베트남전에서, 미군이 뿌린 고엽제 때문에 병에 걸렸다며, 제조사를 상대로 소송을 낸 참전군인과, 가족 1만6579명 중 39명만이 배상을 받을 수 있는 길이 열렸다. 

피해자들이 소송을 제기한 지, 14년 만에 나온 법적 결론이다.  

대법원 민사3부(주심 이인복 대법관)는, 참전군인 1만6579명이 미국 고엽제 제조사 다우케미컬컴퍼니와, 몬산토컴퍼니 등을 상대로 제기한 손해배상 청구소송에서, “ ‘염소성 여드름’ 질병 피해자 중, 소멸시효가 지나지 않은 39명에 대해서만, 제조사의 배상 책임을 인정한다”고 밝혔다. 

대법원은 제조사에 대해, 피해자들에게 1인당 600만~1400만원, 총 4억6600만원을 배상하라고 판결했다. 

대법원은, “염소성 여드름은 고엽제에 함유된 다이옥신 성분에 노출될 경우에만 발병되는, 특이성 질환”이라고 밝혔다. 

법원이, 특정 질병과, 고엽제의 인과관계를 판결한 것은, 이번이 세계 최초다. 

미국에서도 미국과, 호주, 뉴질랜드 참전군인 24만명이 같은 소송을 냈지만, 판결로 가기 전, 1억8000만달러를 지급하는 ‘합의’로 끝났다.  

대법원은, “당뇨병, 폐암, 후두암, 전립선암, 다발성골수종 등 다른 질병은 발생원인이 복잡하고 유전이나, 체질 등 선천적 요인과, 음주와, 흡연, 직업적 환경 등 후천적 요인이 복합적으로 작용한다”며, “이 질병이 고엽제 때문이라고 단정할 증거가 없다”고 밝혔다. 

고엽제 피해소송은 참전군인과, 2세 1만6801명이, 1999년 5조원대 손해배상 청구소송을 제기하며 시작됐다. 

2002년 1심은, 원고 패소 판결을 내렸다. 

소송인단이 2만615명으로 늘어난, 2006년 2심에서는, 5227명이 고엽제와 관련이 있다는 판결이 나왔다.  

이날 대법원에는, 고엽제전우회 소속 참전군인 120여명이, 선고를 보러 왔다. 

고엽제전우회 김성욱 사무총장은, “이런 결론을 내려고 대법원이 7년이나 시간을 끌었다니 참담하다”며, “대법원이 대한민국 주권을 포기했다”고 말했다.  

미국 제조사 측은 이날, “미국 법원은 일관되게 고엽제 사용과 관련, 제조업자들에게 어떠한 책임도 없음을 확인했다”며, “39명의 피해도 인정할 수 없다”는 입장을 밝혔다. 

이들은 “베트남전에서 고엽제 사용과 관련된 문제는 한국과, 미국 정부 사이 적절한 방법으로 해결돼야 한다”고 말했다.

서울고법 민사19부(재판장 노태악 부장판사)는, 14일 베트남 참전군인 김모(71)씨 등이, "베트남 전쟁 중 살포된 고엽제에 노출돼 후유증을 겪고 있다"며, 고엽제 제조사인 미국 다우케미컬사와, 몬산토사를 상대로 낸 손해배상 소송 파기환송심(2013나47448)에서, 원고패소 판결했다.

이에 따라 소송을 낸 참전 군인과, 가족 1만6579명 가운데, 대법원에서 지난해 7월 일부 승소 판결을 받은 39명만이, 600만∼1400만원씩의 배상금을 받게 됐다.

재판부는, "고엽제 제조사들은 다이옥신 성분이 인체에 미칠 유해성을 철저히 검증하고, 안전성이 충분히 확보되기 전에는 이를 유통시키지 말아야 하는데도, 위험방지 조치를 제대로 취하지 않은 잘못이 있다"며, 제조물 결함을 인정했다.

그러나 대법원의 파기환송 취지대로, 염소성 여드름을 제외한 대부분의 질병에 대해서는, 고엽제와의 인과관계를 인정하지 않았다. 

