1.2 PERFORMANCE GUARANTEE
1. INTRODUCTION
This Performance Guarantee is submitted to Korea Heavy Industries & Construction Co., Ltd. (Hanjung / Contractor) by Supplier in conjunction with the technical descriptions, specifications and drawings included in the technical portion of Contractor’s Proposal.
“Employer” means the Project Owner.
2. RESPONSIBILITIES
Commissioning and start-up shall be carried out by the Contractor under his responsibility in presence of the Employer and in accordance with the manuals to be furnished by Supplier and approved by the Employer
3. GENERAL STATEMENT
The Supplier guarantees the equipment specified in the technical portion of the Proposal to meet this Performance Guarantee.
The performance tests shall be carried out in accordance with the procedures for start-up and commissioning, operation for test period, and performance tests described hereunder.
4. GUARANTEES
4.1 General
All performance guarantees and precondition data specified in this Performance Guarantee have been based on the data and general description of the Tender Documents.
Utilities, raw materials, vehicles, equipment not covered under this contract as well as operating personnel required for and during the period of commissioning and start-up shall be provided free of charge to Contractor by the Employer
Contractor shall provide :
· Initial filling of lubricants (including replacement oil to be provided after few hours of operation on certain machines)
· Initial equipment filling with wear and consumable parts (grinding media)
Lubricants and wear or consumable parts shall be Employer Scope of Supply as soon as the plant sections are producing saleable cement.
The operating personnel shall be trained by Contractor and Supplier in accordance with the Training Program.

5. START UP and COMMISSIONING
5.1 Notification of Commissioning
As soon as the Plant or any department thereof is, in the joint opinion of the Employer and the Contractor, completely erected (except in any minor respect which does not affect the operation or safety of such Plant or such department) and is ready for commissioning, the Contractor shall notify the Employer that such Plant or such department is ready for commissioning.
a) Contractor shall prepare a commissioning plan including time schedule, instructions and organisation and manning plan as well as lists of requirements of materials, utilities, vehicles, apparatuses and operating personnel necessary for the commissioning and start-up and shall submit them to the Employer for his approval two (2) months before the commencement of the commissioning and start-up.
The commissioning plan shall include a time schedule and shall be subdivided for the different plant sections as follows:
1. Clinker, gypsum and limestone discharge, crane and transport to gypsum/clinker storage.
2. Cement grinding plant.
b) Contractor shall for each section prepare and submit to the Employer two (2) copies of the following drawings and documents necessary for the commissioning and start-up not later than two (2) months before the commencement of the commissioning and start-up:
1. Flow sheets indicating main interlocking & regulation systems of the equipment to be commissioned.
2. Arrangement drawings (Plans and Elevations)
3. Machinery and equipment lists
4. Spare part lists
5. Inspection procedures
6. Instruction manuals for operations and maintenance
7. Other necessary documents
The commissioning plan shall be updated as required.
Contractor and the Employer can mutually agree to certain modifications to the commissioning plan, like test procedures, duration of test, calibration methods, etc.
5.2 Attaining Normal Operation Conditions
After the Plant or any department thereof is ready for commissioning as mentioned in Clause 5.1 (Notification of Commissioning) above the Contractor shall, with the Employer’s personnel in attendance, perform preliminary operations and thereafter bring such Plant or such department on stream and gradually up to normal operating conditions.
5.3 Notification for Performance
Upon attainment of normal operation of the Plant or any department thereof, attaining nominal rated capacity of the department, to the same standard as required for the Performance Tests, the Contractor shall notify the Employer in writing of the date on which the Performance Tests may commence, as per the Conditions of Contract. Within twenty four (24) hours after receipt of the above mentioned Contractor’s notification, the Employer will notify the Contractor whether he approves the Contractor’s notification or state reasonable grounds for its rejection. If this notification is not sent to the Contractor within the said twenty four (24) hours the Contractor’s notification shall be deemed to have been approved.
5.4 Defects during Commissioning
During commissioning, if any part of the Plant is found to be defective or it is found not to be performing in accordance with the requirements under the Contract, such part shall be repaired or replaced promptly by the Supplier in order to avoid any delay in the commissioning, in accordance with the provisions of the Conditions of Contract.
However minor defects which do not hamper the normal operation of the plant shall not withhold any tests and the issuance of performance test and provisional acceptance certificates.
1. OPERATION for START-UP, COMMISSIONING and PERFORMANCE TESTS
6.1 Supervision during Commissioning and Operation
The Supplier shall delegate technical commissioning specialists conversant with the English language in accordance with the provisions in the Contract to take charge of the commissioning and operation of the Plant, and to this purpose they shall supervise, instruct and direct the Employer’s personnel to operate the Plant in accordance with procedures and operating manuals provided by the Supplier, until the issue of the Certificate of Provisional Acceptance in respect of the Plant.
6.2 Availability of, Materials
The Employer shall provide, at his own expense, all input materials, additive materials, fuels, electric power, water and consumables which are necessary for commissioning and operation prior to the issue of the Certificate of Provisional Acceptance of the Plant.
6.3 Employer’s Personnel
The Employer shall provide, at his own expense, all necessary personnel (trained by Contractor and Supplier) for the operation and maintenance of the Grinding Mill System during commissioning and operation until the issue of the Certificate of Provisional Acceptance of the Plant.
2. PROCEDURES FOR PERFORMANCE TEST
7.1 Introduction
This part contains the basis for the Performance Tests and the description of the test procedures.
Performance Tests shall be carried out during the test period as specified herein.
During such tests, all important data necessary to establish the performance of the Plant or any department thereof shall be recorded at least once per hour.
If any interruption of any Performance Test is caused by the Supplier or is the Supplier responsibility and the duration and number of interruptions exceeds the limits defined in Clause 7.4 (Interruption of Performance Tests) of this part, such Performance Test shall be repeated in accordance with the Contract.
If during the execution of any Performance Test of the Plant or any department thereof, the guarantee value is achieved such Performance Test shall be deemed to have been passed. In the event this guarantee value is not reached, measuring tolerances as below shall be allowed.

