[000] Now, the Rest of the Story.
[001] It was a hot humid summer evening in (Vergin Grove). The
local saloon keeper directed a make-shift bar outdoors.
But in the midst of ostensibly benign comeraderie a
drunken argument cleared up out of the control.
[002] The man was hit in the head with a black jack. The
injured man was sent home to sleep it off, but three days
later he was dead.
[003] The authorities charged a fellow named Duff Armstrong
with murder. Duff needed a lawyer of course but he
couldn't afford a decent one, so an attorney friend of
the family bellieving Duff to be innocent took the case.
[004] He proceeded conscientiously. In jury selection he tried
to get men and women in Duff Armstrong's age, but there
was one wiitness whose account was detailed, definite and
potentially damaging. So Duff's lawyer would have to
concentrate on him, but had to break him down or somehow
discredited him, or the case was lost.
[005] The prosecution presented his testimony promptly. But
then cross-examining that witness Duff's attorney,
directed him to repeat his account what it happened on
August 29. "And please omit nothing", the lawyer said.
[006] The first of all replied the witness the moon was out
that night. whose very bright almost directed overhead
you could see what happened quite clearly. Duff Armstrong
picked up a black jack in the middle of fight and struck
the victim Jim Metzker in the head.
[007] It was an overhand blow, Duff raised his hand and came
down (harm). Duff's attorney then asked the witness to
stand and demonstrate. So he rose, stood in front of the
jury, went through a motiion precisely as he claimed to
observe them.
[008] And was the witness certain that how it happened.
[009] Yes, the witness was certain. There was a full moon after
all, high in the sky, plenty of lights, so there was no
mistaking.
[010] But Duff's lawyer was not satisfied. So repeated his
question the same question over and over, but tried as he
might there seemed no way to pass that unvarying
testimony.
[011] Each time he was asked, the witness recounted the same
actions and the same order under the same circumstances.
And thus did the prosecution's star witness discredit
himself.
[012] Because of the conclusion of that testimony Duff's
attorney submitted an evidence and almanac, and in that
almanac under August 29 was proof that on the night Duff
Armstrong allegedly struck Jim Metsger beneath the light
of a high full moon. The moon was, in fact, all but out
of sight in the western sky.
[013] So with a damaging testimony erased, Duff Armstrong was
acquitted and his attorney went home.

you remember him.
[015] Because the defense lawyer who rendered his service free
of charge because he believed the young man from (Virgin
Grove), Illisnois was innocent.