고엽제 때문에 자녀들에게 말초신경병이 발병했다는 주장이나, 당뇨병, 폐암, 후두암, 전립선암, 다발성 골수종 등.. 다른 질병이 생겼다는 파병 장병들의 주장은, 받아들이지 않은 것이다.

재판부는, "이런 질병들의 경우 발생 원인이 복잡하고, 유전이나 체질 등 선천적 요인과 음주, 흡연, 직업적 환경 등 후천적 요인이 복합적으로 작용해 발병하기 때문에, 고엽제 때문이라고 단정할 수 없다"고 설명했다.

김씨 등 베트남전 참전군인들은, 지난 1999년 고엽제 제조사를 상대로, 5조원대의 손해배상 청구소송을 냈다. 

2002년 1심은 원고패소로 판결했지만, 2006년 항소심은 11개 질병에 대한 역학적 인과관계를 인정해, 5227명에게 600만원∼4600만원씩 배상하라고 판결했다.

그러나 지난해 대법원은, 39명을 제외한 나머지 피고들에 대해 인과관계를 인정할 수 없다고 판단하고, 사건을 서울고법으로 돌려보냈다. 

당시 대법원은, "비호지킨임파선암, 후두암 등은 발생원인이 복잡·다양하고, 선천적 요인과, 후천적 요인이 복합적으로 작용해 발생하는 '비특이성 질환'이므로, 

고엽제 노출로 인한 발병이라고 단정하기 어렵다"며, "고엽제에 함유된 다이옥신 성분에 노출될 경우 발병되는, '특이성 질환'인 염소성 여드름의 경우만, 인과관계가 인정된다"고 판시했다.

In Vietnam, the US soldiers suffered from defoliants, and only 39 out of a total of 16,579 families were allowed to be reimbursed for the war veterans who filed suit against the manufacturer.

In a lawsuit filed by the Supreme Court's Civil Division 3 (Judge Lee In-bok) against 10,659 veterans who filed a lawsuit against US agent Orange Company, Dow Chemical Company and Monsanto Company, "the victim of 'chlorotic acne' "We only accept the liability of the manufacturer for the 39 people who have not passed."

The Supreme Court has ordered the manufacturer to compensate the victims for 6 million to 14 million won per person, totaling 466 million won.

"Chlorine acne is a specific disease that only develops when exposed to dioxin components in defoliants," the Supreme Court said.

This is the first time that a court has ruled a causal relationship between a specific disease and a defoliant.

In the United States, 250,000 US, Australian, and New Zealand veterans alike filed the same lawsuits, but before the verdict came to an end, they reached an agreement of $ 180 million.

"The other causes of diseases such as diabetes, lung cancer, laryngeal cancer, prostate cancer and multiple myeloma are complex, and inherited factors such as heredity and physical constitution, as well as acquired factors such as drinking, smoking and occupational environment" , "There is no definite evidence that this disease is caused by Agent Orange."

In 1999, the company filed a lawsuit claiming damages of 5,000 trillion won.

In January 2002, the plaintiff ruled.

In the second trial in 2006, the number of litigation workers increased to 20 615, and 5227 people were found to be related to Agent Orange.

On the day of the Supreme Court, more than 120 war veterans who belonged to the Korean National Association of Anti-Terrorist Agents came to see the sentence.

"It is terrible that the Supreme Court has taken seven years to make such a conclusion," said Kim Sung-wook, secretary general of the National Association of Agent Education. "The Supreme Court has abandoned the sovereignty of the Republic of Korea."

"The US courts have consistently confirmed that manufacturers are not responsible for the use of defoliants," the US maker said in a statement.

"The problem with using Agent Orange in Vietnam should be solved in an appropriate way between Korea and the US government," they said.

In 2002, the Supreme Court ruled in favor of plaintiffs, but Appellate Court in 2006 approved the epidemiological causal relationship of 11 diseases, and ordered 5227 to pay between 6 million won and 46 million won.

Last year, however, the Supreme Court ruled that the accused could not be acknowledged for the defendants, except for 39, and sent the case back to the Seoul High Court.

At the time, the Supreme Court concluded that "non-Hodgkin's lymphoma and laryngeal cancer are complex and diverse in their causes, and are a nonspecific disease caused by a combination of inherited and acquired factors.
