Palsgraf v. Long Island R.R.--- 248 N.Y. 339, 162 N.E. 99 (1928)
Fact
A passenger was rushing to board a train when it was just about to depart. A guard of the train station tried to help him to board the train by grabbing his arm and mistakenly dropped the passenger's package onto the ground. The package included fireworks wrapped in a newspaper and it exploded. The explosion broke some scales, and the wreckage from it hit the plaintiff(P), who was standing at the end of the other platform, caused injury. P sued the Long Island Rail company.
Issue
The issue is whether the guard has a duty to prevent the danger for P at the opposite end of the platform when newspaper-wrapped parcel exploded while he was helping a passenger boarding the departing train.
Rule
-Duty
McSHERRY, C. J., in W. Va. Central R. Co. v. State, 96 Md. 652, 666
“In every instance, before negligence can be predicated of a given act, back of the act must be sought and found a duty to the individual complaining.”
-Foreseeability
Munsey v. Webb, 231 U. S. 150, 156
“The possibility of an accident must be clear to the ordinarily prudent eye.”
-Causation
Smith v. London & Southwestern Ry. Co., [1870-71] 6 C. P. 14
“The act being wrongful the doer was liable for its proximate results.”
Application
Here, D couldn't foresee the danger to P because the distance between P and the explosion was so big as to entitle her to the invasion of her interest. Also, it was little way for the guard to perceive the danger of the newspaper-wrapped parcel to the eye of ordinary vigilance. Therefore, relative to her, the guard was not negligent at all.
For dissenting, the guard’s act itself was wrongful even to P who was not within the radius of danger because due care is a duty imposed on everyone to protect the public. Although it was not a natural result of his act, the guard's act which included possibility of harm did in fact injure P. It was a proximate result because except for the explosion, she would not have been injured. Therefore, according to Andrew’s view, the guard may be liable to P with P's original and primary action.
Conclusion
Reversed.

원고가 자신의 권리로 소송을 진행하였고, 원고인 palsgraf는 안전할 권리가 있지만 own right of action은 없다.
-정리
<Negligence>
1. Duty of care
2. Breach of duty
3. Causation (foreseeability)
4. Result
(The risk reasonably to be perceived defines the duty to be obeyed.)
따라서, "The risk reasonably to be perceived defines the duty to be obeyed."
>> Rule: A defendant owes a duty only to those plaintiffs who are within the reasonably foreseeable zone of danger.
