Fact
A police officer, Nuccio, shot and killed a youth named Nelson. Nelson's family filed a civil action against Nuccio, and retained Elmer Gertz, the petitioner, to represent them. American Opinion, a monthly magazine company published an article stating that Nuccio's prosecution was part of the Communist campaign against the police. As counsel for the Nelson family, Gertz attended the coroner's inquest and initiated actions for damages. American Opinion portrayed him as a Communist in their magazine and labeled him a "Leninist" and a "Communist-fronter". The article stated that petitioner had been an official of the Marxist League for Industrial Democracy, which was false. Gertz filed a defamation lawsuit. The District Courts entered judgement for the respondents and the Court of Appeals affirmed. Gertz petitioned the Supreme Court.
