and special leave for private reasons.
ㆍSocial insurance.

ㆍCollective welfare.
ㆍPromotion tests, rewards, professional training inside or outside the country ; scientific and technological co-operation with organizations inside or outside the country.
ㆍ Redundancy compensation payments in accordance with laws on labour.

Article 4

Obligations and powers of the employer:

1. Obligations:

ㆍTo fulfil the required conditions as agreed in the labour contract in order to ensure the occupational safety, hygiene and convenience of the employee.
ㆍTo guarantee secure employment for the employee as agreed in the contract.
ㆍTo provide fully and quickly the employees with the rights and interests specified in the contract.

2. Powers:

To transfer employees, interrupt temporarily the employee's work, cancel temporarily or terminate the contract; apply disciplinary measures as stipulated in laws on labour.

1. Other agreements.
