미국 대법관 안토닌 스칼리아의 죽음과 이후 향방

미국의 대법관 안토닌 스칼리아가 지난주에 그의 텍사스 목장에서 죽었습니다.

사망원인은 밝혀지지 않았으나 자연사라고 합니다.79세

그런데 그는 동성결혼이나 낙태등에 반대하는 강경 보수파 대법관으로 알려졌습니다.

그러한 그가 죽음으로서 이제 그 후임을 임명할 권한을 가진 오바마가 그 후임을 임명할수 

있을 것인가? 에 사람들은 관심을 갖고 있습니다. 공화당은 그의 후임 인선과 인준 과정을

끝가지 물고 늘어져서 현 대통령 임기내에는 실행할 수 없게 한다는 것이 목표입니다.

이제 340 일 정도 남은 임기중에 오바마가 과연 대법관을 인준 통과시킬 수 있을지

여부가 관심사인데 오바마는 당연히 자기 입맛에 맞는 사람을 인준 통과시키려 할 것입니다.

최근에 미국 대법원에서는 오바마가 의회의 의결을 거쳐서 공표해야할 법을 대통령의 행정명령으로 

만들어서 헌법을 유린했다는 비판과 제소에 대해 가부 동수 판결이 있었는데

대법원장이 캐스팅 보트로 그 판결을 부결시켰습니다.

오바마는 분명히 월권행위를 하고 있다는 비판이 끊이지 않고 있습니다.

금년에 주목할 사안으로 스칼리아 후임 대법관을 과연 오바마가 임명할수 있을지

여부가 될 것입니다.

A story has emerged today that has stunned everyone.

Supreme Court Associate Justice Antonin Scalia was found dead this morning of supposed natural causes, after attending a party at a ranch near Marfa, Texas.

Scalia was 79 years of age.

Scalia, who was inarguably one of the most conservative of Justices, was appointed in 1986 by President Ronald Reagan.

Now, the implications of Scalia's death has the political world in an uproar due to the current balance of the present bench and the possibilities with regard to whom Obama may choose to appoint, skewing the court towards a position much farther to the left, than present.

Some patriotic Americans have already reacted with quick despondence:

- "We just lost the Supreme Court. Liberal agenda will be in full swing now."

-"America is SCREWED!"

Meanwhile, others are already questioning the, so far, vague details released concerning how Scalia may have died, with the stated cause being listed as "natural."

No doubt, with the small amount of information coming out thus far, speculation will naturally flow towards the conspiratorial, and for good reason, in that the Obama regime has proven itself well beneath trustworthy and notably opaque in virtually all things.

Moreover, the current justices have already left a notable footprint on America, delivering judgments unexpected of a court supposedly tilted towards the right, especially after decisions allowing nationalized healthcare and gay marriage.

Now, the battle will move towards the approval of Obama's SCOTUS candidate by a notably weak GOP majority Senate led by Moderate Republican Mitch McConnell, who recently indicated an eager willingness to work with Obama, no matter the issue, for the stated purpose of not upsetting the upcoming 2016 presidential election, for the GOP's candidate.

"Associate Justice Antonin Scalia was found dead of apparent natural causes Saturday on a luxury resort in West Texas, federal officials said.

Scalia, 79, was a guest at the Cibolo Creek Ranch, a resort in the Big Bend region south of Marfa.

According to a report, Scalia arrived at the ranch on Friday and attended a private party with about 40 people. When he did not appear for breakfast, a person associated with the ranch went to his room and found a body.

My mole in the White House tells me Obama will nominate 46-year-old Judge Sri Srinivasan, an Indian-American jurist who Obama nominated in 2013 to the U.S. Court of Appeals for the D.C. Circuit -- and the Senate confirmed unanimously. Having confirmed him unanimously just three years ago, it would be difficult (but hardly impossible) for Republicans to oppose him now. (Twelve former Solicitors General, including Republican notables as Paul Clement and Kenneth Starr had endorsed his confirmation. Moreover, the D.C. Circuit has long been a Supreme Court farm team – Scalia himself, along with John Roberts, Clarence Thomas, and Ruth Bader Ginsburg were judges there before ascending to the Supreme Court.)

But is Srinivasan progressive? He had been Obama’s principal Deputy Solicitor General before the nomination, arguing Supreme Court cases in support of affirmative action and against Indiana’s restrictive voter ID law, for example. But this record doesn’t prove much. (Having once worked as an assistant Solicitor General, I know the inhabitants of that office will argue whatever halfway respectable arguments the Justice Department and, indirectly, the President, wants made.)

Before the Obama administration, Srinivasan worked for five years in George W. Bush’s Justice Department. Prior to that, as an attorney in the private firm of O'Melveny & Myers, he defended Exxon Mobil in a lawsuit brought by Indonesians who accused the company’s security forces of torture, murder, and other violations against their people; successfully represented a newspaper that fired its employees for unionizing; and defended Enron’s former CEO, Jeffrey Skilling, later convicted for financial fraud. But in these instances, too, it could be argued he was just representing clients. Another clue: After graduating Stanford Law School in 1995, Srinivasan clerked for two Republican-appointed jurists – Judge J. Harvie Wilkinson III, and Supreme Court Justice Sandra Day O'Connor – both of whom were considered moderate.

