Q1. 기수와 미수범에 대한 정의에서 intent의 차이가 있는가에 대한 질문이었고, criminal intent는 차이가 없다는 것이 핵심이었습니다.
조사해 보니,

아래의 Hypo 에서 기수와 미수를 결정하는 것은 의도가 아니라, 목표한 범행 결과의 완성에 있는 것으로 이해를 했습니다.
Ex: A shoots B with intent to kill.
•If wounded or miss, ATTEMPT.
•If mortally wounded, but alive, FRUSTRATED
•If killed, CONSUMMATED.
그렇다면, Frustrated v. attempted 를 구분짓는 것은 범행 목표를 이루기 위한 상당한 행위 (action)이 시작되었으나, 그후,
범죄 행위자의 control또는 예상 상황에 없는 다른 요인(independant factor)으로 인해 범죄 목표의 도달이 실패한 경우를 말하는 것으로 이해하게 되는데, 이 둘을 구분 짓는 objective test or factor 가 있는 것인지 궁금해 졌습니다.
이 부분에 대한 이해를 위해 참고 자료 (아래 첨부문서 4~6쪽; 제목"Attempt: An Overview of Federal Criminal Law) 에서 "Intent & Substantial Step" section을 읽어 보면,
1) the mere intent to violate a federal criminal statute is not punishable as an attempt unless it is also accompanied by significant conduct,” that is, unless accompanied by “an overt act qualifying as a substantial step toward completion” of the underlying offense.
2) And what constitutes a substantial step is a little more difficult to discern.
3) A substantial step is more than mere preparation.
4) A substantial step is action strongly or unequivocally corroborative of the individual’s intent to commit the underlying offense.-즉, 목표로 한 범죄 결과를 이루기 위해 '상당한 정도'의 행위를 단계별로 진행하여 가는 것을 의미하는 것으로 이해가 됩니다. 행위의 진행이 단선적으로 일어나는 것이 아니고, 일종의 스펙트럼으로 연속적으로 일어나는 것으로 보아야 하며, 그렇기 때문에 아래에서 언급하듯이, 어느 순간/기준점을 설정하기 보다는 범죄 각각의 상황 요소등을 종합하여 결정해야 한다는 의미로 이해됩니다.
5) Furthermore, the point at which preliminary action becomes a substantial step is fact specific; action that constitutes a substantial step under some circumstances and with respect to some underlying offenses may not qualify under other circumstances and with respect to other offenses.
2. Attempt-
1) Attempt is defined as an inchoate crime where an individual, with the intent to actually commit a crime, undertakes an action in furtherance of that crime, but ultimately fails.
three elements: (1) intent to commit a crime; (2) conduct that constitutes a substantial step toward completing the crime and (3) a failure to complete the crime.
3. The legal definition of Robbery:
Robbery is defined as the taking (or carring away) of another's property by force or threat against his or her will.
It is sometimes also referred to as larceny by threat or force. Because robbery involves injury or the threat of injury, it is considered a more serious crime than many of the otehr theft crime.

Sec. 939.32(3), Stats. 1985-86, the attempt statute, provides as follows: "An attempt to commit a crime requires that the actor have an intent to perform acts and attain a result which, if accomplished, would constitute such crime and that he does acts toward the commission of the crime which demonstrate unequivocally, under all the circumstances, that he formed that intent and would commit the crime except for the intervention of another person or some other extraneous factor."

범죄 행위를 attempt 하는 것은 행위의 시작(undertaking an action)까지를 포함한다.
행위의 시작이 목표로 한 결과로 이어지느냐 여부는 기수와 미수의 판단에 중요하다.
7. 동일 범죄 category에서도 형량의 차이가 있는 이유는?
범죄의 구성 요건을 충족하였더라고, 그 범죄에 이른 요건에는 정상 참작, 감경 요소등이 있다.

If a judge or jury finds a defendant guilty at the end of a criminal trial, the court must determine the defendant’s punishment. 이러한 형량 range의 존재는 범죄 행위의 결과에 촛점을 맞추기만 한 것이 아니라, 처벌의 목적이 rehab, prevention, justice 등에 있음을 고려하여 범죄자가 그러한 행위에 이르게 된 여러 사회, 경제, 정치, 심리적 다양한 요소등을 고려하여
동일 범죄라 하더라고 감경의 사유가 있음을 감안하고, 초범, 재범 및 중범 등 동일 범죄 행위 여부 (rehab가능성 여부)등을 종합적으로 가능한 객관적 요소로 고려할 수 있도록 하는데 목적이 있다고 생각된다.
8. 미수 범죄 처벌의 이유?
범죄 행위 착수-(commit a criminal act)가 가지는 사회적 위험도를 고려하여 범죄 행위의 기결(완료)에 이르지 못하였다 하더라도 그러한 행위를 처벌함으로써 societal justice and dangerous activity deterrance effect를 위한 것이다.

9. State v. Stewart 케이스에 상당한 시간을 할애하여 개념, 요건에 대하여 강조하여 설명을 하셨다.
형사법 수업 준비에서 항상 간과하게 되는 부분이 사건의 세부 사항, 요건에 대한 것을 완벽하게 파악하지 않고
두루뭉술하게 이해하는 정도로 하게 되는 경향이 있는데, 형법의 경우 특히 범죄의 구성 요건 및 그에 따른 형량의 차이가 크게 나기 때문에 특히 세부적인 부분까지 엄밀하게 파악해야 하겠다는 생각을 했습니다.
제가 이해한 부분에서 오류가 있거나 개념 이해가 잘못 된 부분이 있으면 말씀 주세요~
