앞으로는 조문객이 보낸 화환을 장례식장이 임의로 처분할 수 없게 된다. 또 외부 술이나 과일, 마른 안주와 같은 조리되지 않은 외부 음식을 장례식장에 반입하는 게 가능해진다. 공정거래위원회는 이 같은 내용을 담은 ‘장례식장 표준약관 개정 사항’을 25일 발표했다.

◇“화환은 유족 것” 장례식장 임의 처분 금지

기존에는 화환의 처리 방식이나 외부 음식 반입에 대한 명확한 규정이 없어 유족과 장례식장 사이에 종종 갈등이 빚어졌다. 특히 화환에 대한 국민신문고 접수 사례가 많았다. 지난 2024년 12월엔 한 장례식장의 화환업체가 ‘발인날 화환을 개당 1000원에 가져가겠다’고 요구했다가 유족이 동의하지 않자 장례식장에서 난동을 부렸다는 민원이 접수됐다. 2022년 7월엔 장례식장이 화환 수거를 자신들이 하겠다며 상주들을 압박한 뒤 화환을 특정 협력업체에 팔아넘겨 이익을 취했다는 민원도 있었다. 이에 공정위는 이번 표준약관 개정을 통해 조문객이 보낸 화환의 소유권은 유족에게 있다는 점을 명확히 하고, 장례식장은 유족의 협의가 있을 경우에만 화환을 처리할 수 있도록 했다.

◇과일·술 등 외부 음식 반입 가능

아울러 개정 표준약관은 과일·음료·주류 등 조리되지 않은 외부 음식물은 장례식장에 반입할 수 있게 명시적으로 허용했다. 과일은 자르거나 가공하지 않은 상태인 것만 가능하다. 포장되어 소비기한, 제조일자 등이 표기된 과자, 견과류, 마른안주 등도 반입할 수 있다. 반면 식중독 등 사고 예방을 위해 밥이나 국, 반찬, 육류, 떡 등과 같이 조리된 외부 음식은 원칙적으로 반입할 수 없다. 단, 사업자와 이용자가 사전에 협의한 경우에만 예외적으로 반입할 수 있다.

◇장례비용 사전 설명 의무화

한편 유족이 경황이 없는 틈을 타 장례업체가 비용을 부풀려 받지 못하게 하는 조항도 담겼다. 개정 표준약관은 장례비 구성 항목을 시설임대료, 장례 관련 수수료 , 장례용품비, 청소·관리비 등으로 구체화하고 업체가 계약 체결 전, 유족에게 내용을 설명하도록 명시했다. 지금까지는 장례식장에 가격표시가 제대로 되어 있지 않아 업체별 가격·서비스 내용을 충분히 비교하기 어려웠다. 또 장례식장이 최초 상담 때와 달리 사전 협의되지 않은 경비를 추가했다는 국민신문고 민원이 접수되기도 했다. 공정위는 “앞으로 장례비용을 구체적으로 사전 설명하는 것이 의무화되면 유족들이 명확히 확인한 후 장례식장을 선택할 수 있을 것으로 기대된다”고 했다.

From now on, funeral homes will no longer be able to arbitrarily dispose of wreaths sent by mourners. In response, the Fair Trade Commission clarified in the revised standard terms that ownership of wreaths sent by mourners lies with the bereaved family, and funeral homes can only handle the wreaths with the family’s consent.

◇ Permitted Import of External Food Items Such as Fruits and Alcohol

The revised standard terms explicitly allow the import of uncooked external food items, including fruits, beverages, and alcoholic drinks, into funeral homes. Fruits must be uncut and unprocessed. Packaged snacks, nuts, and dried side dishes with labeled expiration dates and manufacturing dates are also permissible. However, to prevent food poisoning, cooked external food items such as rice, soup, side dishes, meat, and rice cakes are generally prohibited. Exceptions may be made only if the business operator and the user have prior agreement.

◇ Mandatory Prior Explanation of Funeral Costs

The revised terms also include provisions to prevent funeral businesses from inflating costs during the bereaved family’s vulnerable state. The standard terms specify that funeral costs must be broken down into categories such as facility rental fees, funeral-related service fees, funeral supplies costs, and cleaning/management fees, and that businesses must explain these details to the bereaved family before signing a contract. Previously, funeral homes often lacked proper price displays, making it difficult to compare prices and services across businesses. Additionally, complaints were filed through the e-People petition portal about funeral homes adding unagreed-upon fees after the initial consultation. The Fair Trade Commission stated, “We expect that mandatory prior explanation of funeral costs will allow bereaved families to make informed decisions when selecting a funeral home.”
