6. 공기연장 [2] (Under FIDIC)

Sub-Clause 8.5에 규정되어 있으며, AIA와 마찬가지로 Claim 절차조항(Sub-Clause 20.2)이 적용되도록 하고 있고, 아래의 경우에 공기연장이 가능한 것으로 하고 있습니다.
(a) a Variation (except that there shall be no requirement to comply with Sub-Clause 20.2 [Claims for Payment and/or EOT];
(b) a cause of delay giving an entitlement to EOT under Sub-Clause of these Conditions;
(c) exceptionally adverse climatic conditions, which for the purpose of these Conditions shall mean adverse climatic conditions at the Site which are Unforeseeable having regard to climatic data made available by the Employer under Sub-Clause 2.5 [Site Data and Items of Reference] and/or climatic data published in the Country for the geographical location of the Site;
(d) Unforeseeable shortages in the availability of personnel or Goods (or Employer-Supplied Materials, if any) caused by epidemic or governmental actions; or
(e) any delay impediment or prevention caused by or attributable to the Employer, the Employer’s Personnel, or the Employer’s other contractors on the site.

AIA와 FIDIC이 다른 점은, AIA는 조항 자체에 적용 가능한 사유들이 특정되고 있는 반면에, FIDIC은, 위 (b)항에서 알 수 있듯이 계약조건에 산재해 있는 각각의 조항들을 통해 연장권리 인정 여부가 확인되도록 하고 있다는 것입니다.

아울러 FIDIC은 BOQ에 포함된 작업항목의 물량이 10% 이상 증가한 경우에도 공기연장이 가능할 수 있도록 하고 있는데, 이는 AIA에는 없는 내용입니다. 공기연장시 지연분석은 필수적인 사항이고 따라서 물량변경으로 인한 영향분석도 당연히 수행되어야 함을 고려할 때, 특정 % 이상의 물량변경인 경우에만 공기연장을 허용하는것에 대한 논쟁을 피할 수 없을 것으로 판단됩니다.
FIDIC은 2017년 개정판을 통해 concurrent delay를 언급하고 있는데, 구체적인 절차나 분석 방법이 누락되어, 실질적인 의미를 갖지는 못하는 것으로 이해됩니다. AIA에도 concurrent delay에 대한 언급이 없는데, 이 역시 지연분석 과정에서 다루어 질 수 있는 문제로 인식하고 있는 것이 아닌가 합니다.
