[앵커]

이른바 '법왜곡죄'가 더불어민주당이 추진 중인 '사법개혁 3법' 가운데 처음으로 국회 문턱을 넘어섰습니다.

민주당은 이어 '재판소원제' 법안을 상정했고, 7박8일 필리버스터 정국이 이어지고 있습니다.

조한대 기자입니다.

<우원식 / 국회의장> "재석 170인 중 찬성 163인, 반대 3인, 기권 4인으로써 형법 일부 개정법률안 대안에 대한 수정안은 가결되었음을 선포합니다."

판사·검사가 의도적으로 법리를 왜곡하면 10년 이하 징역 또는 자격정지에 처하는 '법 왜곡죄'가 본회의 문턱을 넘었습니다.

만 하루 동안 무제한 토론, 필리버스터가 벌어졌지만, 국민의힘 의원들이 불참한 가운데 민주당이 강행 처리에 나섰습니다.

앞서 민주당은 위헌 논란을 불식시키기 위해, 당·정·청 합의를 거쳐 적용 대상을 '형사 사건'에 한정하고, 법 왜곡 행위를 규정하는 조문도 구체화시킨 수정안을 상정했습니다.

당내 강경파들은 반발하며 재수정을 요구했지만, 지도부는 이를 일축했습니다.

<김현정 / 더불어민주당 원내대변인> "의총을 통해서 당론으로 채택이 된 것이고 그렇게 본회의에서 보고도 되고 필리버스터까지 하는 과정이기 때문에 현실적으로 가능하지는 않습니다."

국민의힘은 사법부를 장악하려는 '사법파괴법'이라며 위헌적 시도라고 날을 세웠습니다.

<이만희 / 국민의힘 의원> "자신의 판결이 수사의 대상이 되지 않을까 고민하게 만드는 자기 검열의 감옥에 갇히게 됩니다. 이는 법관의 소신 있는 재판을 저해하고 사법권 행사를 심각하게 위축시키는 명백한 위헌적 발상입니다."

민주당은 법 왜곡죄 다음 안건으로는 역시 사법개혁 3법 가운데 하나인 '재판소원제' 법안을 상정했습니다.

해당 법안은 대법원 상고심 등으로 확정된 법원 판결이 헌재 결정에 반하거나 기본권 침해 소지가 있을 때 헌법소원을 허용하는 게 핵심입니다.

이에 야당은 사실상 '4심제'라고 비판하며 필리버스터에 나섰습니다.

SEOUL, Feb. 26 (Yonhap) -- The National Assembly, led by the ruling Democratic Party (DP), passed a controversial judicial reform bill to introduce a new crime of "legal distortion" on Thursday after the opposition's 24-hour filibuster expired.

The legislation, one of three judicial reform bills pushed by the DP, seeks to punish judges or prosecutors with a maximum prison term of 10 years if they intentionally distort legal principles or manipulate facts.

The bill was passed during a plenary session Thursday, a day after the main opposition People Power Party launched a filibuster to stall the procedure, denouncing the DP-led judicial reform bills as "malicious legislation" aimed at shielding President Lee Jae Myung.

The original version of the bill had already passed the National Assembly's legislation and judiciary committee, but the DP submitted a revised draft of the bill to the Assembly on Wednesday amid constitutional concerns raised from both within and outside the ruling party.
​
The revised bill limits the scope of judicial distortion to judges and prosecutors involved in criminal trials, and clarifies provisions defining acts that constitute as judicial distortion.
​
The amendment also includes provisions that outlaw spying not only for "enemy countries" but for all "foreign countries or equivalent groups."
​
The DP plans to introduce the other two remaining judiciary reform bills, which seek to allow constitutional appeals of court rulings and increase the number of Supreme Court justices from the current 14 to 26.
