조은석 특별검사팀이 12·3 비상계엄에 관여한 혐의(내란 중요임무종사)로 불구속 재판을 받고 있는 김현태 전 특전사 707특수임무단장을 구속해달라고 법원에 요청했다.

특검은 전날 서울중앙지법 형사37-2부(재판장 오창섭)에 김 전 단장 구속이 필요하다는 의견서를 제출했다고 19일 밝혔다.

김 전 단장은 2024년 12월 3일 비상계엄이 선포된 후 대기 중이던 병력 95명과 함께 국회로 출동했다. 검찰 특별수사본부는 작년 2월 김 전 단장을 불구속 기소했다.

특검은 “당시에는 김 전 단장이 현역 군인이었고, 계엄 직후 기자회견을 자청해 본인이 모든 책임을 지겠다고 하는 등 실체 규명에 협조하는 듯한 태도를 보인 점이 고려됐다”면서 “그러나 기소된 후 이전과 전혀 다른 태도로 범행을 부인하고, 파면돼 민간인이 된 현재는 핵심 공범인 김용현 전 국방부 장관을 접견하고 중요 증인들을 회유·압박하는 등의 증거인멸 행위를 반복하고 있다”고 했다.

특검은 김 전 단장이 오히려 계엄군을 저지한 국민을 상대로 고발을 제기하고, 유튜브 방송이나 집회 등에 참여해 비상계엄은 정당했다는 주장을 하고 있다는 점도 언급했다. 특검은 “김 전 단장은 현재 도망 및 증거인멸 염려가 매우 높다고 평가할 수 있는 현저한 사정 변경이 있어 재판부에 피고인에 대한 구속 재판을 요청했다”고 했다.

법원은 이날 김 전 단장과 이상현 전 제1공수특전여단장(준장), 김대우 전 방첩사 수사단장(준장), 고동희 전 정보사 계획처장(대령), 김봉규 전 정보사 중앙신문단장(대령), 정성욱 전 정보사 100여단 2사업단장(대령) 등 6명의 내란 중요 임무 종사 혐의 사건 1심 공판준비기일을 열었다. 이들은 현역 시절 기소돼 군사법원에서 재판을 받다가, 국방부 징계로 파면되면서 민간인 신분이 되면서 지난달 초 서울중앙지법으로 재판 관할이 변경됐다.

재판부는 내달 16일 첫 정식 공판을 열기로 했다. 내란전담재판부법에 따라 재판은 녹화 중계된다.

Special Prosecutor Cho Eun-suk’s team requested the court to detain former Commander Kim Hyun-tae of the 707th Special Missions Group, Special Forces Command, who is standing trial without detention on charges of involvement in the December 3 emergency martial law (insurrection important mission engagement).

The special counsel submitted an opinion to the Seoul Central District Court’s Criminal Division 37-2 (Judge Oh Chang-seop) on the previous day, stating the necessity of detaining the former commander, and disclosed this on the 19th.

The special counsel added, “The former commander currently shows significant circumstances indicating a high risk of fleeing or destroying evidence, so we requested the court to detain the defendant.”

The court held a pre-trial preparation hearing for the first trial of six individuals, including the former commander, former 1st Special Forces Brigade Commander Lee Sang-hyun (Brigadier General), former Defense Counterintelligence Command Investigation Unit Commander Kim Dae-woo (Brigadier General), former Defense Security Command Planning Director Go Dong-hee (Colonel), former Defense Security Command Central News Unit Commander Kim Bong-gyu (Colonel), and former Defense Security Command 100th Brigade 2nd Business Unit Commander Jeong Seong-wook (Colonel), on charges of insurrection important mission engagement. They were tried in military court while active-duty but had their trial jurisdiction transferred to Seoul Central District Court in early last month after being dismissed through disciplinary action by the Ministry of National Defense.
The court decided to hold the first formal trial on the 16th of next month. The trial will be broadcast via recording in accordance with the law establishing a dedicated tribunal for insurrection cases.
