□ 개요
◦ 그간 산업현장에서 꾸준하게 요구해온 근로자 정기교육 주기 확대, 타법에 따른 안전교육 중복 완화 등
교육 관련 규정을 개선하여 사업장의 부담을 완화하고 현장 작동성을 높이는데 기여
□ 주요 내용
➊ (보수교육 이수기간) 직무교육 대상자의 보수교육 이수기간을 신규 교육을 이수한 날을 기준으로
전후 3개월(총 6개월)에서 전후 6개월 (총 1년)로 확대(제29조제1항)
➋ (정기교육 주기) 근로자 정기교육 주기를 매분기에서 매반기로 확대(별표 4 제1호가목)
➌ (단기근로자의 교육시간) 1개월 이하 기간제 근로자 및 일용근로자의 채용 시 교육시간 개선
- 근로계약기간이 1주일 이하인 경우 채용 시 교육시간을 8시간에서 1시간으로, 1주일 초과 1개월 이하인 경우
8시간에서 4시간으로 완화(별표 4 제1호나목)
- 일용근로자가 채용 시 교육(또는 특별교육) 이수 후 1주일 동안 동일 사업장에서 동일 업무로 다시 종사하는 경우
해당 교육 면제(별표 4 제1호 비고 2)
➍ (교육중복) 타법에 따른 안전교육 이수 대상자의 교육시간 감면
- 시행령 별표1에 따라 보건에 관한 사항만 교육하는 사업은 해당 교육과정별(정기·채용 시·작업내용 변경 시·특별)
교육시간 2분의 1 이상 이수하도록 완화(별표 4 제1호 비고 3)
* 「광산안전법」, 「원자력안전법」, 「항공안전법」, 「선박안전법」
- 항만안전특별법에 따른 신규안전교육 이수 시 그 시간만큼 채용 시 교육시간 감면, 정기안전교육 이수 시
그 시간만큼 해당 반기의 정기교육시간 감면(별표 4 제1호 비고 4, 5)
➎ (관리감독자 교육) 일반 근로자 교육에서 분리하여 교육종류·시간, 교육내용 등을 별도로 규정(별표 4 제1호의2,
별표5 제1호의2)
