A ruling form the Michigan Supreme Court says police can't search cars based solely on the smell of marijuana.
The court threw out gun charges against a man whose car was searched in Detroit in 2020 when the odor of marijuana was detected.
in 2018, Michigan voters legalized the possession and use of a small amount of marijuana by anyone 21 or older, though it can not be used inside a vehicle.
Writing for the majority, Justice Megan Cavanagh wrote, "The smell of marijuana no longer constitutes probable cause.
It might just as likely be the person is in possession of a legal amount, recently used marijuana legally, or was simply in the presence of someone else who used marijuana."
