사건명1 - 대한 민국 헌법 제29조 ② 군인·군무원·경찰 공무원 기타 법률이정하는 자가 전투·훈련등 직무 집행과 관련하여 받은 손해에 대하여는, 

법률이 정하는 보상외에 국가 또는 공공 단체에 공무원의 직무상 불법 행위로 인한 배상은 청구할 수 없다.

사건명2 - 국가 배상법 제2조(배상 책임) ① 국가나 지방 자치 단체는 공무원 또는 공무를 위탁 받은 사인(이하 "공무원"이라 한다)이 직무를 집행 하면서,

고의 또는 과실로 법령을 위반하여 타인에게 손해를 입히거나, 「자동차 손해 배상 보장법」에 따라 손해 배상의 책임이 있을 때에는 이 법에 따라 그 손해를 배상 하여야 한다. 

다만, 군인ㆍ군무원ㆍ경찰공무원 또는 예비군 대원이전투ㆍ훈련 등 직무 집행과 관련하여 전사(전사)ㆍ순직(순직)하거나 공상(공상)을 입은 경우에 본인이나,

 그 유족이 다른 법령에 따라 재해 보상금ㆍ유족연금ㆍ상이 연금 등의 보상을 지급 받을 수 있을 때에는 이 법 및 「민법」에 따른 손해 배상을 청구할 수 없다.
