New York hasn't had an excution in 60 years, but last month it was on the table, when Sayfullo Saipov was convicted of intentionally driving a truck down the Hudson river path, mowing down bicyclists. The same jury that found him guilty will decide if he is put to death or spends the rest of his life in prison. While New York doesn't have capital punishment, Saipov's trial is in federal court, which does.
