Fact
The Plaintiff(P) was injured while assembling an electrical control panel on a platform more than ten feet above a concrete floor. The defendant(D) had not been informed about P's working site and built the panel with two iron cross-members, which were temporarily welded, and not secured permanently. Murray worked in dangerous condition and fell to the concrete floor when the temporarily welded cross-member gave way. Because of the spinal nerve damage from the accident, Murray is incontinent and sexually dysfunctional. Murray sued D under strict liability and D asserted P's assumption of risk as a defense. The verdict entered for P to $2,000,000 but with five percent fault attributable to Murray, it reduced to $1,747,000. D appealed.

Here, D’s product was defective because the cross-member was only temporarily welded. At the same time, P also contributed to the accident because he knowingly performed his job in a dangerous condition. In a strict liability action, D's negligence is not a required element of liability, and the product defect of D is not comparable to P’s faulty conduct. However, the court may consider responsibility based on the casual contribution of both the product defect and P's fault in allocating the loss. Therefore, it is appropriate to consider Murray’s conduct in allocating the damage and reduce his recovery.
