There was a very important case before the Supreme Court today. You could argue everyone before the court is important, but the justices today heard arguments about whether the death penalty for juvenile killers is constitutional. Nineteen states allow capital punishment for 16-or 17-year-olds, and 74 juveniles are now on death row.
Christopher Simmons was 17 when he murdered Shirley Crook. He led detectives to the railroad trestle where he threw her off into a Missouri River to drown. The victim's daughter, Kim, believes he should have been executed.
"He cased the house out. He knew exactly what to do. He knew what he was doing."
The jury agree. But an appeals court threw out the death sentence, saying the execution of juvenile killers is cruel and unusual punishment.
"He was trying to beat the system. He knew what he was doing. He planned to do it. He carried it through and he bragged about it."
Today, a deeply divided Supreme Court wrestling with the question of whether states should execute juvenile killers. Justice Ginsberg wondered why those under eighteen should be death-eligible when they are eligible to vote.
"We cannot impose capital punishment on offenders who do not demonstrate the same degree of adult blame-worthiness, adult culpability, mature judgement, as adult offenders do."
The United States is the only democracy in the world that still executes juvenile offenders. Justice Kennedy said that the opinion of the rest of the world is vehemently against executing juveniles. Yet, Justice Scalia said that the United States should not yield to the views of the rest of the world.
"Any 17- or 16-year-old has absolute knowledge that it is wrong to rape, rob and murder."
Christopher Simmons has been on and off death row for 11 years. The fate of dozens of juvenile offenders on death row will be known when the court rules next year.
