Garratt v. Dailey---- 46 Wash. 2d 197, 279 P.2d 1091 (1955)
Fact
A five-year-old boy was visiting the plaintiff(P). In the backyard, the boy moved a chair as P started to sit on it, causing her a fractured hip and other injuries. Naomi Garratt, who is P’s sister, was the eyewitness of P and testified that the defendant(D) had pulled out the chair from under P when she was sitting down. However, the trial court accepted D's version of the facts that D moved the chair without recognizing P trying to sit on it and attempted to move it back toward right away when he noticed P but failed, because he was too young and small. P appealed.
Issue
Whether D knew with substantial certainty that P would fall when he moved the chair from beneath her.
Rule
1 Restatement, Torts, 29, § 13.
"An act which, directly or indirectly, is the legal cause of harmful contact with another's person makes the actor liable to the other, if
"(a) the act is done with the intention of bringing about a harmful or offensive contact or an apprehension thereof to the other or a third person.
Prosser on Torts 41, § 8.
"Character of actor's intention. In order that an act may be done with the intention of bringing about a harmful or offensive contact or an apprehension thereof to a particular person, either the other or a third person, the act must be done for the purpose of causing the contact or apprehension or with knowledge on the part of the actor that such contact or apprehension is substantially certain to be produced."
Application
Here, the trial court admitted that Brian had no intention of causing apprehension or battery. However, to decide whether D had an intention, his act must be done for the purpose of pulling the chair out from P with knowledge that P’s falling is substantially certain to occur. Even though D doesn’t have any intent to commit an assault or a battery on her, if he was substantially certain that P's body will contact the ground at the time he pulled the chair, he is liable for P because his intent could be inferred therefrom. Therefore, to decide whether D is liable or not, the court should determine whether D was substantially certain of P's fall beforehand.
Conclusion
The judgement was reserved and the case was remanded for clarification.

이 사건은 bench trial이라서 사실판단을 jury가 아닌 판사가 했다.
torts와 criminal에서는 팩트 분석이 핵심이다.
substantial certainty는 이 사건의 핵심이지만 그걸로 충분하지 않다. 그건 결과일 뿐이다.

그러나 Statue가 힘이 있다고 해도 모든 사건에 일괄적으로 적용되지는 않기 때문에 그 갭을 채우기 위해 Cases가 존재한다.
secondary authority라고 해도 판사가 인용하는 이상 그 판례에서는 primary authority가 된다.
restatement는 binding authority가 아니다
하지만 어떤 주에서 의회를 통해 주법으로 인정되면, statue가 된다.