7.2 Performance Test Procedure
7.2.1 General
The test procedure shall be submitted by the Supplier and mutually agreed between the Contractor & the Supplier (their specialists) prior to the tests.
7.2.2 Capacity
The Plant capacities will be determined by weighing either continuously by means of the weighing equipment of the relevant department or group of the Plant or by means of trucks and weigh bridges.
7.2.3 Power Consumption
The electrical energy consumption of medium and low voltage consumers will be measured in the relevant sub-station at the relevant medium or low voltage cubicle. In exceptional cases where this method is not possible, measuring at individual consumer feed line shall be executed.
7.3 Duration of Performance Test
The performance test shall be carried out for the duration marked below:

7.4 Interruption of Performance Test
The Performance Tests shall be carried out for the duration as specified under Clause 7.3 (Duration of Performance Tests) above.
The maximum allowable number of interruptions of the tests are as follows:

If during the performance test an interruption occurs which is not caused by Supplier, the performance test will be resumed after the interruption is over and after sufficient time for bringing the machinery and equipment back to optimum operating conditions.
Time spent prior to, and performance results attained before the interruption will be added to those after interruption.
If substantial additional costs are incurred by the issue of compensation shall be discussed between the parties.
3. SPECIFIC GUARANTEE TEST RUNS PER DEPARTMENT
Further details will be mutually agreed prior to test period.
Cement grinding
One performance test of 24 consecutive hours for fulfilling output and energy consumption guaranteed figures.
The guaranteed power consumption for the grinding Mill shall be max. 32.3 kWh/t at motor shaft and for the air separator shall be max. 1.5 kWh/t. at motor shaft.
4. LIQUIDATED DAMAGES
9.1 For each full unit of 1% less capacity than the guaranteed figure, in excess of
the tolerance, Supplier agree to pay Contractor 1.0% of the contract price .
9.2 For each full 1 kWh/MT power consumption above its guaranteed figure in
excess of the tolerance, Supplier agree to pay Contractor 1.0% of the contract price.
5. TOTAL DAMAGES
The total liquidated damages of Items 9.1 and 9.2 shall in no event exceed the maximum of 5% of the contract price.
