‘파이어릿 베이’ 공동창업자 캄보디아서 체포
저작권 위반 혐의…스웨덴 송환될듯

이름난 파일공유 사이트 ‘파이어릿 베이’의 공동 창업자인 곳프리드 스바르트홀름 바리(27·사진)가 저작권법 위반 혐의로 캄보디아 프놈펜에서 체포됐다. <월스트리트저널> 등은 지난 2일 “캄보디아 경찰이 스웨덴 정부와 공조해 곳프리드를 체포했다”며 “조만간 스웨덴 본국으로 송환될 것”이라고 보도했다.
곳프리드는 지난 2009년 동업자 3명과 함께 스웨덴에서 징역 1년형의 유죄 판결을 받았으나 항소심 직전 출국해 인터폴의 수배명단에 올라 있었다.
전세계 3천만명이 이용하고 있는 파이어릿 베이는 지난 2003년 창립 이후 영화협회, 음반회사 등과 끊임없이 갈등을 빚어왔다.
유죄 판결 이후 파이어릿 베이는 “인터넷 공간을 침묵시키려 한다”며 음반회사를 고소했고, 차단된 사이트를 뚫을 방법을 찾으라고 누리꾼들에게 촉구했다. 파이어릿 베이는 한때 서버를 안전한 곳에 두기 위해 섬들을 사들일 계획도 세웠지만 실행에 옮기진 못했다.
곳프리드의 체포로 저작물 보호 논쟁이 재점화될 것으로 보인다. 노벨문학상 수상 작가인 브라질의 파울로 코엘료는 “파이어릿 베이는 새로운 사고의 전환을 보여줬다”고 주장한 바 있다. 반면 전설적인 팝그룹 ‘아바’의 멤버인 비요른 울바에우스는 “합법적으로 파일을 내려받는 것보다 훔치는 것이 더 싸고 편하겠지만, 정당한 대가를 치르는 것이 그렇게 어려운 일이냐”고 비판했다.

A Swedish national and co-founder of file-sharing website Pirate Bay, the self-touted “world’s largest bittorrent tracker”, was arrested in Phnom Penh on Thursday, police said yesterday.
Cambodian police arrested Gottfrid Svartholm Warg, 27, who was convicted by a Swedish court of illegal file-sharing in 2009, under an international arrest warrant that originated from the Swedish government, National Police Commissioner spokesman Kirt Chantharith told the Post yesterday.
After Warg failed to attend an appeal hearing for himself and Pirate Bay’s three other convicted co-founders, his one-year sentence was upheld and an international warrant for his arrest put out in late 2010, according to news agency AFP.
“I don’t know exactly the crimes he committed,” Chantharith said. “He is now being held in Cambodia as we wait to verify this with the documents that the Swedish authority is sending us. Then we will consider whether to send him back, according to legal procedure.”
Sweden’s Ministry for Foreign Affairs confirmed a Swedish national’s arrest in Cambodia’s capital based on an international order for arrest that originated in Sweden.
“He has a sentence in Sweden for spreading material like films and music that is legally protected from others and which he doesn’t own himself,” Anders Jörle, head of the ministry’s press office, told the Post yesterday.
“The embassy has visited him since the arrest and he is alright,” the press office’s Camilla Akesson Lindblom said.
The press office was unable to confirm that the documents sent from Sweden included an extradition request for the “about 30-year-old” man.
But, like now-returned French architect Patrick Devillers before his “voluntary” departure from Cambodia to China to give evidence in the Bo Xilai case, Warg is being held in the Immigration Department of the Ministry of Interior, which has 60 days to process the documents from Sweden and potentially approve Warg’s extradition, Chantharith said.
According to lawyer Sok Sam Oeun, executive director of the Cambodian Defenders Project, the absence of a formal extradition treaty between Cambodia’s and Sweden’s governments means that if it is the Swedish government requesting extradition, the final decision to extradite is with the Cambodian government.
Warg could appeal the government’s extradition decision to the Phnom Penh Municipal Court, Sam Oeun said, but added that he had never seen an extradition case go to a Cambodian court.
Pirate Bay’s co-founders have maintained that their site, which is still active, can be used for legal purposes.
