더불어민주당이 28일 미국 정치권이 쿠팡의 개인정보 유출 수사를 두고 우리 정부에 문제를 제기한 데 대해 “사법 주권 침해”라고 일제히 비판했다. 이날 민주당과 진보야당 소속 의원 90명은 주한미국대사관에 항의서한을 발송한다.

한정애 민주당 정책위의장은 이날 원내대책회의에서 “미국 기업 쿠팡에 대한 차별적 규제를 중단해달라는 (미국 공화당 의원 모임의)서한에 대해 한 말씀 드린다”며 “서한은 애플, 쿠팡, 구글, 메타를 차별받는 피해 기업으로 나열하고 있는데 이 기업들이 한국에서 받은 규제는 차별이 아니라 법 위반에 대한 동등한 적용이었다”고 했다.

미국 연방 하원 공화당 의원 모임인 ‘공화당 연구위원회’(RSC) 소속 의원 54명은 지난 21일(현지시각) 한국에서 사업하는 미국 기업들에 대한 차별적인 규제를 즉각 중단해달라는 내용의 서한을 강경화 주미대사에게 보낸 바 있다. 해당 서한에는 김범석 쿠팡아이엔씨(Inc) 의장의 신변 안전 문제와 한미 외교·안보 협력을 연계한 내용이 담긴 것으로 알려졌다.

On the 21st (local time), 54 members of the Republican Research Committee (RSC), a group of Republican lawmakers in the U.S. House of Representatives, sent a letter to Ambassador Kang Kyung-wha asking for an immediate end to discriminatory regulations on U.S. companies doing business in Korea. 한정애 의장은 “서한을 보낸 공화당 의원들의 주장은 미국 기업은 외국에서도 자국법보다 느슨한 기준을 적용받아야 한다는 논리에 귀결된다”며 “이는 법치주의, 주권 평등, 한미자유무역협정(FTA) 정신에 모두 위배된다”고 했다. 그는 “한국 정부가 자국민의 개인정보를 보호하고 법을 위반한 기업을 조사하고 수사하는 건 주권국가의 정당한 권리”라고 강조했다.

"The Republican lawmakers' argument in the letter comes down to the logic that U.S. companies should be subject to looser standards than their own laws even in foreign countries," Han said. "This is a violation of the rule of law, equality of sovereignty, and the spirit of the Korea-U.S. Free Trade Agreement." He stressed that it is the legitimate right of a sovereign country for the Korean government to protect the personal information of its citizens and to investigate and investigate companies that violate the law.

원내부대표단인 이용우 의원도 “만일 쿠팡이 단지 미국 기업이라는 이유만으로 우리의 정당한 법적 제재 대상에서 벗어나야 한다고 주장한다면 그것은 심각한 특혜를 요구하는 것일 뿐”이라며 “미국 하원의원 일부의 행태는 엄연한 내정간섭이자 동맹 간의 상호 신뢰와 존중을 훼손하는 행위로 강한 유감을 표한다”고 했다.

Representative Lee Yong-woo, a deputy floor leader, also said, "If Coupang insists that it should be excluded from our legitimate legal sanctions just because it is a U.S. company, it is only asking for serious preferential treatment," adding, "The behavior of some U.S. House members is a serious interference in domestic affairs and a violation of mutual trust and respect between allies."

이날 민주당과 조국혁신당, 진보당, 사회민주당 소속 의원들은 국회 소통관에서 기자회견을 열고 미국 공화당 하원의원들이 한국 정부에 쿠팡 등 미국기업 탄압을 중단하라는 서한을 보낸 것과 관련해 주한미국대사관에 항의서한을 발송한다고 밝혔다.

이들은 기자회견문에서 “범죄 혐의에 대한 수사와 처벌은 주권국가의 고유 권한”이라며 “외국 정부가 특정 개인에 대해 수사와 법 집행을 하지 말 것을 요구하는 것은 국제 규범과 법치주의에 정면으로 반하는 행위”라고 했다. 이들이 마련한 ‘미국의 사법주권 침해 항의서한 연명’에는 민주당과 진보야당 소속 의원 90명이 이름을 올렸다.

미국 정부가 쿠팡의 개인정보 유출에 대한 수사와 행정제재 수위 등을 두고 우리 정부에 항의한 데 대해 더불어민주당 의원들이 주한미국대사관에 단체 항의 서한을 보낼 예정인 것으로 27일 전해졌다.

미 정부가 김범석 쿠팡Inc 의장의 ‘법적 안전’을 거론하면서 쿠팡 문제가 해결되지 않으면 한국의 원자력 추진 잠수함 도입, 우라늄 농축 권한 확보 등 안보 합의 이행을 위한 협의가 어렵다며 안보 협상의 지렛대로 삼은 데 대한 항의 차원이다.

민주당 관계자는 “미국 정부와 의회 공화당 의원들의 의견 표명이 과도하다고 보고 입법부 구성원으로서 목소리를 내야 한다는 데 공감대를 형성했다”고 했다.

이날 강준현 민주당 수석대변인도 논평에서 “외국 정부가 몇 마디 한다고 해서, 그때마다 우리의 법 집행 기준을 바꿔야 하느냐”며 “쟁점은 분명하다. 위법 여부를 따지고, 법과 원칙에 따라 책임을 묻는 것”이라고 했다. 앞서 우원식 국회의장도 지난 24일 라디오 인터뷰에서 미국 공화당 의원의 항의 서한 발송에 대해 “우리나라 법률의 조치에 대해 내정 간섭하지 말라”고 했었다.

민주당 원내부대표인 박홍배 의원 등은 이날 민주당 의원 80여명으로부터 미 정부에 항의하는 단체 서한에 서명을 받은 것으로 전해졌다.

박 의원 등은 28일 오전 국회에서 기자회견을 진행한 뒤 미 대사관에 항의서한을 전달할 계획이다. 민주당 관계자는 “(항의 서한 작성) 소식을 듣고 동참 의사를 추가로 밝힌 의원들이 있어 내일까지 추가로 서명을 받을 수 있다”고 했다.