Since he became a judge on the D.C. Circuit, he hasn’t tipped his hand. But I discovered one morsel of information that might interest you: In 2000, he worked on Al Gore’s legal team in the infamous Supreme Court case of “Bush v. Gore.”

My suspicion is Obama couldn't do better than Srinivasan. No other nominee with get a majority of Senate votes. What do you think?

이 사람에 대해서는 공화당에서도 반대하기 어려울 것이라는 말이 있습니다.

일종의 음모설인데, 그 목장의 주인이 민주당원이면서 오바마와 친한 사이라고 합니다.

정상이면 살인하고도 멀쩡하게 다니는게 가능하지 않을 것 같은데요....하긴 죄가 형성될때에는 이미 다 알고도 태연하게 저질러지게 되는 경우가 대부분이지만요. 오바마가 물러나면 약간 진행이 느려질런지 모르겠습니다....그리고 이런 류의 성경적 큰 틀 안에서의 정치음모론이 항상 미국 중심이라는 것에 심기가 편치 않아집니다. 본디 미국도 마지막을 달려가는 시나리오의 한 덩어리일 뿐인데 미국의 상황이 성경예언의 핵심인 것처럼 비춰지고 (느끼려하고) 그렇게 이해하려고 하는 사람들이 많기 때문입니다.

음모설의 가능성이 주요 뉴스로 올라오고 있습니다. 그러나 재빨리 가족들이 부검을 원치 않았다면서 재빨리 화장해버린 것같습니다.
건강했고, 걸어갈 수 있었는데 심장마비로 죽었다고 합니다. 부검없이 어떻게 심장마비라는 결론을 내릴 수 있는가? 와 무엇이 심장마비를 유발했는가? 에 대한 해명이 없습니다.
이미 워싱턴의 살인 전담 수사국장이었던 사람이 이에 대한 이의를 제기하고 나섰습니다.
오바마는 미국 의회가 휴회로 들어가는 틈을 타서 후임을 임명하리라고 하는데 그 이유는 대통령 비상 특권으로 공화당의 반대를 무릅쓰고, 진보파를 세우기 위함이라 합니다. 죽은 사람은 동성애, 낙태, 등에 반대해온 사람이었습니다

대법관이 갑자기 죽었는데 부검도 없이 화장까지 해버렸으니 사인을 찾아 낼수 있을지 모르겠습니다

화장을 했는지에 대해서는 확인이 안되고 있습니다. 왜냐하면 일부에서는 지금도 부검 요구가 있기 때문입니다. 그런데 스칼리아와 오바마가 죽기 몇시간전에 만났다는 보도가 나오고 있습니다. 집에 가서 그 기사를 올리고 싶습니다.

스칼리아의 장례식이 어제 오전에 있었습니다. 화장한 것은 아니고 더 이상 부검할 수도 없었기 때문에 그냥 진행된 것으로 보입니다.
한편으로 텍사스 주지사는 그 사건에 대해 진상을 조사하도록 명하였습니다. 아마 무언가 잘못 처리한것이라도 지적하려는 것같습니다. 모든 진실은 하나님께 맡겨져야 할 것입니다.
이 사건을 통해서 다시 한번 확인하는 것은 스칼리아 대법관이 천주교 신자였기 때문에, 천주교 신자들중에도 정의 지향적인 사람들이 있다는 것을 인정해주어야 할 것으로 보입니다. 히틀러에 저항했던 사람들중에 카톨릭 신자들이 있었고 그들은 처형되었습니다. 따라서 선의의 카톨릭 신자들도 인정해주어야 할 것입니다.

사망판정을 한 여자는 신데렐라 게바라라는 판사였는데 멀리서 휴대전화로 통화하다가 끊어져서 다시 20분후에 전화받고

사망으로 판정한 것같습니다. 판사가 휴대폰으로 심장마비에 의한 사망으로 단정할 수 있는 미국이 되었습니다.

목장 주인 존 포인덱스터의 목장은 3만 에이커 (약 120 평방 킬로미터) 이고 그 집을 과거에 다녀간 사람들중에는 줄리아 로버트 등 헐리웃 인사들과, 저명인사들이 많으며 주인은 다른 사업을 하고 있다고 합니다. 1박에 545달러 내지 565 달러를 받는다고 하며, 스칼리아 대법관은 그날에 아들과 함께 왔다가(혹은 오려하였다가) 어떤 이유인지 아들은 빠졌다고 합니다.(drop out). 스칼리아 대법관은 과거에 한번만 포인덱스터를 만난적이 있고, 그 목장에도 과거에 한번만 온적이 있었는것으로 보입니다. 그가 죽었음을 발견한 사람은 포인덱스터이었고, 그의 얼굴위에는 베개가 덮여 있었다고 합니다.

자기집도아니고 병원도 아닌 곳에서 갑자기 죽은 사람에 대해서 부검도 없이 그냥 보안관이 심장마비인듯하다고 하자 지역 법관이 심장마비사로 판정해버린 사건으로 보입니다.
오바마는 그의 장례식에 참석하지 않기로 했으며 그의 후임에 인도계 판사를 지명할 가능성이 높다고 합니다.
스칼리아는 동성애와 동성결혼에 대하여 대법원이 판결할 것이 아니라 국민이 결정할 문제로 돌렸으며 낙태에 반대해온 것으로 알려졌습니다. 반면 인도계 판사는 동성애 지지자로 알려졌습니다.
